Minutes of previous meeting approved. Bills approved for payment:
Engineering Department in the amount of $200.00 for Administrative
Services in March.
PUBLIC HEARING:.. CHARLES & DARLENE FISCHER PB #84-03 - LAND USE VARIANCE
A land use variance. as been requested on Lots 7, 8 and 9, Block 22,
East Yellowstone Subdivision,.RLMF Zone, to allow an 8-unit dwelling
to be constructed upon an area containing 12,600 sq. ft., more or less.
The property is located at 216-220 Cedar Avenue, Laurel. Fee has been
paid. Advertised in the Laurel Outlook 2/22/84 and 2/29/84.
Larry Herman, representing Charles Fischer, explained that nearby
use is compatible with request (existing storage sheds and apartments)
and that necessity for change is because.of percentage of building to
free space per lot.
Cal Cumin says it is 2,600 over for a 4-plex but 3,200 short for
an 8-plex.
Mr. Herman suggests this is a good buffer zone between the railroad
and residential. His client seeks a special variance requiring one
action vs two required for a zone change. The existing 6 and 8-plexes
were existing while or before comprehensive zoning was complete.
Joe Bradley.answered Jim Straw that this is a variance from existing
zoning.
Darwin Johnson got up to delineate history and that everything done
there was legal at the time and that he bought land under assumption that
regulations were as they originally were. Mr. Johnson might want to do
the same as Mr. Fischer on the adjoining land.
. Cal Cumin described area around site with protest available.
Cedar Avenue is a dead-end street which is potential trouble for
fire trucks. Traffic could enter and exit only on 4th Street --
already a busy street. The City did follow legal procedures in
zoning despite prior zoning.
Albert Ehrlick objects and protests that people run up on his
lawn and if not for trees errant cars might hit his house. His main
objection is that traffic is already too heavy.
John Hawley Smith requested that protests of six people be made
a part of these minutes.
Mr. Herman rebutted that area might be rezoned.
Mayor Ehrlick.said if this is granted, then Mr. Johnson could
ask for a variance.
Motion from Otto Preikszas to grant the variance as requested.
Motion died for lack of'a second.
Motion from Joe Bradley to deny the request, seconded by Bus
Roberts. Before the vote Joe Bradley explained he is anti due to
procedure, that Board should follow more formal procedures. Before
the vote, Larry Herman withdrew his petiton.
Yu^ HOME OCCUPATIONS: R. A. Kansala, 602 W. 13th Street, requests a home
occupation for a small computer systems development laboratory. (see
request form).
3rd Motion from Bus Roberts to recommend approval, seconded by Jim
Straw. Carried.
ROGER ANDERSON UPDATE: Nothing is happening.
LARRY MYERS UPDATE: Registered letter came back, address unknown.
There is a hearing March 26, 1984, at 7:30 p.m., in Park City multi-
purpose room. Our jurisdiction ends 1/4 east of area and this board
has the right to question runoff from area. Planner is John Beaudry,
civil employee at Columbus. Rod Fink says that a groundwater monitor-
ing requirement exists.
John Hawley Smith said that concurrent with adding Village
Subdivision should have extended its jurisdiction eastward by about
a mile. Cal Cumin learned about this on March 7, 1984. This is a.
matter for adjudication between City of Laurel, Billings and County
Commissioners after agreement between planning boards.
Motion by Bus Roberts that a map be drawn extending this board's
jurisdiction eastward and that steps be taken to resolve the boundary
dispute with Billings Planning Board, seconded by Joe Bradley. Carried.

thus, the use of a portion of a structure as a home occupation will not
permit a subsequent owner an automatic home occupation designation.
Procedure
1. Complete home occupation request form and submit it to the
City seven (7) working days prior to a regularly scheduled
meeting of the Planning Board.
2. The Planning Board will consider the request at their regu-
larly scheduled meeting. Attendance at this meeting is
required by the applicant or his /her representative.
3. The Planning Board will make a recommendation to the City
Council that the specific request for a home occupation
designation be granted or denied.
4. The City Council will consider the Planning Board's recom-
mendation concerning the specific home occupation designation
and approve or deny it at their next regularly scheduled
meeting. Attendance by the applicant or his /her represent -
ative is required at this meeting.
