MONTANA 59044 December 13, 1984 Meeting called to order with the following members present: R. M. Williams, Vice President.?(County Rep.) Ed LaPrath (County Rep.) Marvin Carter (City Rep.) Bus Roberts (City Rep.) Kenneth Christian (County Rep.) Joseph M. Bradley (City Rep.) Members absent: John Hawley Smith, President (City Rep.) Gerald-Shay, Member-at-Large, Exec. Secty Jim Seaton (County Rep.) Hal Dantic (City Rep.) Jim Straw (County Rep.) Also present: Kent Harris Cal Cumin, Cumin Associates, Billings Jim Worthington, Billings Boyd Strissell Minutes of previous meeting approved as sent out. Bills approved for payment: Engineering Department in the amount of $200 for administra- tive services in December; Cumin Associates for Planning Advisory Services for October, November, & December, 1984, as per agreement in the amount of $3,375.00. PB #84-18 STRISSELL REPLAT:- Jim Worthington appeared in behalf of splitting one lot into two and spoke. Recommendations of the Public Utilities Director were read and discussed. Mr. Worthington stated present house prevents dedication of 20 ft.-more right-of-way on east. Motion by Marvin Carter, seconded by Joe Bradley, for 10 ft. dedication on east side of Mullberry and setback waiver. Passed. Motion by Joe Bradley to waive 7th Street dedication, seconded by Marvin Carter. Passed. Motion for waiver of annexation on Lot 27A1 and 27A2 be received prior to replatting by Joe Bradley, seconded by Ken Christian. Passed. Motion to require waiver for all SIDs by Joe Bradley, seconded by Ken Christian. Passed. Motion for easement for ditch and utilities for 10 ft. on south boundary by Marvin Carter, seconded by Ken Christian. Passed. Motion for utility easements on north and east sides as requested by utilities from Joe Bradley, seconded by Marvin Carter. Passed. Motion to recommend conditional approval of the replat subject to these various motions by Joe Bradley, seconded by Marvin Carter. Passed. HOME OCCUPATION: Timothy William Grady requests a home occupation for repair work of air condition and h-eating units at 2206 Atchison. Applicant was not present, so this was tabled until applicant appears. Planning Board minutes December 13, 1984 DOWNTOWN PARKING: Kent Harris requested Jim Worthington be allowed to present plan for parking lot on Blackburn property. Showed drawing of proposed public lot for 80-100 cars. Motion by Joe Bradley, second from Marvin Carter. to support parking inquiries. Passed. SIGN ORDINANCES: Motion from Joe Bradley to notify Council that sign ordinance is being studieJ1, second by Marvin Carter. Passed. Board needs comments and suggestions from Council and from new engineer. Copies are available for.review. Purpose is to stay on top of sign ordinance to be able to act quickly if problem arises. BILLINGS CITY-COUNTY PLANNING: Billings has agreed to modify juris- dictional area to end conflicting areas. Laurel would take to 64th Street and north to King Avenue. Actual expansion to King will require special petition from 5% of the freeholders in area between our 42 mile jurisdiction to King. MISC: Cal Cumin asked to be informed of possible problems and questions For him. Motion from Joe Bradley, second by Bus Roberts, to recommend amendment of Sec. 17.88.050 of the Laurel Municipal Code to provide "City Council may hold a public hearing on the application. The Zoning Commission may recommend. to the Council whether to hold a public hearing or not." Passed. Discussion of non-conforming uses-and increasing of burden on neigh- borhood. Miscellaneous: Revise population estimates for Laurel and respond to HKM future water system plan questions. Letter regarding development on 72nd Street. Jurisdictional area: revise map, coordinate with Billings Planning Board a joint meeting, prepare petition to enlarge planning area, meet with County Commissioners. Attend County tax sale regarding Mogen and Nutting Subdivision lots. Roger Anderson: request County Attorney action once again. Attend City Council meetings. r CUMIN A550CIATES B gs Mt 59904' 406/245-6944 December 13, 1984 Jock West, Attorney at Law 2822 3rd Avenue North Billings, MT 59101 Dear Mr. West: In reference to possible subdivision development of 5.16 acres on 72nd Street West (Tract 2-A of Amended Tract 2, C.S. 1646 in EJ-zNE,NE4 of Section 36, T.1S.,R.24E. Yellowstone County), there are several factors to consider: 1. The site is currently prime, productive agricultural land, and there doesn't appear to be any pressing need to change this status. The Laurel Planning Board has, in the past,-gone on record opposing such development in prime agricultural areas because of a lack of need for such non-agricultural developments. Under State and County law, the "basis of need" is a required criteria for reviewing subdivision development--both of residential or commercial nature. 2. Changing the land use of the site from its present agricultural status would create land use conflicts between new uses--either commercial or residential--and those existing agricultural uses which include intensive farming and a large, confined livestock feeding operation one-mile to the south. 3. The groundwater in this area has been, historically, of question- able quality. Furthermore, on-site wells--as well as septic tank drain- fields--will be affected by the surrounding and adjacent irrigation practices. 4. The area of this tract is included in the Comprehensive Land Use Plan adopted for this part of the County by Laurel and the County Commissioners; it is planned as an agricultural land use, and any change in that land use would be in violation of the adopted Comprehensive Plan. E As any proposal for development of this site has not been before the Laurel City-County Planning Board, as of yet, the comments made herein are strictly my own; the landowner certainly has the right to make application for development review to the Planning Board and ultimate approval/denial by the County Commissioners. Freeman, Director of Planning SUBJECT: Planning Board Jurisdictions At their regular meeting of December 4, 1984 the Planning Board reviewed the results of a meeting between the Board's Comprehensive Plan Committee and the Laurel-Yellowstone City-County Planning Board. The two major issues were 1.) that the Laurel Jurisdictional area should include areas which logically should be in their area and 2.) to have a boundary which would be easily recognizable and would allow property owners to easily determine in which jurisdiction their property was located. It is the recommendation of this Board that the Laurel jurisdiciton be extended to the west to the County line, to the north to King Avenue and to the east to 64th Street West. The Board recommends conditional approval with the follow- ing provisions: 10 ft. dedication of right-of-way on east side of Mullberry and waive setback requirement Waive 7th Street dedication , Need waiver of annexation.
