STREET & ALLEY/ GARBAGE COMMITTEE
NOVEMBER 21, 1996 5:30 P.M.

The first item on the agenda was Red Murray's property, a
triangular parcel, 155 sq. ft in area, on W. 12th Street, south of
the walking bridge. Mr. Murray has prepared a quick claim deed,
and wishes to give the property to the city. The walking bridge
over the Big Ditch belongs to the county and they assume liability
and maintenance of the bridge.
Jim recommends the committee present this to the council for
acceptance of said property at no cost to the city.
Mr.Murray's property is adjacent to the 12th Street right-of-way
and is too small to serve any purpose. If the City proposes to
widen West 12th Street the ownership of this property may become an
issue.
Motion by Gay Easton, seconded by Bud Johnson, to recommend
acceptance. Motion carried.
Mr. black of 312 W. 13th Street was present to indicate his concern
with a sewer line that was put in by the developer in 1991 or 1992.
Mr. Black's lot is in the city limits, however, 13th Street was
never annexed. Mr. Black feels the City should be responsible for
the lack of compaction over the sewer line which led to his curb
and gutter and sidewalk to settle. Mr. Black's claim against the
City has been turned into the City's insurance and they have
determined, following a detailed review of all available
information that the city was not responsible for the settlement of
Mr. Black's curb, gutter and sidewalk.
Mr. Black has indicated that he may want to be de-annexed if the
city doesn't resolve this issue. Mr. Black also indicated that his
water is stale and wants something done about that also. Jim
Flisrand agreed to look into the water issue and flush the lines if
necessary, weather permitting. The city has not had any other
complaints on the water up to this point.
No action was taken by the committee.
Mike Penne would like the snow removal district expanded to Alder
Avenue along E. 1st and Main Street. The district currently stops
at Pennsylvania. Jim Flisrand indicated for an average snowfall
the additional cost would be approximately $720.00 and take 2 1/2
hours to plow and remove the snow.
Motion by Bud Johnson, seconded by Gay Easton, to recommend
approval to the City Council. Motion carried.
Charles Fischer was present to indicate a concern with Community
Hope being required to pay for all of the waste brought to their
organization. Inaccordance with the City's current resolutions
Community Hope would be required to pay for all waste coming from
their operation.
Mr. Fisher indicated the biggest problem is people dropping off
items at the site when no one else is there.
Jim Flisrand recommended a sign be posted to not permit drop-off's
after hours and perhaps the Police Department could assist in the
enforcement due to the disposal of waste other than in a garbage
container is illegal.
Mr. Fisher indicated they would try running an ad in the paper to
discourage the unwanted dumping of waste. Mr. Fisher indicated
the actual amount charged at the container site is actually not
that much, and they will see if they can control the problem,
through ads, signing and talking with the Police Department.
Gay Easton indicated if the trailer house at the container site is
no longer needed the City should consider advertising it and
dispose of it while it may still be worth something. Jim indicated
he would check into what is required to sell the trailer and
proceed with the process. The trailer is no longer needed at the
site.
Margit Thorndal was present indicating the turnaround at West
School was working great, however, they need the city to sand it.
The winter conditions make the area very icy. Jim indicated the
City's policy due to liability and budget reason would not allow
him to sand on school property. Following more discussion the
committee recommended the issue of using city equipment and
spending city money to complete work on school property would need
to be reviewed by the City Council.
Discussion with the school regarding the painting of curbs and
placement of signs on public streets resulted in the need to Jim to
contact Mr. McMillan, Superintendent, to resolve these issues. The
schools request for restricted parking or loading and unloading
will be prepared for the next Street & Alley/Garbage committee
meeting.
Container site fees were discussed relating to the current
resolution requiring all commercial and non-residents to pay at the
site. It is still the general consensus that all users of the
container site must pay to dispose of the waste they generated,
except for the city resident. The city resident is paying for the
container site in their monthly assessment.
The last item related to the concern of messy yards and junked
vehicles throughout the city. The current ordinance Section
8.12.030 restricts any person to accumulate or scatter debris over
their premises. This violation is considered a nuisance and can be
addressed through enforcement procedures.
