HomeMy WebLinkAboutOrdinance No. 533rr r ORDINANCE NO. 533 BEING AN ORDINANCE AMENDING ORDINANCE NO. 502 AND 441 RELATING TO THE LICENSING OF CERTAIN OCCUPATIONS, INDUSTRIES, TRADES, PURSUITS AND PROFESSIONS IN THE CITY OF LAUREL, AND REQUIRING PAYMENT OF A LICENSE FEE, ESTABLISHING "THE PROTECTION OF LIFE AND PROPERTY FUND", PROVIDING FOR THE ENFORCEMENT OF THIS ORDINANCE, AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAUREL: Section 1. That all ordinances or portions thereof inconflict with this ordinance and in particular Section 2 of Ordinance No. 502 are hereby repealed. LICENSES IN GENERAL Section 2. LICENSES, No person, firm, association, or corporation, shall conduct, operate, transact, engage in, or carry on any of the industries, pur- suits, trades, professions, vocations, or businesses, with the City of Laurel, hereinafter specified and enumerated, without first applying for an obtaining a license therefore from said City of Laurel as herein provided; and, if such app- lication for licenses be granted, shall pay therefor as follows (provided that any mixed business conducted under one roof), with the exceptions of the business of selling cigarettes, selling beer and liquor or holding public dances, shall pay the maximum licenses required for any one of such businesses if conducted under separate roofs and in distinct and separate buildings and should any dis- pute arise as to the application of this provision, it shall be decided and controlled as provided in Section et seq of this ordinance; however, in the event that a lic- enze shall be requested after the commencement of the regular license year that the license fee herein innumerated shall be pro-rated quarterly, the applicant paying only that portion of the license fee commencing with the nearest quarter previous to his application: Accountants: $35.00 per year. Apartments, Hotels, Boarding and Rooming Houses and rental units of any kind and nature in which there are three or more rental units, the sum of $2.00 per unit per year to a maximum of $35.00. Boxing Exhibitions: Every boxing match or boxing exhibition where ad- mission is charged shall pay a fee of $10.00 per day. Carnival Street Fair, Tent Show or so-called roundups: Other than circuses, menageries, dog and pony shows, and wild animals shows, the sum of $25.00 per day; provided that said license shall apply whether any of said activities operate within the city limits of the City of Laurel, or outside and within three miles of said city limits; and provided none of said named amuse- ments shall operate in any location other than designated in the license. Circuses Menageries: Dog and pony shows, wild animal shows, including side shows, transported on alore than 25 railroad cars, $125.00 per day; same transported on less than 25 railroad cars, $75.00 per day; it being provided that if transportation is made by truck that the City Treasurer shall determine the number of railroad cars that would be required to transport equipment, and license shall be paid according to the number of railroad cars that would be ncessary; and provided, further that said license shall apply whether any of said activities operate within the city limits of the City of Laurel, or outside and within three miles of said city limits; and provided none of said named amuse- ments shall operate in any location other than designated in the license. Cabins: $2.00 per cabin per year, to a maximum of $35.00 per year. Cafes or Restaurants: $45.00 per year. Card Tables: $10.00 per table Chiropractor: $35.00 per year. Cigarettes: $5. 00 per year. Contractors: Contractors: (building) $35.00 per year. (painting) $35. 00 per year. Contractors: (house moving and excavation) $35.00 per year. THOMAS L. Commission Merchants and Wholesale Grocers: Handling fresh fruits, vegetables, eggs, meat and other perishable products, at a fixed place of business, $35. 00 per year. Confectionary: (retail) $35.00 per year. Cold Storage: $35.00 per year. Dairies: (retail sale and delivery products including wholesale delivery to retail outlets) $100-. 00 per year. Public Dance Halls: $50.00 per year, or $5.00 per dance; provided however, that no such license shall be required. from religious, charitable, or duly chartered fraternal organizations, or other similar organizations; such public dance halls being defined as any public dance hall, public dance, dance, cabaret, beer parlor, restaurant, cafe night club, or any other place maintained for promiscuous and pulbic dancing, the rules for admission to which are not based upon personal selection or invitation; it being provided, that the fact that no admission charged is made shall not affect the nature thereof; and it being provided that the license fee so required for such public dance shall be in addition to any other license paid under this ordinance. Dry goods: $35.00 per year. Dogs, Male: Tte owner of each and everymale dog kept or staying within this City shall pay a tax of $2. 50 per year. Dogs, Female: The owner of every female dog, which is kept, or stays in the City, shall pay a tax or license of $1000 per year. The whole of such dog tax shall be paid to the City Treasurer at his office on demand or notice from the Chief of Police, and a failure to pay such tax for the whole period of 10 days after such notice, shall be taken as conclusive evidence of abandonment of owner- ship of any dog assessed to any person. Every dog, whether male or female, found within the City, abandoned or without an owner or person having charge of the same and responsible for the tax thereon, or for which the owner thereof has neglected for the period of 10 days after said notice to pay the tax, thereon, THOMAS L. BRADLEY - - ATTORN 5Y-AT-4A W LAUREL, MONTANA • l_ shall be subject to be killed by the Chief of Police or any policeman of this City, or other person, on the order of the Chief of Police and it is hereby made the duty of the Chief of Police and policemen cooperating with the City Treasurer, to notify every owner of a dog kept within this City, of, and demand and collect the payment of such tax, and to put to death every abandoned dog staying or kept within this City, for which no owner can be found after diligent inquiry, and every dog for which no tax is paid, by the owner or some person for the owner, after said notice. Provided, that the provisions of this section shall not apply to the ddg or dogs of strangers, travelers, and persons visiting the City, and sojourning therein for a period not exceeding 30 days. Frozen Food: (wholesale) $35.00 per year. Funeral Homes: $35.00 per year. Furniture Dealers: $35.00 per year. Gas Company: (natural) $100.00 per year. Garage: (repairs, oil, accessories) $35. 00 per year. Gaoceries: $45.00 per year. Hucksters: Any person engaged or employed in the business of buying and selling or selling on commission, any fruits, vegetables or other farm produce at retail to consumers by going from house to house the sum of $35.00 per year. Itinerant Merchant: Each itinerant merchant, before conducting any bus- iness as herein defined with the corporate limits of the City of Laurel, Montana, THOMAS L. BRADLEY ATTOR N 2Y•AT-LA W LAUREL, MONTANA -4- shall make application to the City Treasurer of said City for license, which license, when issued, shall not be transferable, specifying in said application his name and residence, the number of days or the period of time he will be engaged in said City in the conduct of such business, the article or articles to be sold or offered for sale, and the manner of conducting said business, and shall pay for license $100.00 per year or any part of a year; all licenses expire on December 31st of each year. Such transient retail mer- chant being defined as every person, firm or corporation, himself, or itself, or representing any other person, firm or corporation, who or which brings into temporary premises, to the City of Laurel, a stock of goods, wares or articles of merchandise or notion, or other articles of trade, and who or which solicits, sells or offers to sell, or exhibits for sale, such stock of goods, wares or art- iclds of merchandise or notions or other articles of trade at retail, is with the meaning of this ordinance, a transient retail merchant, and such definition shall continue to apply until such person, firm or corporation shall be continuously engaged at such particular places in the city for a period of one year. "Temporary premises" within the meaning of this ordinance shall mean and include any hotel, rooming house, store room, building or any part of any building whatsoever, tent, vacant lot, freight, station, railroad car, or any public or quasi-public place, temporarily occupied for such business.
