COUNCIL MEMBERS PRESENT: Norman Orr Donna Kilpatrick Bruce Teeters Bob Graham L.D. Collins Chuck Rodgers COUNCIL MEMBERS ABSENT: Ron Marshall Lonnie Kellogg INVOCATION: Invocation was given by Alderman Collins. MINUTES: Motion by Alderman Collins to approve the minutes of the regular meeting of November 19, 1991, as presented, seconded by Alderman Orr. Motion carried 6--0. Received a December 31, CORRESPONDENCE: Received a newsletter dated November 1991, Cities and Towns. letter of resignation from 1991. CLAIMS: from the Montana League of Mayor Gauthier, effective RE-CODIFICATION OF EXISTING ORDINANCES: ORDINANCE NO. 999 (first reading) AMENDING SECTION 2.04.030 OF THE LAUREL MUNICIPAL CODE, MAYOR AS PRESIDING OFFICER Motion by Alderwoman Kilpatrick that Ordinance No. 999 (first reading) be passed and adopted, seconded by Alderman Orr. A roll call vote was taken and all aldermen present voted, "YES." Motion carried 6--0. ORDINANCE NO. 1000 (first reading) AMENDING SECTION 2.12.020 OF THE LAUREL MUNICIPAL CODE, ELECTIVE AND APPOINTIVE OFFICES Motion by Alderman Orr that Ordinance No. 1000 (first reading) be passed and adopted, seconded by Alderman Graham. A roll call vote was taken and all aldermen present voted, "YES." Motion carried 6--0. ORDINANCE NO. 1001 (first readingl AMENDING SECTION 2.16.010 OF THE LAUREL MUNICIPAL CODE. DUTIES. (CITY CLERKI Claims for the month of November were reviewed by the Budget/Finance Committee and recommended that they be paid. Motion by Alderwoman Kilpatrick to approve all claims in the amount of $ 203,324.02 for the month of November, seconded by Alderman Orr. Motion carried 6--0. DAY CARE FACILITIES IN CERTAIN COMMERCIAL ZONES BY SPECIAL REVIEW: ORDINANCE NO. 998 (second reading) AMENDING SECTION 17.02.010 OF THE LAUREL MUNICIPAL CODE, TO ALLOW DAY CARE FACILITIES IN CERTAIN COMMERCIAL ZONES BY SPECIAL REVIEW Public Hearing: No comments. Motion by Alderman Collins to close the public hearing, seconded by Alderman Orr. Motion carried 6--0. Motion by Alderman Orr that Ordinance No. 998 (second reading) be passed and adopted, seconded by Alderman Collins. A roll call vote was taken and all aldermen present voted, "YES." ORDINANCE NO. 1003 (first reading) AMENDING SECTION 3.04.030 OF THE LAUREL MUNICIPAL CODE, ANNUAL FINANCIAL STATEMENT REQUIRED Motion by Alderman Rodgers that Ordinance No. 1003 (first reading) be passed and adopted, seconded by Alderman Collins. A roll call vote was taken and all aldermen present voted, "YES." Motion carried 6--0. ORDINANCE NO. 1004 (first reading) AMENDING SECTION 6.08.020 OF THE LAUREL MUNICIPAL CODE, LICENSE FEE Motion by Alderman Orr that Ordinance No. 1004 (first reading) be passed and adopted, seconded by Alderman Graham. A roll call vote was taken and all aldermen present voted, "YES." Motion carried 6--0. ORDINANCE NO. 1005 (first reading) AMENDING SECTION 8.04.100 OF THE LAUREL MUNICIPAL CODE, REFUSE FEE INCLUDED IN WATER BILLING Motion by Alderwoman Kilpatrick that Ordinance No. 1005 (first reading) be passed and adopted~ seconded by Alderman Collins. A roll call vote was taken and all aldermen present voted, "YES." Motion carried 6--0. ORDINANCE NO. 1006 (first reading) AMENDING SECTION 8.16.020 OF THE LAUREL MUNICIPAL CODE, PROHIBITING THE SALE OF FIRE WORKS WITHIN CITY LIMITS Motion by Alderman Rodgers that Ordinance No. 1006 (first reading) be passed and adopted, seconded by Alderman Collins. A roll call vote was taken and all aldermen present voted, "YES." Motion carried 6--0. TRANSFERRING FUNDS TO CAPITAL PROJECTS FUNDS: RESOLUTION NO. 2566 BEING A RESOLUTION TRANSFERRING CERTAIN FUNDS OF THE CITY OF LAUREL, MONTANA This is a resolution to transfer funds to the Fire Department Capital Projects Fund. Motion by Alderman Orr that Resolution No. 2566 be passed and adopted, seconded by Alderman Graham. Motion carried 6--0. RESOLUTION NO. 2567 BEING A RESOLUTION TRANSFERRING CERTAIN FUNDS OF THE CITY OF LAUREL, MONTANA This is a resolution transferring funds to the Ambulance Projects Fund. Minutes of the City Council of Laurel Page 3 Council Meeting of December 3, 1991 Motion by Alderman Rodgers that Resolution No. 2567 be passed and adopted, seconded by Alderman Teeters. Motion carried 6--0. RESOLUTION NO. 2568 BEING A RESOLUTION TRANSFERRING CERTAIN FUNDS OF THE CITY OF LAUREL, MONTANA This is a resolution transferring funds to the Capital Projects Fund for the purchase of a computer. Motion by Alderman Orr that Resolution No. 2568 be passed and adopted, seconded by Alderman Graham. Motion carried 6--0. COMMITTEE REPORTS: --Budget/Finance Committee minutes of November 19, 1991 were presented and reviewed. Motion by Alderwoman Kilpatrick to enter the Budget/Finance Committee minutes of November 19, 1991, into the record, seconded by Alderman Orr. Motion carried 6--0. Vicki Metzger gave a report regarding a business license for Midland Roofing. They have been given until Friday at 5:00 p.m. to get a license. Jim Worthington stated he has not contacted them to do repairs to city buildings. --City Council Committee of the Whole minutes of November 19, 1991 were presented. Motion by Alderman Orr to enter the City Council Committee of the Whole minutes of November 19, 1991, into the record, seconded by Alderman Collins. Motion carried 6--0. --Garbage Committee minutes of December 2, 1991 were presented and reviewed. Motion by Alderman Graham to enter the Garbage Committee minutes of December 2, 1991, into the record, seconded by Alderman Orr. Bob Graham stated that the committee recommends there be a charge of $ 2.00 per square for shingles in order to compensate for dumping costs. When the customer picks up the building permit, they would pay this fee, based on the number of squares they will be removing. This permit would need to be presented to the transfer site operator before being allowed to dump shingles. It was stated that a rate increase is eminent in the Garbage Fund and Chuck Rodgers feels it is better to do it now rather than later. More discussion followed and the Mayor asked Dave to present the information on a rate increase at the next council meeting. At this time, a vote was taken on the motion. Motion carried 6--0. --License Committee minutes of November 26, 1991 were presented and reviewed. Discussion followed regarding business licenses and fees for baby-sitters. The committee asked for input from the council before setting up guidelines. It was stated that day care homes with 12 or fewer children are required to register with the State but there is no fee for this. If you care for 13 or more children, the State requires you to be licensed and pay a fee. In regard to a fire inspection, conflicting information has been received about whether or not the State does this. Joe Bradley said the city can still do a fire inspection as part of our business license procedure and if we find a residence in violation, we can shut them down. If this happens, the State wants to be notified~ Darrell said the way things are now, the Fire Department has knowledge of day care homes where there are 13 or more children because the State requires them to have a business license. Our local Fire Department then does the fire inspection, as required by the State. Minutes of the City Council of Laurel Page 4 Council Meeting of December 3, 1991 Discussion regarding whether the business license fee should be adjusted for baby-sitters, based on the number of children they have. Joe Bradley said it is the baby-sitter's Choice whether they want to limit the number of children they have to six or fewer children. The work on the part of the city to process a business license is the same, regardless of how many children they have. Joe would hate to see the city get into a situation where we are trying to distinguish which businesses are more profitable than others. The question was brought up regarding teenage children who baby-sit occasionally. Joe said we are not licensing these kinds of baby-sitters. We are licensing day care facilities, following the guidelines that the State requires. If they are required to register or be licensed by the State, then we also require them to be licensed by the city. It was stated there are women who baby-sit every day from the time school gets out until the parents pick the children up, who may not be making that much money. Joe said we would still require them to get a license and pay the full fee. Motion by Alderman Collins to enter the License Committee minutes of November 26, 1991, into the record, seconded by Alderwoman Kilpatrick. Motion carried 6--0. --Parks Committee minutes of November 21, 1991 were presented and reviewed. Motion by Alderwoman Kilpatrick to enter the Parks minutes of November 21. 1991, into the record, seconded by Orr. Motion carried 6--0. Committee Alderman COMMENTS FROM THE AUDIENCE: None MAYOR'S COMMENTS: The Mayor appointed Dan Meats and Butch Ripley as volunteer firemen. Motion by Alderman Orr to confirm the Mayor's appointment of Dan Meats and Butch Ripley as new firemen, seconded by Alderman Teeters. Motion carried 6--0. Bob Gauthier mentioned that Sharon Herman's mother passed away and her funeral is Wednesday at 10:00 a.m. Donna Kilpatrick stated that the which is a Montana flag and she ceremony. It was decided to have p.m. at City Hall. city was given two flags, one of would like to have a dedication it on Monday, December 9th at 4:00 WILLIAM'S PROPERTY: Jim Worthington reported on the William's property that the city recently purchased. Material has been removed from the two white buildings and all utility services to them have been off since August of 1991. The building that was occupied by Fred Winters has been vacated and Fred requested to have services cut off today but Jim was notified by the power and gas company whether the city wants them left on. It was the consensus of the council to have the utilities turned off and Jim will so direct them tomorrow. Jim gave some background on this building. In 1984 there were problems with the sewer system so the water was shut off. In 1988 the meter was removed and the building has not had service since that time. The building is substandard as far as our ordinances go, so the council made the decision not to rent or lease the property. Jim said all three buildings are now empty and he would like some direction from the council regarding future plans for the buildings. He would like to have a Buildings Committee meeting to discuss the options. Jim said he has had several requests from individuals who would like to go into the buildings and salvage what is salvageable for their own gain. This was referred to the Buildings Committee for a recommendation. Vicki Metzger stated that Fred did not pay his monthly rent for November. Jim said that the building Fred occupied is basically cleaned out inside, but there are still a lot of televisions sitting Page Minutes of the City Council of Laurel Council Meeting of December 3, 1991 outside. It was suggested that a letter be written to Fred, notifying him of this. Regarding the business license for Fred's TV, it was clarified that he will need to come in and update his current license with the new address. He will be required to have a fire inspection at his new location and pay the inspection fee. Motion by Alderman Orr that the power and gas be disconnected to the building formerly occupied by Fred's TV, seconded by Alderwoman Kilpatrick. Motion carried 6--0. A public hearing will be held on the CDBG on Tuesday, December 10th at the Library. RESIGNATION OF MAYOR GAUTHIER: Bob Gauthier addressed the council regarding his resignation. They sold their house last weekend and he plans on being out of Laurel by the end of the month. Bob said it is due to personal reasons. His wife has supported him very strongly for the last 10 years while he was in politics and now she has some things that she would like to do. The economic conditions are such that this is an ideal time to make a change. Bob said that when he took this job, he did not realize the tremendous impact it would have on his family, Bob said that he has served in public office for 10 years and has enjoyed the time he has put in. Me hopes he has contributed and made it a valuable experience for everyone. Bob thanked each one who has served on the council and contributed to making his job more enjoyable. He also thanked all the department heads for all they have done for him. Bob apologized to Jennifer Feldhaus for the announcement getting to the Gazette before the Outlook, but he thanked her for her cooperation in his efforts. Bob stated the council will appoint his successor and he hopes they choose someone who has had council experience within the last couple of years. Things have changed and the budget issues have become more complex. Bob said Chuck Rodgers and Bob Graham have been very valuable as Council President and Vice-President. Bob thanked everyone for the time he has spent here and stated he would like to stay on the Budget/Finance Committee. He feels he can bring some continuity to it and help the new person who comes on board to deal with some of the issues that come up. Chuck Rodgers stated that he has served under five Mayor's and he said it has been an honor to serve with Bob. Donna Kilpatrick said she also feels it has been an honor to serve with Bob. There being no further business to come before the Council at this time, the meeting was adjourned at 7:55 p.m. Donald L.
