HomeMy WebLinkAboutCity Council Minutes 05.07.1991Minutes of the City Council of Laurel May 7, 1991 A regular meeting of the City Council of the City of Laurel, Montana, was held in the Council Chambers and called to order by Mayor Bob Gauthier at 7:00 p.m., on May 7, 1991. COUNCIL MEMBERS PRESENT: Norman Orr Donna Kilpatrick L.D. Collins Chuck Rodgers Lonnie Kellogg Bob Graham Eon Marshall Bruce Teeters COUNCIL MEMBERS ABSENT: None INVOCATION: Invocation was given by Reverend Wilhelm. MINUTES: Motion by Alderman Rodgers to approve the minutes of the regular meeting of April 16, 1991, as presented, seconded by Alderman Collins. Motion carried 8--0. CORRESPONDENCE: Received a thank you from Peg Kamerzel for the retirement party. Received a bulletin from the Montana League of Cities and Towns regarding HB-795, Public Works financing program. The City Clerk wrote to the Governor encouraging him to sign the bill. CLAIMS: Claims for the month of April were reviewed by the Budget/Finance Committee and recommended that they be paid. Motion by Alderwoman Kilpatrick to approve all claims in the amount of $ 259,273.86 for the month of April, seconded by Alderman Orr. Motion carried 8--0. KREG JONES - D.A. DAVIDSON & CO. (SEWER REVENUE BONDS): Kreg Jones, representing D.A. Davidson, stated his company served as financial advisor in 1983 for the issuance of the Sewer Revenue Bonds. In 1983 the City sold 20 year bonds and retained the right to prepay these bonds after 10 years. At this time the interest rates for municipal bonds is at an 11 year low and the city would like to take advantage of this. Since you do not have the option to pay the bonds off for another 2 1/2 years, you can do what is called advanced refunding. You would refinance the bonds in advance of your right to pay them off in 1993. Kreg said you basically swap an old debt for a new one which will result in savings, due to the lower interest rate. Kreg explained in detail the process for issuing 1991 bonds. The net savings to the City over a 12 year period will be $ 84,396.00. The Budget/Finance Committee minutes of May 6th were reviewed. committee made a recommendation to proceed with the issue. The RESOLUTION NO. 2523 A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF LAUREL AND D.A. DAVIDSON & CO., SAID AGREEMENT RELATING TO THE PURCHASE AND SALE OF SERIES 1991 SEWERAGE SYSTEM REVENUE BONDS Motion by Alderman Collins that Resolution No. 2523 be passed and adopted, seconded by Alderman Marshall. Motion carried 8--0. BID OPENING - 1990-1991 AUDIT: Letters were sent by the City Clerk to local accounting firms soliciting bids for the 1990-91 audit. All bids recieved were opened at this time. Motion carried 8--0. STREET SWEEPING: RESOLUTION NO. 2525 A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF LAUREL AND THE MONTANA DEPARTMENT OF HIGHWAYS, SAID AGREEMENT RELATING TO STREET SWEEPING Motion b.v Alderman RodEers that Resolution No. 2525 be passed and adopted, seconded by Alderman Collins. Motion carried 8--0. ADOPT LAUREL MUNICIPAL CODE: ORDINANCE NO. 984 (second reading) ADOPTION OF THE LAUREL MUNICIPAL CODE, 1991 Public Hearing: No comment. Motion by Alderman Orr to close the public hearing, seconded by Alderman Kellogg. Motion carried 8--0. Motion b.v Alderman Graham that Ordinance No. 984 (second reading) be passed and adopted, seconded by Alderman Orr. A roll call vote was taken and all aldermen voted~ "YES." Motion carried 8--0. DEMOLITION OF DANGEROUS BUILDING - MARTIN GARAGES: Jim Worthington, City Engineer, gave a report on the demolition of a dangerous building. Jim stated the demolition has been completed on the Martin garages and notice has been sent to the Clerk and Recorder informing them that there is no longer a building there. The last step, as required by the Uniform Code, is to submit a written report to the City. Jim presented this report showing the itemized cost of demolition. Jim stated a certified letter was sent to Mr. Martin itemizing the cost of demolition. This letter was refused and because of that action, this report was submitted. The next step is to have a public hearing on June 4th for the purpose of allowing anyone to voice their objections. If there are no objections at the hearing, the cost of demolition will be put on Mr. Martin's taxes. Jim did note that when the abstract research was done prior to demolition, Mr. Martin's taxes were current. RESOLUTION NO. 2526 A RESOLUTION SETTING A PUBLIC HEARING ON THE CITY ENGINEERS REPORT FOR TUESDAY, JUNE 4, 1991 AT 7:00 IN THE COUNCIL CHAMBERS AND PROVIDING THAT THE CITY CLERK SHALL GIVE NOTICE AS REQUIRED BY THE UNIFORM CODE FOR ABATEMENT OF DANGEROUS BUILDINGS Page 3Minutes of the City Council of Laurel Council Meeting of May 7, 1991 Motion by Alderman Kellogg that Resolution No. 2526 be passed and adopted, seconded by Alderman Marshall. Motion carried 8--0. COMMITTEE REPORTS: --Budget/Finance Committee minutes of April 16, 1991 were presented and reviewed. Discussion regarding the cost of putting curb and gutter on the west side of First Avenue South between Taco John's and Town Pump. It was questioned why the city is paying for it and not the property owners. The Mayor said the State requested that curb and gutter be put in after they did the overlay project on First Avenue several years ago. At that time, the property owners were approached and asked to voluntarily install curb and gutter, but they did not want to put out the money for this project. Bob said money was budgeted in the gas tax fund last year to cover this project. After discussion it was decided to check further into the possibility of approaching the owners again before the city puts out the money for the project. They can attend a Street and Alley Committee meeting to discuss it. Joe Bradley said the City would need to notify them. This item was referred to the Street and Alley Committee. It was questioned whether Jim Worthington has checked the O'Rourke house in Riverside Park. Jim stated the occupants are not fully moved out yet but he expects to have the key to the house within a day or two. Don Hackmann said he checked the code book and sanding and snow removal are street maintenance items but there is no mention of weeds. --Budget/Finance Committee minutes of April 29, 1991 were presented and reviewed. In reference to the Buy Sell Agreement on the Williams property, Bob Graham stated he is opposed to the purchase. --Fire Committee minutes of April 29, 1991 were presented and reviewed. Motion carried 8--0. --Parks Committee minutes of April 25, 1991 were presented and reviewed. Motion by Alderwoman Kilpatrick to enter the Parks minutes of April 25, 1991, into the record, seconded by Graham. Committee Alderman There was discussion on salaries for the head lifeguards and other swimming pool employees. Carl Hollabaugh attended a Parks Committee meeting asking permission to be able to move into the house in Riverside Park that was recently vacated by the O'Rourke family. He is willing to negotiate a contract to mow the lower portion of the park in exchange for rent. Carl. stated he was a licensed contractor and since the house is in need of repairs, he is willing to do repairs and make improvements as part of this contract. Jim Worthington stated that he will inspect the house within the next day or two and make a report to the Parks Committee on Thursday, May 9th at 5:00 p.m. Dave Michael stated there have been other requests for this house and he suggested that the Parks Committee handle this and make a recommendation for a new tenant. Carl was invited to attend the meeting on Thursday. At this time a vote was taken on the motion. Motion carried 8--0. COMMENTS FROM TIlE AUDIENCE: Bob Graham thanked everyone on the Council and the Department Heads for the kind words his family received on the death of his father. Cal Cumin reported on the petroleum coke pile east of town. The owners were contacted and it is a business that is continually moving the coke in and out. The pile is periodically sprayed with silicone to prevent dust in wind storms. There will be a Street and Alley Committee meeting on May 16, 1991 at 5:00 p.m. Donna Kilpatrick requested permission to leave the State. Motion by Alderman Collins to allow Donna Kilpatrick to leave the State, seconded by Alderman Orr. Motion carried 8--0. There will be an Ambulance Committee meeting on May 28, 1991 at 6:00 p.m. in the Council chambers. Page Minutes of the City Council of Laurel Council Meeting of May 7, 1991 A Police Committee meeting will be held on May 8, 1991 at §:00 p.m. The Police Commission will meet at the F.A.P. on Wednesday, May 8th at 5:00 p.m. to review the Police Chief applications. MAYOR*S COMMENTS: The Mayor appointed Bob Western to the Airport Authority to fill the · unexpired term of Dave Powers. Motion by Alderman Collins to confirm the Mayor's appointment of Bob Western to the Airport Authority~ seconded by Alderman Kellogg. Motion carried 8--0. The Mayor appointed Curt Hoffman as Assistant Manager and Cheryl Hallstad~ Brian Hunter and Kyle Hoffman as head lifeguards. Motion by Alderman Collins to confirm the Mayor's appointment of Curt Hoffman as Assistant Manager and Cheryl Hallstad, Brian Hunter and Kyle Hoffman as head lifeguards, seconded by Alderman Graham. Motion carried 8--0. There being no further business to come before the Council at this time, the meeting was adjourned at 8:32 p.m. Donald L.
