CITY COUNCIL COMMITTEE OF THE WHOLE
AUGUST 1, 1995 5:30 P.M.

Ron Marshall reported that both the South Fourth Street and Fifth
Avenue railroad crossings were blocked tonight at the same time.
About a year and a half ago the City got a commitment from the
railroad that they wouldn't do that anymore, but it seems to happen
quite frequently. Ron suggested that the City contact John Grewell
with Montana Rail Link to bring this problem to his attention.
Lonnie mentioned that John Minch won't be here tonight due to knee
surgery.
The Mayor won't be here tonight due to his brother having surgery.
Donna wanted to know what was decided about all of the cars parked
and stored on the streets. She said that nothing is being done
about it. Mike said that if the Police department is called they
are tagging them and they are towed after 5 days.
Dave distributed minutes from 12-14-48 regarding sewer users
outside city limits. This is in response to Mr. Hicks request for
sewer service on East Railroad Street.
Dave also handed out and reviewed a booklet of information
regarding the sewer rate increase which is on the agenda tonight.
Jim distributed the PW Update of 8-1-95. He reported that the City
is no longer doing gas tests. He found out from the State that we
need to enforce the mechanical code before we can do gas
inspections throughout the City or the area 1 mile outside the City
limits. Discussion regarding the mechanical code. Jim suggested
that we not adopt the mechanical code at this time. We need to
wait and see what happens to the City's request for building
inspections outside the City limits.
Joe Leckie reported that the City will seek an Attorney General's
opinion regarding the O'Toole residence at 1819 W. Maryland Lane.
Joe has talked with the mayor and he has agreed that we should seek
an Attorney General's opinion in regards to the actual definition
of what a mobile home is, and what a manufactured home is and
whether under our zoning ordinances we can distinguish between a
manufactured home that is built to U.B.C. standards as opposed to
HUD standards. Joe has contacted the Attorney General's office and
they know that this request is coming. The real issue is to what
standards we can hold a manufactured house- a house that is built
off site.
Discussion regarding a court case in Belgrade and also subdivision
covenants.
Darrell McGillen said that he has had a couple of phone calls
regarding weed problems within the city limits, especially in the
alleys.
He said that someone had asked him what was going on regarding Mr.
Martin's property on Montana Avenue. Where are we at with that,
such as weeds, etc.
Jim said that weeds are handled on a complaint basis.
Mike Atkinson reported that the City has applied for a COPS program
grant. There is a resolution on the agenda tonight approving the
application.
Vicki reported that she had a phone call from a lady who had
received a phone call from someone who said that she was two months
behind in her water bill and the City was coming to shut it off
unless she paid it. She is an elderly lady and we don't know if
this is a one time prank, but the police are handling it. The call
did not come from a City employee, but someone posing as one. The
man calling wanted the lady to pay him.
The meeting was adjourned at 6:54 p.m.

SUBJECT: Public Works-- UPDATE
STREET & ALLEY
1. Continuing our street maintenance programs including pothole
patching, sweeping.
2. Sign replacement.
3. Mowing public right-of-ways.
PARKS & CEMETERY
1. Equipment, building and ground maintenance continuing
throughout the parks, cemetery maintenance, as needed.
WATER & SEWER
1. Meter replacement and testing program, will begin again in
September, following summer construction.
2. Plants continuing with normal treatment and maintenance
activities.
3. Jet nodding problem areas.
4. Water Improvements Project continuing with preliminary
engineering and collection of field data.
5. Hydrant at the Fire Station has been replaced.
SOLID WASTE
1. Proceeding with collection and container site operation as
required.
2. Limitations on what type of waste can be accepted at the
container site was sent out to the public in their water bill.
ADMINISTRATION
1. Building activity is typical of this time of year.
2. Continuing to work with all supervisors on scheduling work,
work habits, individual responsibilities and goal setting.
3. Working with the State Building Department to increase the
City's inspection area. City was also notified we cannot
continue to do gas inspections until we adopt the Uniform
Mechanical Code.
