HomeMy WebLinkAboutCity Council Minutes 03.17.1992Minutes of the City Council of Laurel March 17, 1992 A regular meeting of the City Council of the City of Laurel, Montana, was held in the Council Chambers and called to order by Mayor Chuck Rodgers at 7:00 p.m., on March 17, 1992. COUNCIL MEMBERS PRESENT: COUNCIL MEMBERS ABSENT: INVOCATION: Invocation was MINUTES: Norman Orr Donna Kilpatrick L.D. Collins Albert Ehrlick Lonnie Kellogg Bob Graham Ron Marshall Gay Easton None given by Reverend Storment. Motion by Alderwoman Kilpatrick to approve the minutes of the regular meeting of March 3, 1992, as presented, seconded by Alderman Collins. Motion carried 8--0. CORRESPONDENCE: Received a letter from the Laurel Chamber of Commerce regarding concessions being sold in Thomson Park during Aviation Week on March 27th and 28th. Received the February minutes and activity report from the Air Pollution Control Board. CITY CLERK & CITY TREASURER'S FINANCIAL STATEMENTS: The City Clerk and City Treasurer's financial statements for the month of February, 1992, were presented. Motion by Alderwoman Kilpatrick that the City Clerk and City Treasurer's financial statements for the month of February, 1992, be approved, seconded by Alderman Orr. Motion carried 8--0. CENEX INDUSTRIAL WASTE DISPOSAL & REVIEW OF TAXICAB ORDINANCES: Items 5 and 8 on the agenda will be tabled until the next council meeting on April 7, 1992. ALLOW GROUP & FAMILY DAY CARE HOMES IN ALL RESIDENTIAL DISTRICTS: ORDINANCE NO. 1026 (second reading) AMENDING SECTION 17.16.010 OF THE LAUREL MUNICIPAL CODE, TO ALLOW GROUP DAY CARE HOMES AND FAMILY DAY CARE HOMES IN ALL RESIDENTIAL DISTRICTS Public Hearing: No comments. Motion by Alderman Collins to close the public hearing, seconded by Alderman Marshall. Motion carried 8--0. Motion by Alderwoman Kilpatrick that Ordinance No. 1026 (second reading) be passed and adopted, seconded by Alderman Collins. A roll call vote was taken and all aldermen voted, "YES". Motion carried 8--0. APPLICATION PROCEDURE: ORDINANCE NO. 1027 {second reading) AMENDING SECTION 6.40.040 OF THE LAUREL MUNICIPAL CODE1 APPLICATION PROCEDURE Public Hearing: No comments. Motion by Alderman Orr to close the public hearing, seconded by Alderman Collins. Motion carried 8--0. Minutes of the City Council of Laurel Page 2 Council Meeting of March 17, 1992 Motion by Alderman Orr that Ordinance No. 1027 (second reading) be passed and adopted, seconded by Alderman Graham. A roll call vote was taken and all aldermen voted, "YES". Motion carried 8--0. COMMITTEE REPORTS: --Budget/Finance Committee minutes of March 3, 1992 were presented and reviewed. Motion by Alderwoman Kilpatrick Committee minutes of March 3, 1992, Alderman Orr. Motion carried 8--0. to enter the Budget/Finance into the record, seconded by Motion by Alderman Marshall to accept the 1990-91 Audit Report, seconded by Alderman Orr. Motion carried 8--0. --Cemetery Committee minutes of March 5, 1992 were presented and reviewed. Motion by Alderman Orr to enter the Cemetery Committee minutes of March 5, 1992, into the record, seconded by Alderman Graham. Motion carried 8--0. --City Council Committee of the Whole minutes of March 3, 1992 were presented. Motion by Alderman Marshall to enter the City Council Committee of the Whole minutes of March 3, 1992, into the record, seconded by Alderman Orr. Motion carried 8--0. --City-County Planning Board minutes of March 12, 1992 were presented and reviewed. Motion by Alderman Orr to enter minutes of March 12, 1992, into the Collins. Motion carried 8--0. the City-County Planning Board record, seconded by Alderman HOME OCCUPATIONS: Maynard and Jean Holland, 401 West 13th, are asking for a home occupation for MJ Investments. Cal Cumin stated there was discussion on why they needed a business license and a home occupation. Recently they were granted a business license and issues that came up have been resolved so the Planning Board recommended approval for the home occupation. Motion by Alderman Kellogg to grant a home occupation to Maynard and Jean Holland, seconded by Alderman Graham. Motion carried 7--1 with Alderman Collins voting, "NO". Cal commented that the home occupations seem to be getting out of control but he doesn't know what to do about it. Lonnie Kellogg said that in spite of the problems that arise with the ordinance, he feels it is important to keep it in place. James Nelson, 1034 7th Avenue, would like a home occupation to do wooden ornaments in his home. Motion by Alderman Kellogg Nelson, seconded by Alderman Alderman Collins voting, "NO". to grant a home occupation to James Marshall. Motion carried 7--1 with LuAnn Engh, 1033 7th Avenue, is requesting a home occupation for Northland Corrosion Services. The telephone, mailing address and bookkeeping activities would be at her residence with the commercial activity and storage being at the old Butler Building, next to Hardee's. Motion by Alderman Kellogg to grant a home occupation to Northland Corrosion Services, seconded by Alderwoman Kilpatrick. Motion carried 8--0. Fourth of July Planning Committee minutes of March 10, 1992 were presented and reviewed. Page 3 Council Meeting of March 17, 1992 Minutes of the City Council of Laurel Motion by Alderwoman Kilpatrick to enter the Fourth of July Planning Committee minutes of March 10, 1992, into the record, seconded by Alderman Kellogg. Motion carried 8--0. --Parks Committee minutes of March 12, 1992 were presented and reviewed. Motion by Alderwoman Kilpatrick to enter the Parks Committee minutes of March 12, 1992, into the record, seconded by Alderman Orr. Motion carried 8--0. COMMENTS FROM THE AUDIENCE: A License Committee meeting will be held on Tuesday, March 24th at 7:00 p.m. Bob Graham stated a request was made from a gentleman (Hank Harding) to lease park property in Badger Square, which is in the county. Discussion regarding the lease value, what it is based on and where the funds go. Cal Cumin will check on this. Street and Alley Committee will meet on Thursday, March 19th at 6:00 p.m. MAYOR'S COMMENTS: The Mayor appointed Arthur Hazen, Jill Zuhoski and Matt Hoppel to the Police Reserve. Motion by Alderman Marshall to confirm the Mayor's appointment of Arthur Hazen, Jill Zuhoski and Matt Hoppel to the Police Reserve, seconded by Alderman Ehrlick. Motion carried 8--0. The Mayor stated the city received another payment from Ernie Davis but, at this time, he is still behind schedule. Dave reported that a garbage truck is in the shop for repairs so garbage pickup may run behind schedule. There being no further business to come before the Council at this time, the meeting was adjourned at 7:29 p.m. Donald L.
