Minutes of previous meeting approved as presented. Bills
approved for payment: Engineering Department in the amount of
$200.00 for Administrative Services in December; Cumin Associates
in the amount of $3,375.00 for.Planning Advisory services for
October, November, and December, 1983, as per agreement.
PUBLIC HEARING - VANNICE PB #83-9: A land use variance has been
requested on Lot 10, Block 19, Laurel Heights Subdivision, Zone
R-6000, to allow a business office or real estate office. The
property is located at 620 2nd Avenue, Laurel, Montana. Fee has
been paid. Advertised in the Outlook 11/23 & 11/30/83.
Mrs. Vannice is represented by Larry Herman, Attorney.
Motion by Bus Roberts, seconded by Ken Christian, to make petitions
part of these minutes. Carried. Original non-conforming use as
flower ship started in 1948. Via variances it has been a real
estate office, book store. It is alleged the present shape
of the building dates to 1948. Its current use as a real
estate office dates back to August, 1982. Parking only on
the street. Five people currently work at the real estate
business. City granted a license for use as a real estate
business without formality of a request for variance. Question
raised about charging commercial rates for garbage. Mrs. Caudillo
complained about parking on her side of street (she lives opposite)
, children playing on her property, etc., says extension of
building causes a traffic hazard. Her remarks were supported by
Mrs. Phillips and Mr. Lehr. Mr. Herman pointed out that Mrs.
Phillips owns a beauty shop in the area. Mrs. Phillips says
she had a variance only once in 11 years. The flower shop
businesswas not closed, the business was sold, and subsequently

moved to Main Street. Cal Cumin mentioned that the business
has been.in there a year, that--the variance is only for Lot 10,
and for a real estate office for no more than 5 people. Mrs.
Caudillo asked about tifn4YZ-9ps9: Mr. Cumin said it w,6ald be
awkward for us to-deny since-it has 15-16 months of real estate
use. Joe Bradley said the real estate office has -burdened the
neighborhood over, previous-uses. Motion from Ken Christian that
variance be approved solely for Lot 10, limited to 5.employees,
and restricted solely to a real estate sales office, seconded
by Bus Roberts. Carried.- This recommendation goes t'o'the City
Council for final approval slated for January 3, 1984.
PUBLIC HEARING - AMEND SECTION 17.32.01: Advertised in the
Outlook 11/23 & 11/30783. This hearing to recommend deleting
of "Concrete or paving materials mixing plants and--manufacturing
of concrete products".from LI:,use.
Mir. Bob Scbessler.is non-conforming and his.:quest.ion
concerned being able to increase or expand his operation on
the site. ' -Jae= Bradley said Enanging ordinance- wo.a1d' 11mit
expansion. w
Motion from Joe Bradley to delete "or paving materials"
from ordinance. Mr. Schessler asked „if he could put up another
silo, for example. Explanation, leaves in "concrete mixing and
manufacturing of concrete products"-so Schessler's present
operation is not-affected. Otto P.reikszas seconded the motion.
Carried. Recommendation goes to the City'Council for final
approval.

Motion from Joe Bradley that Section 17,.32.010 be further
amended "heavy manufacturing- .or blending or mixing plants
not otherwise mentioned are allowed in heavy industrial area
under special review," seconded by Ken Christian. Carried.
Recommendation goes to the City Council for final approval.
Cal Cumin brought up that RP Zone is too broad and that
a requirement f-or special-review is'needed. The only thing
allowed in RP Zone is relatively innocuous, Cumin stated.
Parking ordinance.was voluminously discussed.

Joe Bradley suggested we conform with. State law which-identifies
section protested and that the person.signing has a justifiable
right to protest. Joe Bradley has given the secretary a wording
to use in making forms. Mr. Bradley thinks the filing can be
with this Board. Discussion about checking validity of each
protestor i.e. we shouldn't make public jump through too many
hoops to protest.
ROGER ANDERSON update: Nothing is being done and legal
proceedings will be necessary.
We have two plats coming up. Straw, Smith, Roberts,
Christian and LaPrath are on plat review committee.
