July 3, 1990
A regular meeting of the City Council of the City of Laurel,
Montana, was held in the Council Chambers and called to order by Mayor
Bob Gauthier at 7:00 p.m.~ on July 3, 1990.

Motion by Alderman Kellogg to approve the minutes of the
meeting of June 19, 1990, as presented, seconded by Alderman

Received the Montana League of Cities and Towns Executive Director's
Report, dated June 29, 1990.
Received a letter from Curt Rieman requesting permission to hold his

FINAL REPORT ON CANTRELL PROPERTY:
Jim Worthington gave the final report on the Cantrell property. Mr
Cantrell has fenced the property with a five wire fence, the ditch has
been placed as requested and a subdivision plat has been prepared
which meets the requirements set forth by the council. The plat has
been signed by Mr. Cantrell and his wife along with two utility
companies and there are still two utilities that have to sign off on
it.
Jim stated that in checking with the abstract company today, the title
report indicates no encumbrances and the taxes have been paid. Jim
recommends that the council allow the property to be deannexed and at
the same time that the plat is recorded, he must provide the city a
warranty for the 16 lots that are to be deeded to the city as part of
the agreement.
Joe Bradley said the motion should be to allow the Mayor and the City
Clerk to execute the plat but it should be executed last and everyone
else should sign off first. We do not have the abstract or
certificate in writing yet but Jim did talk to them today and Joe will
need to see it before signing.
Motion by Alderman Kellogg to authorize the Mayor and the City
Clerk to sign off subject to (1. everyone else signing (2. getting the
abstract and certificate in writing and {3. subject to Cantrell
providing the city with the warranty deed for the 16 lots, seconded by
Alderwoman Kilpatrick.
Joe Bradley stated he received a call from Mrs. Devener after the last
council meeting regarding her misunderstanding of the buffer zone
behind her property.
It was stated that the buffer zone was strictly the green lots on the
map presented but there was a platted street behind all but the two
lots directly behind Mrs. Devener's property. Cal Cumin said the idea
of having the street as part of the buffer zone was never a part of

the discussion. The street was included so the city would have access
to the lots~ but it was never intended as a buffer to the buffer zone.
The intention was to have a one lot buffer and this is what we have.
A vote was taken on the motion. Motion carried 4--1 with
Collins voting, "NO."
AGREEMENT WITH CITY OF BILLINGS TO RENT "ROLL OFF" TRUCK:

A RESOLUTION APPROVING AN AGREEMENT BETWEEN
THE CITY OF LAUREL AND THE CITY OF BILLINGS,
SAID AGREEMENT RELATING TO THE RENTAL OF A
GARBAGE "ROLL OFF" TRUCK
Motion by Alderwoman Kilpatrick that Resolution No. 2451 be
passed and adopted, seconded by Alderman Collins.
The Mayor stated that the city needs to rent this truck to carry the
large transfer site containers to Billings until we get our own truck
in December. This will not alleviate the need for our regular garbage
trucks to dump each load in Billings once the transfer site is in
place.
The rent on this truck will be $ 20.00 per hour and a man from Laurel
will go to Billings and pick up the truck with the time starting at
that point. It was stated that this truck is an extra for the City of
Billings and it would be much more feasible for Laurel if we could
store the truck here and avoid paying the run around costs.
It was stated that Billings will service and maintain the truck under
the rental agreement but it was questioned whether the fuel is
included in this cost. It was also discussed whether Laurel would
have to carry additional insurance if this truck was stored in Laurel.
The Mayor stated he will check with Ken Haag and Alan Tandy to see if
some kind of arrangement can be made regarding the storage of the
truck.
At this time the motion was voted on. Motion carried 5--0.
PROHIBIT PARKING IN RESERVED CITY BALL EMPLOYEE PARKING SPACES:
ORDINANCE NO. 977 (second reading)
ADDING SECTION 16.68.015 TO THE LAUREL MUNICIPAL
CODE, TO PROHIBIT PUBLIC PARKING IN RESERVED
PARKING SPACES ADJACENT TO LAUREL CITY HALL ON
THE WEST SIDE OF THE ALLEY LYING BETWEEN FIRST
AVENUE AND SECOND AVENUE AND RUNNING FROM WEST
FIRST STREET TO WEST THIRD STREET, RESERVED
PARKING FOR CITY HALL EMPLOYEES

PARK RULES - PICNIC SHELTER:
RESOLUTION NO. 2452
A RESOLUTION APPROVING RULES GOVERNING
USE OF CITY PARKS
Motion by Alderwoman Kilpatrick that Resolution No. 2452 be
passed and adopted~ seconded by Alderman Graham. Motion carried 5--0.
Joe Bradley said a $ 10.00, non-refundable fee will be required to
reserve the picnic shelter in advance. Those wanting to reserve it
will be required to fill out an application at City Hall which needs
to be signed by the police department and the engineer's office. The
engineer's office will post a copy of the reservation at the shelter
and the party reserving it will have a copy, which they should have in
their possession at the shelter.
Joe said someone needs to be named on the application as the
responsible party and should include their namer address, and phone
number. If there is any damage, they would be contacted.
No cooking over an open flame or barbecuing is allowed within or under
the picnic shelter.
FINANCIAL AID FOR SWIM LESSONS AND ADMISSION TICKETS:
The Mayor stated two families have inquired whether there is financial
aid for swim lessons and admission tickets. This has been discussed
in the past but there has never been a request for it until this year.
Bob checked with Billings and got a copy of the standards they go by.
They base their program on the school lunch standards for low income
families and currently they have two families on the program. One is
on the reduced fee and the other is free.
Bob said if a family qualifies for the program in Laurel, it will just
be free. This way we will not be denying anyone under the age of 18
use of the pool and it will help keep children out of the ditches
around town.
The Parks Committee minutes were referred to at this time.
Motion by Alderwoman Kilpatrick to accept the committee's
recommendation to adopt the guidelines Billings has for free swim
lessons and admission tickets for those who qualify, seconded by
Alderman Collins. Motion carried 4--1 with Alderman Kellogg voting~
Discussion followed regarding what system the city should use for the
daily admission passes.
This was referred back to the Park Committee to implement the rules.

Discussion followed regarding complaints that too many people are on
the roof of the old concession stand building which is now a scorer's
booth. For safety reasons~ the roof can only accommodate three people
at one time and there have been reports of 12 people being on there.
Jim Worthington recently spoke to the American Legion and informed
them again that three people is the limit.
The question was asked how it was first determined to allow only three
people on the roof. Jim stated that the American Legion requested
that they be allowed to put a person on the roof to keep score and Jim
told them we do not know the structural strength of the roof until it
is analyzed. A verbal agreement was made not to have more than three
people up there at one time.
Joe Bradley stated that this is a city building and we are responsible
for it so we need to make sure it is safe.
Discussion followed regarding a tribute to D.J. McGillen to be placed
in a city park. It was felt that the firemen may have something in
mind and we need to speak to them first.
Jim Worthington reported that they are planning to keep the pool open
during the regular hours on the 4th of July but if conditions warrant,
it may be closed early for crowd control.
Lonnie Kellogg brought up an item that was discussed at the June 19th
council meeting regarding an asphalt charge for work done at 311
Montana Avenue. The party was charged for asphalt replacement on the
side of the street where there was no asphalt to begin with.
Motion by Alderman Kellogg to refund the difference between alley
restoration and street asphalt on work done at 311 Montana Avenue,
seconded by Alderman Graham. Motion carried 5--0.
COMMENTS FROM THE AUDIENCE:
Milt Wester commented on the old concession stand in Thomson Park. He
said he was involved in this when it was built and frankly, no one
should be on it. It is a flat roof which can easily be cracked or
damaged. It was originally built to house the light switches for the
ball field and it temporarily housed the concession stand until the
new one was built. It is now a storage shed with no safe or
convenient way to reach the roof.
More discussion followed and Milt said the roof gave them problems
from the start and Jim Flisrand went up and made it sound to be a roof
only and not a platform for people to stand on.
Cal Cumin stated the Shiloh interchange issue has come up again and
needs support. Bozeman has done a lot of design work and contributed
thousands of dollars to an interchange on 19th Street in Bozeman and
they will be ready for construction in October. We here in the
Yellowstone Valley, have not got our act together yet as to where the

Shiloh interchange is going to be built. Cal said what is going to
happen is if we cannot consolidate our opinion down here in the valley
as to where the interchange is going to go, we are going to loose it.
Cal said we have to keep our hat in the ring and keep it stirring
constantly.

that will be supported will be the most easterly one which is actually
located east of the KGHL radio towers. This site is favored because
it is presenting the least controversy.
