COUNCIL CHAMBERS MEMBERS PRESENT: OTHERS PRESENT: Jeanette Dolechek Dennis Eaton Bob Graham Chuck Dickerson George Byko Al Hicks Kristine Kerr Maureen Kaul Albert Ehrlick Ron Marshall John Minch Jim Flisrand Sherrie Legerski Lia Keller Puff Anderson Rudy Groshelle Sherrie Legerski was present to discuss her concerns of obtaining sewer and water service for her new residence on the corner of E. 8th Street and Fir Avenue., which is currently outside the City limits. The Street & Alley committee on August 10, 1995 recommended water and sewer services be made available provided Legerski's annex and complete the necessary street improvements adjacent to each lot as they develop. (Letter enclosed) Following a discussion a motion was made by Bob Graham, seconded by Phil 40 Curry, to accept the Street & Alley's recommendations. Motion carried. Al Hicks was present again to request sewer service for his property on East Railroad Street. Committee discussed intent of the past City's agreement to give all residents sewer service in that area and the zoning status of Mr. Hick's property. Motion by Bob Graham, seconded by Albert Ehrlick, that Al Hicks be allowed to hook up to the sewer provided the Public Works Director and Planning Director determine the current zoning allows his type of business or that the City County Planning Board approves Mr. Hick's zoning request to accommodate his business. Motion carried. Lisa Keller and Kristine Kerr were present to discuss their concerns with the sewer backup and expenses associated with the incident. The sewer backup was a result of the City lift station malfunctioning. Following considerable discussion a motion was made by Bob Graham, seconded by Jim Flisrand, that the City Attorney review the incident and that the insurance company be questioned regarding their review of all data. Motion carried. Rudy Groshelle requested an adjustment on his past water bill relating to his commercial property on East Main Street. The City has replaced his meter, however has not had the opportunity to check the meter in question. The meter will be checked for low, medium and high flows with results presented to the next Public Utilities committee meeting. • Maureen Kaul residing at 1030 13th Avenue made a request to the City to relax the $15.00 shut off fee assessed her on two separate occasions. Following an extensive discuss and review of staff procedure, a motion by Bob Graham, seconded by John Minch, that her request be denied. Motion carried. Jim Flisrand updated the committee on the underpass project. Morrison and Maierle is the consultant working for Cenex and the State Highway Department in rerouting the current underpass drain. Flisrand is working with the consultant and Highway Department to include the construction of a storm sewer on South East Fourth Street as part of the resolution to the underpass drainage concerns. The committee encouraged Flisrand to continue talking with the State to resolve not only problems at the underpass but also drainage concerns on the State Highway (S. First Avenue). The water and sewer debts not collected throughout the past year were submitted to the committee for approval to be written off the books. Motion by Chuck Dickerson, seconded by Ron Marshall, to approve the staff request. As discussed at that meeting,. we feel that the best way to approach all the issues involved in what you would. like to do and what the city code requires be done is: 1. bring Block 6; Nutting Brothers Subdivision into the City which will allow you legal access to both municipal water and sewer for the. single-family, UBC-approved modular housing unit you wish to locate there., 2.:. construct the required curb and gutter inprovenients in front of just those lots you are building on at tliis.tinne; and 3. enter into a contract with the City for the remainder of the required improvements for the rest of the block that is tied to when the individual lots are built upon ...or 'when a certain percentage of such lots are built upon. This arrangement will allow issues of concern to you and to the City to be appropriately and fairly addressed. This can be further discussed at the Public Utilities Meeting Monday at 5.:30 PM at the Laurel City Council Chanibers.
