October 5~ 1993
A regular meeting of the City Council of the
Montana, was held in the Council Chambers and called
Charles Rodgers at 7:04 p.m., on October 5, 1993.

COUNCIL MEMBERS ABSENT: Bob Graham
INVOCATION: Invocation was given by Alderman Collins.
MINUTES:
Motion by Alderman Marshall to approve the minutes of the regular
meeting of September 21, 1993, as presented, seconded by Alderman
Ehrlick. Motion carried 7--0.
CORRESPONDENCE:
Received the 1992-93 annual report from the Yellowstone City-County
Health Department.
Received a copy of a letter to Gary Temple from Hugh Sweeney,
Attorney, and a copy of a letter to Hugh Sweeney from Brewer &
Associates, a structural engineering firm, regarding the proposed
addition to 101 East Main.
CLAIMS:
Claims for the month of September were reviewed by the Budget/Finance
Committee and recommended that they be paid.
Motion by Alderwoman Kilpatrick to approve all claims in the
amount of $ 227,612.68 for the month of September~ 1993~ seconded by
Alderman Orr. Motion carried 7--0.
ADDENDUM TO POLICE POLICY MANUAL:
Ron Marshall stated that the addendum contains rules and regulations
for the Laurel Police Department Dispatchers.
Motion by Alderman Marshall to approve the addendum to the Laurel
Police Department Policy Manual, seconded by Alderman Collins. Motion
carried ?--0.
CONSIDER CHANGE OF COUNCIL MEETING DATE DUE TO ELECTION:
Chuck stated that the council may want to consider changing the
council meeting on November 2nd to November 3rd, due to city
elections.
Motion by Alderman Ehrlick to change the council meeting from
November 2nd to November 3rd, due to November 2nd being the Municipal
General Election, seconded by Alderman Marshall. Motion carried 7--0.
Chuck stated that on that same night either Kevin Bryan, County
Treasurer or one of the commissioners will be over to report on how
their first month of activity has been for licensing motor vehicles.
Jennifer Feldhaus reported that the county did 90 transactions on its
first day of business in Laurel. They predict that this will level
off to about 66 transactions a day with around 14 to 17 new licenses
and titles a day.
DISPOSAL OF CITY OWNED LOTS IN CHERRY HILLS SUBDIVISION:
Dave Michael stated the Budget/Finance Committee rejected a bid from
an individual for the single improved lot in Cherry Hills Subdivision
at the September 7th meeting. This individual asked what the city
wants for the lot and what the procedure is for obtaining it.

Dave stated that he has never received any direction from the council
regarding this improved lot or the other unimproved lots in Cherry
Hills. It was stated that we had an appraisal of the lots at one time
but the council needs to decide how to dispose of them.
Chuck referred this to the Building and Parking Committee and added
land to the committee title.
Don Hackmann~ City Clerk~ reported on the change in the law as of
October 1st. Previously, we had been required to advertise when
buying or selling equipment or land that was valued over $ 10,000.00.
The change in the law has raised this limit to $ 20,000.00 with
construction being raised to $ 25,000.00.

Alderman Orr. Motion carried 7--0.
It was stated that we received two bids for the painting of City Hall
but we were notified today that Arden's Decorating has withdrawn his
bid.

Motion by Alderman Orr to enter the City Council Committee of the
Whole minutes of September 21, 1993, into the record, seconded by
Alderman Marshall. Motion carried 7--0.
--City License Committee minutes of September 8, 1993 were presented
and reviewed.
Motion by Alderman Collins to enter the City License
minutes of September 8, 1993, into the record, seconded by
Orr. Motion carried 7--0.

Motion by Alderman Kellogg to enter the Laurel Airport Authority
minutes of August 24, 1993 and September 28, 1993, into the record,
seconded by Alderman Ehrlick. Motion carried 7--0.
--Park Committee minutes of September 23, 1993 were presented and
reviewed.
Motion by Alderwoman Kilpatrick to enter the Parks Committee
minutes of September 23, 1993, into the record, seconded by Alderman
Ehrlick. Motion carried 7--0.
--Police Committee minutes of September 28, 1993 were presented and
reviewed.
Motion by Alderman Marshall to enter the Police Committee minutes
of September 28, 1993, into the record, seconded by Alderman Kellogg.
Motion carried 7--0.
COMMENTS FROM THE AUDIENCE: None
APPOINTMENTS:
The Mayor appointed Marvin Carter to the Police Commission.
Motion by Alderman Kellogg to confirm the Mayor's appointment of
Marvin Carter to the Police Commission, seconded by Alderman Marshall.
Motion carried 7--0.

The Mayor appointed Gloria Wester to the Nominating Committe'e of the
Historical Preservation Board.
Motion by Alderman Ehrlick to confirm the Mayor's appointment of
Gloria Wester to the Nominating Committee of the Historical
Preservation Board~ seconded by Alderman Marshall. Motion carried
7--0.
The Mayor appointed Ron Bushnell to the Historical Preservation Board.
Motion By Alderman Ehrlick to confirm the Mayor's appointment

Alderman Orr. Motion carried 7--0.

Chuck stated the landfill is being taken care of, fences are being pnt
up and seeding will be started next week.
A committee will meet on Thursday at 5:00 p.m. to discuss South 5th
and possibly Spruce Grove.
Chuck said the city is installing sprinkler systems in the triangular
parks on First Street.
Joe reported on the temporary restraining order by First National
Pawn. What they want to stop is the new statute that allows police
officers to walk in and without a search warrant, not merely put a
hold on merchandise but actually take it from the store by request.
At this time, our police department can put a 30 day hold on
merchandise which allows us time to further investigate and get a
search warrant.
