March 2, 1993
A regular meeting of the City Council of the City of Laurel,
Montana, was held in the Council Chambers and called to order by Mayor
Charles Rodgers at 7:03 p.m., on March 2, 1993.
COUNCIL MEMBERS PRESENT: Donna Kilpatrick Gay Easton
Albert Ehrlick Bob Graham
L.D. Collins Ron Marshall
Lonnie Kellogg
COUNCIL MEMBERS ABSENT: Norman Orr
INVOCATION: Invocation was given by Alderman Collins.
MINUTES:
Motion by Alderman Marshall to approve the minutes of the regular
meeting of February 16, 1993, as presented, seconded by Alderman
Graham. Motion carried 7--0.
CORRESPONDENCE:
Received a letter from Ken Haag, Director of Public Works~ regarding
House Bill #454 "An Act Amending the Megalandfill Siting Act".
Received a legislative bulletin from the Montana League of Cities and
Towns.
CLAIMS:
Claims for the month of February were reviewed by the Budget/Finance
Committee and recommended that they be paid.
Motion by Alderwoman Kilpatrick to approve all claims in the
amount of $ 278~068.12 for the month of February: seconded by Alderman
Ehrlick. Motion carried 7--0.
CHRISTMAS TO REMEMBER COMMITTEE:
Joanne Fox and' Jean Carroll Thompson, representing the Christmas to
Remember Committee~ stated they will be sponsoring a bazaar on April
2nd at the Kinder Closet. They are requesting permission to place
tables outside the Kinder Closet in order to sell hot dogs~ hamburgers
and pop.
Motion by Alderman Ehrlick to allow the Christmas to Remember
Committee to set up tables in front of the Kinder Closet during a
bazaar on April 2~ 1993, seconded by Alderman Graham. Motion carried
7--0.
ESTABLISHING ZERO SETBACK:
ORDINANCE NO. 1068 (second reading)
AMENDING SECTION 17.16.020 AND TABLE 17.16.020
OF THE LAUREL MUNICIPAL CODE, ESTABLISHING ZERO
SETBACKS IN RESIDENTIAL 6,0001 RLMF, AND RMF ZONES
IF APPROVED THROUGH THE SPECIAL REVIEW PROCESS
Public Hearing: No comments.
Motion by Alderman Marshall to close the public hearing, seconded
by Alderman Collins. Motion carried 7--0.
Motion by Alderman Graham that Ordinance No. 1068 ( second
reading) be passed and adopted, seconded by Alderman Kellogg. A roll
call vote was taken and all aldermen present voted, "YES". Motion
carried 7--0.
REPEAL AUXILIARY POLICE TO OPERATE AMBULANCE:

Motion by Alderman Marshall that Ordinance No. 1069 (first
reading) be passed and adopted, seconded by Alderman Kellogg. A roll
call vote was taken and all aldermen present voted, "YES". Motion
carried 7--0.
AMBULANCE SERVICE - ASSESSMENT OF COSTS:
ORDINANCE NO. 1070 (first reading)
AMENDING SECTION 2.76.150 OF THE LAUREL
MUNICIPAL CODE, VOLUNTEER AMBULANCE SERVICE-
ASSESSMENT OF COSTS
Motion by Alderman Graham that Ordinance No. 1070 (first reading)
be passed and adopted, seconded by Alderwoman Kilpatrick.
Motion by Alderman Marshall to amend Section 2.76.150, B, by
adding, "alter or amend such rates and add or delete charges,"
seconded by Alderman Kellogg. Motion carried 7--0.
A roll call was taken on the motion as amended. Motion carried ?--0
with all aldermen present voting, "YES".
ESTABLISHING JOINT HISTORIC PRESERVATION BOARD:
ORDINANCE NO. 1071 (first reading)
ESTABLISHING A JOINT YELLOWSTONE HISTORIC
PRESERVATION BOARD
Gall Kenson, Staff Planner for Yellowstone County, gave a presentation
to the council at the February 2nd council meeting and she briefly
reviewed it again.
Motion by Alderman Kellogg that Ordinance No. 1071 (first
reading) be passed and adopted, seconded by Alderman Ehrlick.
Joe Bradley clarified that the City Council would appoint one member
to this board and the city has to agree jointly with the other
entities on the remaining five members and the historic preservation
officer. The majority vote rules and no one entity can veto an
appointment.
Ron Marshall inquired whether this would cost the city anything and
Gall said it would not. The only way the city would incur any costs
is if the council would agree to help fund a project through matching
funds. No money would be spent without council approval.
Gall said she is working with the City of Billings to adopt this same
ordinance. Once they adopt the ordinance and appoint their member,
the five remaining members can be appointed. Gall anticipates the
first meeting will be held at the end of May.
A roll call vote was taken on the motion. Motion carried 7--0.
COMMITTEE REPORTS:
--Budget/Finance Committee minutes of February 16, 1993 were presented
and reviewed.
Motion by Alderwoman Kilpatrick to enter the Budget/Finance
Committee minutes of February 16, 1993, into the record, seconded by
Alderman Marshall. Motion carried 7--0.
--City Council Committee of the Whole minutes of February 16,
were presented.

reviewed.

--Police Committee minutes of February 18, 1993 were presented and
reviewed.
Motion _~_ Alderman Marshall to enter the Police Committee minutes
of February 18, 1993, into the record~ seconded by Alderman Kellogg.
Discussion followed regarding the requirement that a Municipal Court
have a qualified attorney living within the city. Ron pointed out
that a city the size of Missoula has a much larger pool of attorneys
to choose from. In Laurel, we only h~ve three attorneys and one does
not live within the city limits. It was stated that the salary for a
Municipal Judge would be the same as for a City Judge.
The council asked Joe*s opinion about the Municipal Court. Joe said
the city does not have that many appeals that go to a second trial.
Last year we only had two, At this time we have several appeals in
the works but not all of them will go to trial. So in regard to the
second item of the minutes, Joe said he doesn't have much to do and it
is not a prime concern.
In regard to the distribution of the fines, Joe said that in the past
year or two, he thought we only forfeited half of the amount of one
fine.
Joe did check with the City Attorney's office in Missoula and they
like the Municipal Court system but would like to check with some of
the larger towns in Montana and find out why they have not gone with
the system.
The committee will continue to investigate this and report back to the
council.
A vote was taken on the motion. Motion carried 7--0.

reviewed.

A Fire Committee meeting will be held on Thursday, March 4, 1993 at
7:00 p.m.
There will be a Public Utilities Committee meeting at 5:00 p.m. on

The Mayor stated that we need all 1993-94 budgets turned in by April
2nd.
Chuck stated that he and Dave have been meeting with the foremen and
will continue to do so the rest of the week to get their input into
the budgets.
There being no further business to come before the council at this
time, the meeting was adjourned at 7:32 p.m.
