HomeMy WebLinkAboutCity Council Minutes 09.04.1990Minutes of the City Council of Laurel September 4, 1990 A regular meeting of the City Council of the City of Laurel~ Montana, was held in the Council Chambers and called to order by Mayor Bob Gauthier at 7:06 p.m.~ on September 4, 1990. COUNCIL MEMBERS PRESENT: Norman Orr Donna Kilpatrick L.D. Collins Chuck Rodgers Lonnie Kellogg Bob Graham Ron Marshall Bruce Teeters COUNCIL MENBERS ABSENT: None INVOCATION: Invocation was given by Alderman Collins. MINUTES: Motion by Alderman Collins to approve the minutes of the meeting of August 21, 1990~ as presented, seconded by Rodgers. Motion carried 8--0. regular Alderman CORRESPONDENCE: Received a letter from the Laurel Herbstfest street closure, parade route and garbage pickup through the 23rd. Committee regarding from September 21st Received a letter advising the city that Town Pump received their retail on-premise consumption beer license. Received a letter from Governor Stan Stephens regarding a Governor's Summit Conference on Economic Growth and the Creation of Jobs which will be held in Helena at the Colonial Inn on October 11 and 12, 1990. CLAIMS: Claims for the month of August were reviewed by the Budget/Finance Committee and recommended that they be paid. Motion by Alderwoman Kilpatrick to approve all claims in the amount of $ 249,385.93 for the month of August, seconded by Alderman Collins. Motion carried 8--0. PUBLIC HEARING ON GARBAGE RATE INCREASE: This being the time and place advertised, a public hearing was held. PROPONENTS: Dave Michael presented the rate increase proposal. He stated it is needed in part to offset the dump fees the City of Billings is charging for us to dump our garbage in their landfill along with the expense of purchasing the needed equipment to run a transfer site. OPPONENTS: None The City Clerk received a letter from Mr. and Mrs. Kim Flohr, 1118 13th Avenue, who were protesting the service, not the rate increase. This letter was referred to the Garbage Committee. Mike Penne questioned whether he will be able to haul scrap sheet metal to the transfer site and he was told he can, Motion by Alderman Collins to close the public hearing, by Alderman Orr. Motion carried 8--0. seconded Discussion followed regarding whether the city permit from the state and how this could reduce that needs to be hauled to Billings. can obtain a burning the amount of garbage Dave Michael reported that we need to get our transfer site operational soon because it is costing the city $ 500.00 a week to dump in Billings due to the compacted garbage rates that they charge. If our trucks can dump in our own holding bins at the transfer site~ we can then haul the bins to Billings and we will be charged a lose garbage rate which is much cheaper. RESOLUTION NO. 2482 ANNUAL RESIDENTIAL REFUSE COLLECTION FEES Page 2 Council Minutes of the City Council of Laurel Meeting of September 4, 1990 LAUREL HERBSTFEST COMMITTEE: Mike Penne, representing the Herbstfest Committee, sent a letter which was presented in the correspondence regarding a street closure, the parade route and garbage pickup for the Herbstfest. Mike requested permission to close East Eighth Street from First Avenue to the alley west of Pennsylvania Avenue from Friday at 4:00 p.m. through Sunday night at approximately 10:00 p.m. He stated they expect a much larger crowd this year because of the Hicky Skaggs concert on Friday and there is also a football game on Saturday afternoon. Having been in the Police Reserves for many years, Mike is familiar with the problems that arise and he feels it would be beneficial to completely close the street. He said in the past that the barricades were only down for approximately three hours each night. The parade will follow the same route as in the past. It will start at the Graff School and proceed to Main Street, continue west on Main and turn north on First Avenue to Sixth Street~ west to Third Avenue~ north to Ninth Street and east to Second Avenue where it will disperse. Mike said there were some problems with the garbage collection last year but he has already spoken to Dave Michael regarding this and it has been worked out. More discussion followed regarding the street closure. Mike stated that the committee requested that the School Board allow parking in the Graff School playground area but it was denied. Alan Crowe stated that parking is going to be a problem for all the activities taking place but he has no problem with closing the street. Mike stated that the north school lot is going to be used for parking mobile homes this year and they will be directed there as they start moving in. The committee wants to utilize all the space they can in the high school parking lot for the Friday night concert. Motion by Alderwoman Kilpatrick to allow Eighth Street and to approve the parade route, Collins. Motion carried 8--0. the closure of East seconded by Alderman Mike also inquired whether the city actually has a policy regarding the throwing of candy from parade vehicles. The Mayor said we do not have anything official on this but the council's policy is that we prefer that candy not be thrown for safety reasons. DEBBIE TEDSTROM - RECYCLING PROGRAM IN LAUREL: Not present. TRANSFER OF WATER DEPOSIT CASH FUND TO WATER OPERATING FUND: RESOLUTION NO. 2483 AUTHORIZING TRANSFER OF WATER DEPOSIT CASH FUND TO WATER OPERATING FUND Motion by Alderman Collins that Resolution No. 2483 be passed and adopted, seconded by Alderman Orr. Motion carried 8--0, COMMITTEE REPORTS: --Cemetery Committee minutes of August 31, 1990 were presented and reviewed. Motion by Alderman Orr to enter August 31, 1990, into the record, Motion carried 8--0. the Cemetery Committee minutes of seconded by Alderman Collins. --City Council Committee of the Whole minutes of August 21, 1990 were presented. Motion carried 8--0. HOME OCCUPATION: Terry Steinmasel, 1013 13th Avenue, has applied for a Home for a gum ball vending business. The Planning Board approval. Terry was not present at the council meeting. Occupation recommended Motion by Alderman Marshal] to approve the home occupation for Terry Steinmasel, seconded by Alderman Orr. After discussion, there was a motion to table. Motion by Alderman Kellogg to table the motion for Terry Steinmasel's home occupation until September 18, 1990, seconded by Alderwoman Kilpatrick. Motion carried 8--0. --Parks Committee reviewed. minutes of August 24, 1990 were presented and Motion by Alderwoman Kilpatrick to enter the Parks Committee minutes of August 24, 1990, into the record, seconded by Alderman Orr. Motion carried 8--0. Discussion followed regarding the "Deadfest" to be held in South Pond Park on September 8th. At the Parks Committee, Bob Strand stated there would be a private gathering which will be open to the public, to commemorate the fish kill. Beer will be available but will not be sold. Milt Wester said this is something a few guys decided to do just for the fun of it. Bob Strand will have his band there, beer will be available but not sold and there may be a fishing derby. No organization in Laurel is sponsoring it and Milt said it is to be an informal gathering for the fun of it and not intended to be a fund raiser of any sort. It was noted that two of the applications for city licenses on the August 14, 1990 City License Committee minutes were not approved. Motion by Alderman Collins to grant Sonshine Electric and F.B. Services & Beigel Services city business licenses, seconded by Alderman Orr. Motion carried 8--0. MAYOR'S COMMENTS: The Mayor stated that there is a Fourth of July Committee and he listed the different committees who will have representatives on it. The Mayor appointed the Garbage Committee chairman, Bob Graham, to the committee. Motion by Alderman Orr to to the Fourth of July Committee, carried 8--0. confirm the appointment of Bob Graham seconded by Alderman Rodgers. Motion The Mayor appointed Chuck Rodgers, committee. Police Committee chairman, to the Motion by Alderman Graham to confirm the Mayor's appointment of Chuck Rodgers to the Fourth of July Committee, seconded by Alderman Orr. Motion carried 8--0. The Mayor appointed Donna Kilpatrick, representing the Parks Committee, to the Fourth of July Committee as chairman. Motion by Alderman Collins to confirm the Mayor's appointment of Donna Kilpatrick to the Fourth of July Committee as chairman, seconded by Alderman Graham. Motion carried 7--1, with Alderman Teeters voting, "NO." The Mayor appointed Ken Olson as the Fire Department representative. Motion by Alderman Collins to confirm the Mayor's appointment of Ken Olson to the Fourth of July Committee. seconded bv A]derm~m Orr. Motion by Alderman Orr to confirm the Mayor's appointment of Fred Feuerbacher to the Fourth of July Committee, seconded by Alderman Graham. Motion carried 8--0. The Mayor appointed Peg Olson as representative of the Chamber of Commerce. Motion by Alderman Kellogg to confirm the Mayor's appointment of Peg Olson to the Fourth of July Committee, seconded by Alderman Orr. Motion carried 8--0. The Mayor appointed Keith Thompson as a representative from the Christmas to Remember Committee. Motion by Alderman Collins to confirm the Mayor's appointment of Keith Thompson to the Fourth of July Committee, seconded by Alderwoman Kilpatrick. There being a division of the house, a roll call vote was taken. Motion denied 6--3 with Aldermen Marshall, Collins and Alderwoman Kilpatrick voting, "YES." Aldermen Graham, Orr~ Kellogg~ Rodgers and Teeters voted, "NO." Bob Graham stated he is not against Keith Thompson but against the Christmas to Remember Committee being represented on this. Discussion followed and the Mayor stated Keith Thompson volunteered to serve as a representative of the Christmas to Remember Committee and also his own concession stand because of activities they have in the park and downtown over the Fourth of July. Bob Graham changed his vote to "YES." Motion is now tied 4--4. The Mayor broke the tie with a "YES" vote. Motion carried. Keith was appointed as a member at large. The Mayor appointed Judy Ludwig and Bob Wommack as at large members. Motion by Alderman Collins to confirm the Mayor's appointments of Judy Ludwig and Bob Wommack as at large members to the Fourth of July Committee, seconded by Alderman Marshall. Motion carried 8--0. The Mayor appointed Jim Worthington and Dave Michael as city representatives to the committee. Motion by Alderman Orr to confirm the Mayor's appointment of Jim Worthington and Dave Michael to the Fourth of July Committee, seconded by Alderman Teeters. Motion carried 8--0. Bob Gauthier stated he was not able to contact anyone from the Jaycees and if someone can contact them, we can get a representative from their group on the committee also. Donna Kilpatrick asked permission to leave the state from September 17th through the 21st. Motion by Alderman Orr to grant Donna Kilpatrick permission to leave the state, seconded by Alderman Kellogg. Motion carried 8--0. There being no further business to come before the council at this time, the meeting was adjourned at 8:15 p,m. Donald L.
