COUNCIL MEMBERS PRESENT: COUNCIL MEMBERS ABSENT: of the City Council of the City of Laurel, the Council Chambers and called to order by Chuck Rodgers at 7:00 p.m., on January 15, Bruce Teeters Donna Kilpatrick L.D. CORRESPONDENCE: Invocation was given by Reverend Hunter. approve the minutes of the presented, seconded by regular Alderman Received a thank you from the Laurel Senior Citizens for the $ 250.00 contribution to the Senior Citizens Center. Received a memo from the Montana League of Cities and Towns regarding "Local Government Day" in Helena on January 25~ 1991. CITY CLERK & CITY TREASURER'S FINANCIAL STATEMENTS: The City Clerk and City Treasurer's financial statements for the month of December were presented. Motion by Alderwoman Kilpatrick that the City Clerk and City Treasurer's financial statements for the month of December, 1990, be approved, seconded by Alderman Collins. Motion carried 6--0. RENEWAL TO TRADE PARKING SPACES WITH YELLOWSTONE BANK: RESOLUTION NO. 2510 APPROVING RENEWAL OF ONE YEAR AGREEMENT TO TRADE USE OF CERTAIN PARKING SPACES WITH YELLOWSTONE BANK OF LAUREL Motion by Alderman Marshall that Resolution No. 2510 be passed and adopted, seconded by Alderman Collins. Motion carried 6--0. CREATE CAPITAL PROJECTS FUND FOR FIRE DEPARTMENT: RESOLUTION NO. 2511 A RESOLUTION TO CREATE A CAPITAL PROJECTS FUND FOR THE FIRE DEPARTMENT Motion by Alderwoman Kilpatrick that Resolution No. 2511 be passed and adopted, seconded by Alderman Collins. Don Hackmann explained that the city has a capital projects fund for the Fire Department, but it is restricted to the purchase of a truck only. It was suggested by a State Auditor that this fund be set up with a broader base to include purchase of property, plant and equipment. A vote was taken on the motion. Motion carried 6--0. RESOLUTION REQUIRING TWO SIGNATURES ON CIq"f C~ECKS: RESOLUTION NO. 2512 A RESOLUTION REQUIRING TWO SIGNATURES ON CITY CHECKS Motion by Alderman Collins that Resolution No. 2512 be passed and adopted, seconded by Alderman Marshall. Motion carried 6--0. Minutes of the City Council of Laurel Page 2 Council Meeting of January 15, 1991 COHMITTEE REPORTS: --Budget/Finance Committee minutes of January 2, 1991 were presented and reviewed. Alan Crowe reported that he received correspondence from the PSC that the rates for the 911 line would be increased by 36% by the end of January. He has been talking with the telephone company regarding this and has received no definite answer that the rates will go up. This would be an increase to the city and not the consumer. Motion by Alderwoman Kilpatrick to enter Committee minutes of January 2, 1991, into the Alderman Marshall. Motion carried 6--0. --Fire Committee minutes of January 7, 1991 were presented and reviewed. In regard to the summary of the Fire/Building Inspector position, Joe Bradley stated that more detail needs to be given to the qualifications of this person. Things to be considered are; what training is he required to have or would he be trained after being hired, will he be required to attend classes periodically and does this person need to have prior experience. It was Darrell McGillen's feeling that they could take a person with very little experience in the fire codes and train them sufficiently. Joe said this job would also include building inspector and he questioned Jim Worthington as to what would be involved in training for this part of the job. Jim said the state does not offer training and the knowledge would come from reading and application of the codes under the supervision of himself. More discussion followed and it was stated that it would be an asset if this person had a construction background. They would then have a knowledge of both fire and building codes. It was clarified that this person would only inspect businesses and home occupations. They would not inspect new home construction or remodeling projects unless the Engineer felt he had the qualifications to do so. Motion by Alderman Marshall to enter the Fire Committee of January 7, 1991, into the record, seconded by Alderman Motion carried 6--0. minutes Kellogg. --Montana Tradeport Authority minutes of December 21, 1990 were presented. Motion carried 6--0. --Police Committee minutes of January 3, 1991 were presented and reviewed. Motion by Alderman Kellogg to enter the Police Committee minutes of January 3, 1991, into the record, seconded by Alderman Marshall. Motion carried 6--0. --Public Utilities Committee minutes of January 14, 1991 presented and reviewed. were There was discussion regarding the bill submitted by Earl Linger for a meter loop and labor at his old place of business. This raised the question of why he was never charged for water and sewer in the old building for the 14 years he was in there. It was stated that the house is on its own meter. The garage was built on a spot where an old house once sat and this house had water Page3 Minutes of the City Council of Laurel Council Meeting of January 15, 1991 Dave Michael said when Earl moved out, the curb box was repaired and the water was turned off. It has been off until the current tenant requested service and the city required a meter to be installed before turning the water on. It was suggested in the committee minutes that the plumbers be allowed to buy the meter loop from the city, to avoid the possibility of future errors. It was stated that every city has its own requirement regarding the size of meter loops. The problem is that the plumbers may assume they know what is needed and do the job without checking. It was suggested that the requirements be put on the plumbing permit and this would inform the plumber of the size. The only problem with this is that permits are not required in a circumstance such as Linger's. Joe will check to see if the city can actually sell to the public or whether it is prohibited by ordinance. Motion by Alderman Collins to enter the Public Utilities Committee minutes of January 14, 1991, into the record, seconded by Alderman Marshall. Motion carried 6--0. Ron Marshall inquired about the abatement proceedings on the garages by the Merchant Apartments. Jim Worthington said the letter was sent and it was signed for on January 10th. He now has 60 days from the 10th to get all the necessary permits for demolition. He also has 30 days from the 10th in which he can appeal this action. Donna Kilpatrick requested permission to leave the state from February 4th to the 7th. Motion by Alderman Collins to grant Donna Kilpatrick permission to leave the state, seconded by Alderman Marshall. Motion carried 6--0. Bruce Teeters inquired whether a letter was sent to Fred Winters regarding the junk he has on the sidewalk in front of his business. Joe Bradley said a letter was sent two days ago. In reference to discussion at the last council meeting regarding the Williams' property, Joe Bradley said he contacted an appraiser and he will try to do it within the next week. Joe spoke to Mr. Williams to let him know the city was interested and to ask that they wait to put the property up for sale until the city can give them a counter offer. Jim Worthington stated an official was in from Exxon and submitted a copy of a resolution requesting an easement and also a map showing the routing of the pipeline across the Yellowstone River. The pipeline has been moved east to an area between our water and sewer plants. This is still in the preliminary stages and they have given it to the city for review. There being no further business to come before the Council at this time, the meeting was adjourned at 7:37 p.m. Donald L.
