HomeMy WebLinkAboutCity Council Minutes 09.03.1991Minutes of the City Council of Laurel September 3, 1991 A regular meeting of the City Council of the City of Laurel, Montana, was held in the Council Chambers and called to order by Mayor Bob Gauthier at 7:00 p.m., on September 3, 1991. COUNCIL MEMBERS PRESENT: Norman Orr Donna Kilpatrick L.D. Collins Chuck Rodgers Lonnie Kellogg Bob Graham Ron Marshall Bruce Teeters COUNCIL MEMBERS ABSENT: None INVOCATION: Invocation was given by Alderman Collins. MINUTES: Motion by Alderman Marshall to approve the minutes of the regular meeting of August 20, 1991, as presented, seconded by Alderman Collins. Motion carried 8--0. CORRESPONDENCE: Received a notice from the Department of Revenue regarding a transfer of ownership for a Retail On-Premise Consumption Beer/Wine license for Happy Garden Restaurant. CLAIMS: Claims for the month of August were reviewed by the Budget/Finance Committee and recommended that they be paid. Motion by Alderwoman Kilpatrick to approve the claims in the amount of $ 225,125.67 for the month of August, seconded by Alderman Orr. Motion carried 8--0. CERTIFICATE OF RECOGNITION: A Certificate of Recognition was presented to Bill Gremmer for 20 years of service to the Volunteer Fire Department. UNITED WAY: Kevan Bryan, Yellowstone County Treasurer, stated he is serving as Public Service Chairman for the local United Way effort. The annual fund raising effort is under way and Kevan gave a summary of what United Way is trying to accomplish in our area. The agency operates on donations received mainly through payroll deduct plans in the work place and he explained a couple new changes that have taken place this year. Butt Kucera is a different ways that sponsorship. Community Hope volunteer and he explained the this organization benefits from the United Way LAUREL HIGH SCHOOL HOMECOMING PARADE: Shanna Waddell, representative of Laurel High School Pep Club, came before the Council requesting permission to hold a Homecoming parade on September 20th. The parade would be held from 6:00 to 7:00 p.m. and start at the Laurel Co-op service station, travel west on Main Street to First Avenue and north to the Memorial Football Field where it would disband. Motion by Alderman Collins to allow a Homecoming parade to be held on September 20th from 6:00 to 7:00 p.m., seconded by Alderman Orr. Motion carried 8--0. ENCROACHMENT ORDINANCE - PUBLIC RIGHT-OF-WAY: This item was postponed until the next council meeting. UNION CONTRACT CLASSIFICATION: The Union Classification Appeal Committee requests review and upgrade the following positions: that the Council 1) Cemetery/Utility Worker to grade 11, 2) Working Foremen to ~rade 18 - step 3. Minutes of the City Council of Laurel Page 2 Council Meeting of September 3, 1991 Discussion followed and it was stated that if these changes are approved, they would take place in this fiscal year. The increases could be worked into the current budget. Motion by Alderman Rodgers to approve the Cemetery/Utility Worker upgrade from grade 9 to grade 11, seconded by Alderman Orr. Motion carried 8--0. Motion by Alderman Marshall to table the upgrade for Working Foremen, seconded by Alderman Rodgers. Motion carried 7--1 with Alderman Teeters voting, "NO." In regard to the Landfill position, the Appeals Committee did not take any action because they felt this did not fall under the classification appeal process. What they are asking for is a change of classification and not merely an upgrade Of an existing position. Motion by Alderman Orr to accept the committee's recommendation that this upgrade is beyond the scope of the classification appeal process, seconded by Alderman Graham. Motion carried 8--0. In regard to the Police Dispatcher's position, the Appeal Committee felt this was beyond the scope of the classification appeal process. Motion by Alderman Collins to accept the committee recommendation. Motion died for lack of a second. Motion by Alderman Orr to table the upgrade for Police Dispatcher, seconded by Alderman Graham. Motion carried 8--0. COMMITTEE REPORTS: --Budget/Finance Committee minutes of August 20, 1991 were presented and reviewed. Motion by Alderwoman Kilpatrick to enter the Budget/Finance Committee minutes of August 20, 1991, into the record, seconded by Alderman Orr. Motion carried 8--0. --City Council Committee of the Whole minutes of August 20, 1991 were presented. Motion by Alderman Orr to enter the City Council Committee of the Whole minutes of August 20, 1991, into the record, seconded by Alderman Kellogg. Motion carried 8--0. --City License Committee minutes of August 27, 1991 were presented and reviewed. Motion by Alderman Graham to grant a city license to Burger King, seconded by Alderman Orr. Tim Ballou, Manager of Burger King, was questioned whether a sidewalk will be laid to the west of the building on the highway right-of-way to comply with specified conditions. Tim stated that a federal department controls the highway divider near the off ramp and due to the location, they will not allow Burger King to install a sidewalk in that area. The off ramp is a yield only for motorists making a right hand turn. The motorist is busy watching the left hand and merging traffic and they do not want additional congestion created by pedestrians in that area. Jim Worthington stated he is working out a recommendation to take to the Planning Board regarding this. Discussion followed and it was stated that there is a problem with customers who are entering Burger King from First Avenue South. They are having to go against the flow of traffic for 40 or 50 feet to enter in the area south of the Conoco C Store. Tim stated that with the signing in the area, they hope to route the traffic into Burger King from South 4th Street. At this time a vote was taken on the motion. Motion carried 8--0. Motion by Alderman Collins to enter the City License minutes of August 27, 1991, into the record, seconded by Rod~ers. Motion carried 8--0. Committee Alderman Minutes of the City C°uncil of Laurel Page 3 Council Meeting of September 3, 1991 COMMENTS FROM THE AUDIENCE: Dave Michael requested a short Personnel Committee meeting following the Council meeting. A Police Committee meeting will be held on September 5th at 5:30 p.m. at the FAP Complex. A Garbage Committee meeting will be held on September 16th at 5:00 p.m. The City-County Planning Board will meet on September 12th at 7:00 p.m. to discuss Asphalt Supply and the baby sitting issue. MAYOR'S COMMENTS: The Mayor appointed Ken Williams to the Parks & Recreation Committee. The Mayor appointed Susan Blaskovich to the Ambulance Reserve. Motion by Alderman Marshall to confirm the Mayor's appointment of Susan Blaskovich to the Ambulance Reserve, seconded by Alderman Orr. Motion carried 8--0. Lonnie Kellogg resigned from the Yellowstone County Air Pollution Control Board. Motion by Alderman Orr to accept the resignation of Lonnie Kellogg from the Yellowstone County Air Pollution Control Board, seconded by Alderwoman Kilpatrick. Motion carried 8--0. The Mayor appointed L.D. Collins to the Yellowstone County Air Pollution Control Board. Motion by Alderman Kellogg to confirm the Mayor's appointment of L.D. Collins to the Yellowstone County Air Pollution Control Board, seconded by Alderman Graham. Motion carried 8--0. The Mayor introduced the three finalists for Police Chief and they are: Mike Atkinson - Acting Police Chief Kenneth Hoefner - retired Dist. Commander of the Highway Patrol August Bentz, Jr.- Lieutenant with the Billings Police Dept. The City Council interviewed each candidate by asking the same three questions of each one which were as follows: 1) How would you bring about changes to this department? 2) Of all your skills, what is your strongest point and what is your weakest point? 3) What goals do you have for this department? The Mayor thanked the candidates and asked them to stay briefly after the meeting to meet the aldermen. There being no further business to come before the Council at this time, the meeting was adjourned at 8:05 p.m. Donald L.
