December 17, 1991
A regular meeting of the City Council of the
Montana, was held in the Council Chambers and called
Bob Gauthier at 7:00 p.m., on December 17, 1991.

Motion by Alderman Marshall to approve

CORRESPONDENCE:
Received a membership bulletin from the Montana League of Cities and
Towns regarding the special session of the legislature.
Received the November minutes and activity report from the Air
Pollution Control Board.
Received a letter from the Montana Department of Health and
Environmental Sciences regarding the Laurel Landfill and Transfer Site
Inspection.
Received a picture and an anonymous note regarding the junk stored at
the Fred Winter's residence.
CITY CLERK AND CITY TREASURER'S FINANCIAL STATEMENTS:
The City Clerk and City Treasurer's financial statements for the month
of November were presented.
Motion kM Alderwoman Kilpatrick that the City Clerk and City
Treasurer's financial statements for the month of November, 1991, be
approved~ seconded by Alderman Collins. Motion carried 8--0.
JACK REHBERG - SAFETY AWARD FROM AAA:
Jack Rehberg, board member with the Montana Automobile Association,
congratulated the City of Laurel and presented them the 1990
Pedestrian Safety Citation. This is the fourth consecutive year that
Laurel has received it without having a pedestrian fatality. Montana
is only one of two states, out of the 27 that participate nation wide,
that has had 100% participation.
MIDLAND ROOFING - CITY LICENSE:
A representative from Midland Roofing stated they opened the office in
Laurel but found it was not cost efficient, so they have centralized
everything back to the main office in Billings. The Laurel office was
shut down, but there is the possibility that it will open again in
March when roofing gets under way. If they do open in the spring,
they will go through the process and get the fire inspection at that
time.
Joe Bradley stated that Midland Roofing already had a business license
but when they established the office in Laurel, they needed
confirmation of the license. The fire inspection will be done when
they reopen in the spring.
Motion ~3_Alderman Collins to confirm a city business license for
Midland Roofing, seconded by Alderman Marshall. Motion carried 8--0.

AGREEMENT WITH DOUBLE-TREE, INC. FOR GRANT WRITING SERVICES:
Don Hackmann stated that what Double-Tree, Inc. needs is a motion to
retain their services. Then, if the grant is awarded, a suitable
agreement will be entered into.
Motion by Alderman KelloRg to retain Double-Tree, Inc. for grant
writing and management services pertaining to a CDBG application on
behalf of Big Sky Laminates, Inc., without compensation, and, in the
event a grant is awarded, then to enter into a suitable, written
agreement for management, consulting and administrative services, by
resolution, seconded by Alderman Marshall. Motion carried 8--0.
AUTHORIZING CDBG GRANT APPLICATION:

RESOLUTION TO AUTHORIZE SUBMISSION OF
APPLICATION
Motion by Alderman Marshall that Resolution No. 2569 be passed
and adopted, seconded by Alderman Graham. Motion carried 8--0.
ESTABLISHING DUMP FEES FOR DISPOSING OF SHINGLES:
RESOLUTION NO. 2570
ESTABLISHING DUMP FEES FOR WOOD, CONSTRUCTION
OR DEMOLITION MATERIALS, AND OTHER GARBAGE,
RUBBISH AND TRASH
Motion by Alderwoman Kilpatrick that Resolution No. 2570 be
passed and adopted, seconded by Alderman Collins. Motion carried
8--0.
RE-CODIFICATION OF EXISTING ORDINANCES:

AMENDING SECTION 2.04.030 OF THE LAUREL
MUNICIPAL CODE, MAYOR AS PRESIDING OFFICER

Motion by Alderman Orr to close the public hearing! seconded by
Alderman Rodgers. Motion carried 8--0.
Motion by Alderman Orr that Ordinance No. 999 (second reading) be
passed and adopted, seconded by Alderman Graham. A roll call vote was
taken and all aldermen voted, "YES." Motion carried 8--0.

Motion by Alderman Orr that Ordinance No. 1001 second reading)
be passed and adopted, seconded by Alderman Graham. A roll call vote
was taken and all aldermen voted, "YES." Motion carried 8--0.

AMENDING SECTION 2.96.240 OF THE LAUREL
MUNICIPAL CODE, GROUP INSURANCE

Motion by Alderman Marshall to close the public hearing, seconded
by Alderman Kellogg. Motion carried 8--0.
Motion by Alderman Kellogg that Ordinance No. 1002 (second
reading) be passed and adopted, seconded by Alderman Collins. A roll
call vote was taken and all aldermen voted, "YES." Motion carried
8--0.

call vote was taken and all aldermen voted, "YES." Motion carried

Motion by Alderman Marshall to close the public hearing, seconded
by Alderman Kellogg. Motion carried 8--0.
Motion by Alderman Rodgers that Ordinance No. 1006 (second
reading} be passed and adopted, seconded by Alderman Orr. A roll call
vote was taken and all aldermen voted, "YES." Motion carried 8--0.
COUNCIL APPOINTMENT OF NEW MAYOR:
Motion by Alderman Orr to accept Mayor Gauthier's resignation as
of December 31, 1991, seconded by Alderwoman Kilpatrick. All aldermen
voted, "YES" except Alderman Kellogg, who voted, "NO." Motion carried
7--1.

Motion by Alderman Orr to nominate Chuck Rodgers as Mayor,
seconded by Alderman Teeters.
Motion by Alderman Kellogg to close the nominations, seconded by
Alderman Orr. Motion carried 8--0.
A roll call vote was taken for Bob Graham for Mayor. Aldermen
Marshall, Orr, Kellogg, Rodgers and Teeters voted, "NO." Aldermen
Graham, Collins and Atderwoman Kilpatrick voted, "YES." The vote was
5--3 against Graham for Mayor.
A roll call vote was taken for Chuck Rodgers for Mayor. All aldermen
voted, "YES." The vote was 8--0 in favor of Rodgers for Mayor.
Chuck Rodgers was elected by the council to replace Bob Gauthier as
Mayor, effective January 1, 1992.

COMMITTEE REPORTS:
--Ambulance Committee minutes of December 12, 1991 were presented and
reviewed.
Motion by Alderman Teeters to enter the Ambulance Committee
minutes of December 12, 1991, into the record, seconded by Alderman
Marshall. Motion carried 8--0.
The Mayor appointed the following people to the ambulance reserve:

Motion by Alderman Teeters to confirm the Mayor's appointment of
the people listed above to the ambulance reserve, seconded by Alderman
Orr. Ron Marshall abstained from voting because one person is his
daughter. Motion carried 7--0.

INCREASE IN REFUSE COLLECTION
RESOLUTION NO. 2571
BEING A RESOLUTION OF INTENT TO ESTABLISH AN
INCREASED REFUSE COLLECTION FEE SCHEDULE~ TO
BECOME EFFECTIVE TEN (10) DAYS AFTER FILED WITH
MUNICIPAL CLERK AND REVISED RATE SCHEDULE ON FILE
Motion by Alderman Marshall that Resolution No. 2671 be passed
and adopted, seconded by Alderman Rodgers.
Bob Graham and Dave Michael explained the worksheets that were
attached to the minutes concerning the increase. Discussion revolved
around the increased volume of garbage due to the roof repairs and
whether to charge the commercial district the same as the residential.
Dave proposed that the garbage rate be increased by $ 1.00 per unit of
garbage for both residential and commercial.

reviewed.
Motion by Alderman Collins to adjust the sewer
average for Walter Reiter, seconded by Alderman

Discussion regarding Cenex Transportation's request to hook into our
city sewer line. Bob Gauthier stated that if this includes the area
where the trucks are washed, he does not recommend allowing them to
hook up to our sewer line. It was the consensus of the council not to
allow this.

Motion by Alderman Collins to adjust Cleve Hull's sewer bill and
sewer average, seconded by Alderman Graham. Motion carried 8--0.
MAYOR'S COMMENTS:
Bob Gauthier stated this would be his last meeting and he thanked the
Council as a whole and each individual department head.
Lonnie Kellogg thanked the Mayor for keeping the City on track over
the last few years and said all the Council appreciates the time he
has put in. Lonnie also thanked Bruce Teeters for serving on the
Council and stated they have both earned his respect.
Darrell McGillen presented Bob Gauthier with a fireman's cap on behalf
of the Fire Department.
Chuck Dickerson questioned whether the person appointed to fill the
alderman vacancy will have to run in the next municipal election. Joe
Bradley stated they would have to run to fill out the unexpired term.
REPAIR HAIL DAMAGE TO CITY BUILDINGS
Ed Bailey with Midland Roofing stated he worked with the insurance
adjustor when estimating the damage to city buildings. His company is
requesting permission for them to proceed with the work.
Jim Worthington stated the Council has given him permission to repair
the five buildings that are leaking now at Riverside Park. The
remaining ones will be bid next spring.
There being no further business to come before the Council at
time, the meeting was adjourned at 8:38 p.m.
