CITY COUNCIL COMMITTEE OF THE WHOLE
AUG. 16, 1994 6:30 P.M.

Lonnie Kellogg stated that the Council had voted some time ago to
sell the city owned lots in Cherry Hills Sub. Lonnie stated that
after looking into this it became more complicated than they
thought. The biggest problems were with the water and sewer lines.
If they put the water and sewer lines in on one side and pave the
street, then when they put in the other side they would have to
tear up half of the street. He stated that they are working with
a couple of developers to see what would be the best way to go in
putting these lots up for bid. They will bring the proposal back
to the council when they get it ready.
Lonnie stated that the council received a letter several days ago
regarding the State's Highway Funding Projects over the next two or
three years. He thinks the city should definitely send a letter
concerning the drainage problem at the underpass so at least it
would be on record. They have funds coming up over the next three
years and maybe we could at least get our name on their list. We
need to state that this could become an emergency if the underpass
is flooded and there is a train blocking the 5th avenue crossing.
They need to be aware that this is our only access to the
Southside.
Ron Marshall stated that last week they interviewed 2 applicants
for the Director of Public Works. Both were very well qualified
with good extensive Engineering background. He did not have a
chance to go through the applications and was wondering if maybe
some of the other applicants would be less qualified but still be
able to do the job of what we are looking for. The Mayor cautioned
about going to light on the qualifications and stated that two of
the applicants have withdrawn because of the salary.
Donna Kilpatrick asked about the tanning salon going in at the
beauty shop at 209 W. 6th Street. Donna stated that the beauty
shop was grandfathered in that the people in the neighborhood are
up in arms because right across the street from them they have got,
in recent months, an antique store that is licensed to sell small
antiques. The residents have heard rumors that the business is
also refinishing furniture. These people are wondering what is
happening to their neighborhood. Donna asked if this should have

come before the council instead of the Board of Adjustments.
Gay Easton stated that the beauty shop was not grandfathered in but
was a variance that was applied for and granted probably 20 or 25
years ago.
Joe Leckie stated that he referred this to Cal Cumin and it was Cal
that decided it should go before the Board of Adjustments. The
people need to go to the Public Hearing tomorrow night if they have
any concerns.
Vicki Metzger stated that this will come before the council at the
time of their City License request.
Vickie also stated that Asphalt Supply has sold and we will have a
chance to review their application again. Ron Marshall stated that
it was his understanding that as long as the original applicant
owned and operated the business they could legally be there but he
didn't think there were any provisions for a new owner.
Sharon Herman stated that she will pass out the final copy of the
Policy and Procedures manual. These should be reviewed before the
Sept. 6th council meeting as they will be on the agenda for passage
and approved at that time.
