Minutes of previous meeting approved as presented. Bills
approved for payment: Engineering Department in the amount of
$200.00 for Administrative Services in September; Laurel Outlook
in the amount of $24.00 for advertising Martin etal and North
• Hill Estates.
HOME OCCUPATIONS:
Dale Schneider not present. Discussion tabled.

Associates recommends approval. Joe Bradley
approved such occupation previously. Motion
seconded, passed.

Danny J. Fox dba Al Custom Cabinets of 219 West Ave. Plans to
work out of his garage. Will use two or three saws. Neighbor
across alley already.doing this. Gerald Shay pointed out that
two people are involved. Fox etal would go to homes and.custom
build cabinets to owner's desires. No lumber_ storage, just enough
materials for one job. Cal Cumin echoed Gerald Shay's comment
as well as noise involved. Bus Roberts asked.and was answered
that neighbors did not object. Mr. Shay reiterated that more
than one family is involved; which is contrary to ordinance.
Joe Bradley expanded these are unrelated persons in business.
Motion from Joe Bradley that the board recommend denial,
seconded by Merritt Williams. Passed.
MARTIN ETAL #83-7: A zone change has been requested on Lots 10--15,
Block 21 and Lots 10--15, Block 20, Laurel Realty 2nd Subdivision,
from E6000 zone to-allow Residential Professional.-.The property
is located between 401 1st Avenue and 519 1st Avenue, Laurel,
Montana. Fee and time interval was waived by Council. Advertised
in Laurel Outlook on August 24 and 31st.
Written protest received from 48 homeowners.
Jack,Martin, owner of 519 1st-Avenue, a sandstone.house on
three lots, present. He stated that previous.rezoning request
was denied so he wants to include the west half of the blocks
between 4th and 5th Street.also to conform with the one block
requirement. Joe Bradley asked if Mr. Martin has consent of
all of the people in the second half of the block. Unanimous
consent does not exist.
Dr. Wheeler listed the advantages to him of this location.
He proposes a building something like Dr. Hoklin's..
Cal Cumin read the 12 point zone change criteria.. He
questioned whether this zoning request complies with master plan.
Kathleen Phillips said there is plenty of area downtown
available. Alex Henry states we have too much traffic on lst
Ave. already. Russell Stadalman lives across alley from stone
house.and is opposed to extension of zoning.
Mr. Martin rebutted that a dental clinic could not materially
affect traffic on what is already a major arterial.
Discussion of our Comprehensive Plan going back to 77-79.
There was comment about problems in Billings concerning rezoning
blocks by half.
Motion from Otto Preikszas that board recommend approval.
Motion died for lack of second.
Motion from Joe Bradley that board recommend disapproval,
seconded by Jim Seaton. Passed.

CLARENCE FOOS NORTH HILL ESTATES #83-8: Richard Gee, planner,
represented board in lieu of Cal Cumin due to a conflict of
interest. Sandra Fischer, landscape architect, presented plan
with detailed specifications about Phase I. Eastern half would
have 54 lots on it. Jim Worthington addressed traffic flow.
Traffic would have access to Alder Avenue and Yard Office Road,
both of which are collectors. Mr. Schoenthal and Audubon Society
said park dedication was very good regarding traffic, zero keg-
gers, access by foot only, beautiful diversity, marsh-juniper
bunch grass community, cottonwood perimeter area, etc. Useful
to EMC students, Laurel public schools. Useful for 25 years
as is before reconsideration needed.
Gordon Weber representing Audubon Society, 437 members.
in area. Society has a fund to assist EMC in restoring area
to natural character. It is already useable. Improvements would
start in fall and be in place by June, 1984.
Jim Phelps, an officer of the Audubon Society wished to
reinforce. comments of previous two speakers.
A tape by Larry Mayes, biology instructor, was played in
favor. of keeping the park area in a "natural setting." Area
is handy to Laurel schools.
See attached comments from Richard Gee, Harry Wolverton,
and others. Also attached is the response from the subdivision's
engineer to these comments. (Exhibit X)

4) The subdivision improvement agreement needs to provide
Guarantee of Improvements section.
5) Easements and/or dedicated rights-of-way be provided for
Big Ditch and High Ditch.
6) Utility easements as required be granted to various companies.
7) Improvement of statement in North Hills Estates Subdivision
filings.
8) Recommend granting of variance in length of road of cul-de-sac.
Motion from Joe Bradley that Preliminary Plat be approved
subject to above recommendations, seconded. Passed. This now
goes to the County Commissioners for their consideration.
Recommendations of board:
1) Accept park as proposed.
2) Second access should be provided.
3) Full right-of-way, Clarhill Road, developed by start of

ZUCK. ANNEXATION REPORT: Mr. Zuck.explaine,d proposed layout of
addition from a map proposal.. Ed LaPrath questioned 60 ft.
width of street when records in Billings snow 80 ft. Mr. Zuck
said part of Date Avenue was deeded to Sunhaven before Zuck opened -
it.
Cal Cumin discussed requirements to be met for annexation
(see Department Heads comments attached). He recommended that
after Mr. Zuck gets a ,plat for annexation by the-City, we
review the plat for conformity to existing regulations. No
opponents appeared. Mr. Zuck continued that he is asking for
guidance and direction to-cut down.on number of legal papers
to be filed. He asked if feeling is that.streets should be
extended. Mr. Zuck says he has met with City people and there
is a meeting of minds except that there was some objection to
putting some streets through at ,a prior meeting of the Board.
Cal Cumin said we could recommend approval of area which
is already platted. Zoning has been approved and next step
would be request for replatting.' To LaPrath's-question, Cal
answered that a 50 foot lot would be impractical.
Moved, seconded, and passed 5--3 to recommend annexation.
Moved, seconded, and passed that the board recommends to
Council that it wait for a replat review by this board.

Procedure
1. Complete home occupation request form and submit it to the
City seven (7) working days prior to a regularly scheduled
meeting of the Planning Board.
2. The Planning Board will consider the request at their regu-
larly scheduled meeting. Attendance at this meeting is
required by the applicant or his /her representative.
3. The Planning Board will make a recommendation to the City
Council that the specific request for a home occupation
designation be granted or denied.
4. The City Council will consider the Planning Board's recom-
mendation concerning the - specific home occupation designation
and approve or deny it at their next regularly scheduled
meeting. Attendance by the applicant or his /her represent-
ative is required at this meeting.
