HomeMy WebLinkAboutCity Council Minutes 06.07.1994Minutes of the City Council of Laurel June 7, 1994 A regular meeting of the City Council of the City of Laurel, Montana, was held in the Council Chambers and called to order by Mayor Charles Rodgers at 7:00 p.m., on June 7, 1994. COUNCIL MEMBERS PRESENT: John Minch Albert Ehrlick Lonnie Kellogg Donna Kilpatrick Gay Easton Bob Graham Ron Marshall COUNCIL MEMBERS ABSENT: Chuck Dickerson INVOCATION: Invocation was given by Alderman Kellogg. MINUTES: Motion by Alderman Marshall to approve the minutes of the meeting of May 17, 1994, as presented, seconded by Alderman Motion carried 7--0. regular Graham. CORRESPONDENCE: Received a note from Jack A. Spears regarding homes that have gravel, asphalt, pipe and wood in driveways. Received a memo from the Montana League of Cities and Towns regarding District meetings. District 11 meets Tuesday, June 14th at 10:00 a.m., City Hail in Billings. Received a preliminary 1995 legislative program from the Montana League of Cities and Towns. Dave received a letter from the Cove Irrigation Co. regarding water for the cemetery. Received a memo from Beartooth RC&D, regarding an appointment to the Board of Directors. Received the recommendation from Richard Larsen & Associates, Inc. regarding organization for the City of Laurel. (See item 13 on the agenda) The Mayor commented that the letter from Jack Spears is pointing out other areas in town that have gravel and such in their driveways. We have allowed it and it is not just a problem in Village Subdivision. Albert Ehrlick said this is one of those situations that goes back to where nothing is done until we receive a complaint about it. CLAIMS: Claims for the month of May were reviewed by the Budget/Finance Committee and recommended that they be paid. Motion by Alderwoman Kilpatrick to approve all claims in the amount of $ 260,061.55 for the month of May, 1994, seconded by Alderman Ehrlick. Motion carried PUBLIC HEARING & RESOLUTION TO VACATE ALLEY: This being the time and place advertised, a public hearing was held. No comments were made. Motion by Alderman Graham to close the public hearing, seconded by Alderman Ehrlick. Motion carried 7--0. RESOLUTION NO. R94-17 VACATING ALLEY, TRACT l-B, IN CERTIFICATE OF SURVEY NO. 1780, IN THE CITY OF LAUREL, MONTANA Minutes of the City Council of Laurel Page 2 Council Meeting of June 7, 1994 Motion by passed and adopted, seconded by Alderman Graham. with Alderman Kellogg voting "NO". PROHIBITING SOLICITATION ON OR NEAR ROADWAYS: ORDINANCE NO. 094-7 (second reading) ADDING TITLE 9.25.010, TO THE LAUREL MUNICIPAL CODE~ PROHIBITION OF SOLICITATION ON OR NEAR ROADWAYS Public Hearing: Duane Guenthner spoke in favor of the ordinance. No opponents. Motion by Alderman Marshall to close the public hearing, by Alderman Kellogg. Motion carried 7--0. Motion by Alderman Marshall that Ordinance No. 094-7 reading) be passed and adopted, seconded by Alderman Minch. call vote was taken and all aldermen voted "YES". Motion 7--0. 1994-95 FIRE DISTRICT CONTRACTS: RESOLUTION NO. R94-18 A RESOLUTION APPROVING AGREEMENTS BETWEEN THE CITY OF LAUREL AND RURAL FIRE DISTRICT NO. 5, SAID AGREEMENTS RELATING TO FIRE PROTECTION and Alderwoman Kilpatrick that Resolution No. R94-17 be Motion carried 6--1 seconded (second A roll carried Motion by Alderman Kellogg that Resolution No. R94-18 be passed adopted, seconded by Alderman Graham. Motion carried 7--0. Darrell McGillen informed the council that with the fire district resolutions~ the city is entering an agreement for three fiscal years. The committee submitted a 10% increase over the previous year's contracts and divided it out over a three year period. Darrell said the Fire Committee is happy with this agreement and they did not receive any opposition from the districts or LUFSA. RESOLUTION NO. R94-19 A RESOLUTION APPROVING AGREEMENTS BETWEEN THE CITY OF LAUREL AND RURAL FIRE DISTRICT NO. 7, SAID AGREEMENTS RELATING TO FIRE PROTECTION Motion by Alderman Kellogg that Resolution No. R94-19 be passed and adopted~ seconded by Alderman Marshall. Motion carried 7--0. RESOLUTION NO. R94-20 A RESOLUTION APPROVING AGREEMENTS BETWEEN THE CITY OF LAUREL AND CARBON COUNTY FIRE DISTRICT NO. 8, SAID AGREEMENTS RELATING TO FIRE PROTECTION Motion by Alderman Graham that Resolution No. R94-20 be passed and adopted, seconded by Alderman Kellogg. Motion carried 7--0. RESOLUTION NO. R94-21 A RESOLUTION APPROVING AGREEMENTS BETWEEN THE CITY OF LAUREL AND LAUREL URBAN FIRE SERVICE AREA (LUFSA), SAID AGREEMENT RELATING TO FIRE PROTECTION Motion by Alderman Marshall that Resolution No. R94-21 be passed and adopted, seconded by Alderman Minch. Motion carried 7--0. Minutes of the City Council of Laurel Page 3 Council Meeting of June 7, 1994 AGREEMENT WITH B-S PARTNERSHIP: This item was postponed until the next meeting, at which time a resolution will be presented. SOLID WASTE AGREEMENT WITH CITY OF BILLINGS: RESOLUTION NO. R94-22 A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF LAUREL AND THE CITY OF BILLINGS, SAID AGREEMENT RELATING TO SOLID WASTE DISPOSAL Dave Michael gave an overview of the agreement. an increase of $ 1.98 for compacted garbage and garbage. This is necessary in order for the maintain their landfill and meet regulations. R94-24 A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF LAUREL AND COVE IRRIGATION CO., SAID AGREEMENT RELATING TO SALE OF EXCESS WATER, BY COVE DITCH COMPANY Motion by Alderwoman Kilpatrick that Resolution passed and adopted, seconded by Alderman Ehrlick. 7--0. no. R94-25 RESOLUTION OF INTENT TO VACATE PUBLIC RIGHT OF WAY (ALLEY), LOCATED TWENTY (20) FEET WEST OF LOT 1, BLOCK 7, OF CHERRY HILLS SUBDIVISION Motion by Alderman Graham that Resolution No. R94-25 be passed and adopted, seconded by Alderman Kellogg. Motion carried 7--0. RECOMMENDATION FROM RICHARD LARSEN & ASSOCIATES, INC.: The Mayor stated the council needs to review the recommendation from Richard Larsen & Associates~ Inc. regarding the positions of maintenance director and utilities director. He said the council needs to come up with something in the near future and go ahead with the advertisement. Bob Graham recommends that the city council go ahead and advertise for the position of maintenance director immediately. Regarding the reorganization of the city, Bob suggests that we advertise and hold a public meeting because of the possible controversial nature of things. Lonnie Kellogg stated that our current ordinance lists the job qualifications and we are now looking at different criteria for this Minutes of the City Council of Laurel Page 4 Council Meeting of June 7, 1994 position. If we want to use the new criteria, we would have to draw up a new ordinance. Motion by Alderman Graham to accept the position of maintenance director with the new job description and have the City Attorney draw up an ordinance with the new description, seconded by Alderman Marshall. Joe Leckie said the city can start the advertising procedure during the 30 days after the ordinance passes and before it takes effect. The only thing you cannot do is make the actual hiring determination before the 30 days are up. You would advertise the job with the provision that they will be functioning under the new ordinance. Lonnie Kellogg stated he is still opposed to a maintenance director and feels the city needs an engineer. He said the city is bulging at the seams and we are looking at new subdivisions and this work will require an engineer. More discussion regarding what position needs to be filled, what are we willing to pay for a given position and what prospects are we going to attract for this given salary. A vote was taken on the motion. Motion carried 7--0. More discussion and it was stated that we need to look not only at the maintenance director but also at how the utilities director position ties in. Bob said, first we need to and then tie the second one that job description on our determine what our main position will be into it. Once we do this, we can change books also. Bob stated that Richard also recommended that the city treasurer's position be combined with the city clerk, which would eliminate one position. He asked everyone to consider this and talk to the clerk and treasurer. Don Hackmann said this is a long term goal and nothing can be done about the position until the treasurer's term is up. Motion carried 7--0. --Parks Committee minutes of May 26, 1994 were presented and reviewed. Motion carried 7--0. --Public Utilities Committee minutes of June 6, 1994 were presented and reviewed. Debbie McGrath, 315 East 4th Street, attended the committee and was in attendance at the council meeting to express her about the water breaks that are occurring in her area on a basis. meeting regular She said she has lived in her house for eight years and there seems to be a water break on a yearly basis and just this spring there have been three. She was told at the meeting that the pipe in this area was installed in the 1930's and she would like to know what can be done about getting this replaced. John Minch reported that the records indicate that there have been 14 water leaks made from First Avenue to Idaho Avenue since 1987. So far this year, there have been four in this area, none the previous year and four the year before that. Bob Graham recommends that the city put this area as a priority for fixing~ if and when money is available. Bob Graham stated a subcommittee will listen to Water Specialties, who is interested in helping us the water plant, at no charge to the city. Discussion regarding driveway approaches and that they must conform to our code book, how are we going to inform those who are violating the codes and how we will enforce it. Joe Leckie stated that letters were mailed to residents of Village Subdivision regarding the removal of gravel and such from driveway approaches. Now that we are aware of others, letters will be sent to them also. The letter stated that they have 10 days to comply and the Minutes of the City Council of Laurel Page 6 Council Meeting of June 7, 1994 time is up and Joe asked direction from the council as far as how to proceed. It was stated that we do not know which trailers are rentals and which are being lived in by the owner. Discussion about how to serve notice to the owner. Dave stated that the city is having trouble coming up with an acceptable project for the ISTEA money. Cal Cumin asked Dave to prepare a map for wheel chair handicapped curb cuts. They went through the business district, First Avenue, around the schools and parks and came up with more than an adequate number of cuts for the ISTEA funds. Cal will now submit this to the state to see if it is an acceptable project for ISTEA funds. Discussion about the possible purchase of a road screen by which we could recycle the chips we put on the streets instead of dumping them. COMMENTS FROM THE AUDIENCE: The Laurel Volunteer Fire Department requested permission to shoot their annual fireworks within the city limits on July 4th. Motion by Alderman Graham to allow the Fire Department to shoot their fireworks within the city limits on July 4th, seconded by Alderman Marshall. Motion carried 7--0. There will be a Fire Committee meeting on Monday, June 13th at 7:00 p.m. at the FAP complex to discuss the Airport Authority fire agreement. A License Committee meeting will be held on Tuesday, June 14th to review the licenses. John Minch requested permission to leave the state from June 10th to the 19th. Motion by Alderman Ehrlick to grant John Minch leave the state, seconded by Alderwoman Kilpatrick. permission to Motion carried APPOINTMENTS: None MAYOR'S COMMENTS: The Mayor stated there are problems within the Airport Authority and they are considering increasing the membership on their board. Hopefully, they will work out their problems. There being no further business to come before the council at this time, the meeting was adjourned at 8:15 p.m. Donald L.
