Meeting was not called to order due to a lack of a quorum. The
following were present:

Hearings held as delineated below. Delayed meeting called for
• May 14th at 7:00 p.m., for completion of business.
HOME OCCUPATIONS: Ray Hatfield, 420 Cedar, requests a home occupation
for a taxidermy business. -Ray stated this would be a bird, fish, and
animal taxidermy, no other. Jim Straw asked if this is downstream a
full-time occupation. Mr. Hatfield stated that although he is currently
unemployed, he is seeking permanent employment of a different nature.
Tools - mostly his hands. Neighbors know about this but no comment, in
fact not too many neighbors. Skins are salted for preservation and
shipped to Kallispel for tanning. Jim Straw seemed favorably inclined.
Bus Roberts saw no traffic problem.
Mike Hoppel, 819 7th Avenue, requests a home occupation for an
upholstery business. Mike wants to start an upholstery shop in a two-
car garage. Gerald Shay states that the ordinance is specific that there
may be no sales other than material used in work. Otto Preikszas asked
about extra trash. Marv Carter said if necessary then there would.be an
extra can and fee. Mike proposes only temporary occupancy, say 4 months.
PUBLIC HEARINGS:
SECTION 17.32.010, AMEND ZONING ORDINANCE: Published in newspaper 4/25
and 5/2/84. Cumin Associates explained this section, List of Uses, Com-
mercial-Industrial Districts (see copy attached). No comments from the
audience..
FILE #PB 84-04 POINDEXTER: A land use variance has been requested on
Tracts lA and 2A of C/S 41780, 86000 zone, to allow a triplex to be built.
The property is located at 804--806 W. 7th Street, Laurel. Fee has been
paid. Published in Outlook 4/25 and 5/2/84. Petitioner present. No
protests received. This is located west of Sth.Avenue and on 7th Street

extended. City engineer says City can and will culvert drainage ditch
which exists midway in 7th Street extended west of 8th. He would side- •
walk and curb both sides of this property in conformance with existing
checkerboard pattern east of 8th Avenue. Jim'Straw asked, "How would
you access this property?" Ans: The third unit in back can be accessed
from vicinity of West School. Hardship claimed due to existing services.
The planner is against since it is in contradiction to R6000 zoning.
FILE #PB 84-05 S &.S SUBDIVISION REPLAT: Jim Worthington made the presen-
tation of the replat. No protestors. No comments.
FILE #PB 84-08 DeCARLO SUBDIVISION REPLAT: Jerry Cormier presented the
replat. This is located SW of the Golf..Course cornering on the Big Ditch,
east of Wold Road and SW of Fairway Drive.. Cumin Associates pointed out
that numbering..-on-the plat makes this-confusing. It needs to be corrected.
Land not particularly suited to agriculture since the area is gravelled.
Cumin called attention to fact road platted NE of plat includes Big Ditch
but this is not being subdivided. Jim Straw leans to wider dedication of
road along ditch. Someone pointed out that the Big Ditch is here an
embankment so view is not a factor for site. Purpose of this plat is to
divide two lots into five for resale. The road along ditch is wide enough
to construct the road. Mr. Cormier stated the road is outside the juris-
diction of this request. Mr. Russell says there is sufficient width for
the road and County surveyor has no plans to improve it. Road is only for
incidental useage now. Cumin wants to go for 10 ft. session. Russell
insists there is sufficient space now. Cumin advises conditional approval
of replat subject to letter from County surveyor that there is enough
space for a road. •
FILE #PB 84-11 MURRAY HEIGHTS PARTIAL ANNEXATION: No representatives
present.
PLANNING JURISDICTION: Jim Straw pointed out that this may be moot after
June 1, 1984, when Billings may pull out of planning. Straw defended job
we have been doing and on re-thinking it was apparently conceded that
Laurel should be left along. Commissioners in Resolution of Intent said
Laurel is doing OK and should be left along.
Meeting postponed from May 10, 1984, called to order May 14, 1984,

Minutes of previous meeting approved. Bills approved for payment:
Engineering Department for Administrative Services in April and May, in
the amount of $400.00.
HOME OCCUPATIONS CONTINUED: Motion from Bus Roberts, seconded by Jim
Seaton to recommend approval of Hatfield's taxidermy at 420 Cedar.
Carried.
Cumin Associates recommended against Hoppel upholstery. Bus Roberts
asked about trash since a previous business created problems. Otto
Preikszas wants excessive trash provided for. Ed LaPrath moved to
recommend approval since we have been generous in previous cases. Died
for lack of second. Motion from Jim Seaton to recommend denial, seconded
by Bus Roberts. Carried.
SECTION 17.32.010 AMEND ZONING ORDINANCE CONTINUED: Changes proposed
explained at previous regular meeting making one deletion and requiring
special review for some others. Cumin Associates read rewritten ordinance
as we had already discussed it. No protests. Motion from Otto Preikszas
to recommend approval, second by Ed LaPrath. Carried.
FILE #PB 84-04 POINDEXTER CONTINUED: It is to City's advantage to clean
up a mess. Motion from Otto Prei szas to recommend approval, seconded
by Bus Roberts. Carried.
FILE #PB 84-05 S & S SUBDIVISION REPLAT CONTINUED: Cumin says technically
no problems. Moved by Jim Seaton we recommend approval, seconded by Ed
LaPrath. Carried.
FILE #PB 84-08 DeCARLO SUBDIVISION REPLAT CONTINUED: Recommended for
approval by County Commissioners.
FILE #PB 84-11 MUR RAY HEIGHTS PARTIAL ANNEXATION CONTINUED: Cumin says
this is already platted with sewer and water installed. Motion by Bus
Roberts and seconded by Ed LaPrath to recommend approval. Carried.
PLANNING JURISDICTION: Cumin has letter from Billings planner setting up
meeting to resolve overlapping area in dispute. Smith wants meeting to
go ahead in distrust of a June 1st estop. See letter of May 9, 1984, from
Smith to County Commissioners (copy attached.) See Resolution of Intent
to Create County Planning Board dated May 10, 1984. (copy attached)
MOBILE HOMES, ETC.: Motion from Ed LaPrath, second by Jim Seaton, that
we recommend to Council that mobile homes, etc., be numbered and otherwise
suitably addressed to be legible from street. Carried.
BUDGET 1984-85: Cumin wants $5,000.00 for "Special Studies" to encompass
expanded area of our jurisdiction due to extension of City limits. Motion
from Bus Roberts to recommend approval of the budget to include $5,000.00
Special Studies Item, seconded by Ed LaPrath. Carried.
AIRPORT ZONING: Obstruction ANM-569-OE dated 3/27/84 to Airport Manager,
Laurel, MT. regarding one guyed tower 299 ft. above ground in airport
zoning area. Motion from Jim Seaton to recommend against allowing,
seconded by Hal Dantic. Carried.

The Laurel City-County Planning Board's proposal to adjust the common
Jurisdictional Area boundary was presented to the Billinqs Board at
the meeting on May 1, 1984. After some discussion, a committee of the
Board was appointed to meet with the Laurel Board or its subcommittee
in order to develop a mutually agreeable adjustment.
The committee members are: Arnold Reed, C. Dale Vermillion, Thresa
Goodman and James Higginbotham. The committee is available to meet
with you at a mutually convenient time and place.

Gentlemen:
This letter is in response to the proposal of the City-County Planning Task
Force (as described in the Billings Gazette-see attached) to abolish the.
city-county planning area agreement now in effect between Laurel and Billings.
As representatives of the people in Laurel and this adjacent Laurel planning
area, we do not want our on-going planning program changed. It has worked
well and to the satisfaction of people in our city-county area for many years.
Furthermore, if we are not mistaken, it has worked well for the Board of
County Commissioners.
There is a lot.of development and land use change occurring in the existing •
Laurel City-County Planning Area. This Board has been and is able to admin-
ister this planning-related activity--we feel--very adequately as required
by State law and in good cooperation with the City of Laurel and the Board
of County Commissioners.
We realize planning problems exist elsewhere in the County and around
Billings. However, these are not occurring in our City-County planning
area. Eliminating the County.planning area around Laurel from the juris-
diction of this well established and operating City-County Planning Board
would completely disrupt the growth planning already in process for Laurel
and this dynamic part of the County, destroy the established budgeting pro-
cess, largely invalidate our City-County Comprehensive Plan, and completely
confuse the established process for subdivision and zoning review on-going
in our area.
We hope you will consider our position in dealing with your County plan-
ning problems elsewhere and not eliminate the long standing, responsive,
and smooth working agreement between us.

RESOLUTION OF INTENT
TO CREATE COUNTY PLANNING BOARD
WHEREAS Section 76 -1 -104, Montana Code Annotated allows for the
establishment of a county planning board for the area outside of the
incorporated limits of cities, towns and jurisdictional planning areas,
and
WHEREAS the City- County Task Force on Planning did, on May 1, 1984,
pass a motion requesting the Board of County Commissioners to pass a
resolution of intention to form such County Planning Board and to
provide the affected electors with notice thereof as required by statute,
NOW, THEREFORE, IT IS HEREBY RESOLVED that it is the intent of
the Board of County Commissioners to establish a County Planning Board
for the area in Yellowstone County outside the incorporated limits of
Billings, Broadview and Laurel and outside the 41 mile jurisdictional
areas surrounding Laurel.
IT IS FURTHER RESOLVED that the Clerk and Recorder prepare an
appropriate notice of this Resolution of Intent and of the hearing
date thereon to be published in each newspaper in Yellowstone County
as required by Section 76 -1 -104, M.C.A.

having been held, the Board recommends approval of the proposed
ordinance amending Section 17.32.010, List of Uses, Commercial-
Industrial Districts.

AMENDING SECTION 17.32.010, LIST OF USES, COMMERCIAL-INDUSTRIAL
DISTRICTS
BE IT ORDAINED by the Council of the City of Laurel that Section
17.32.010 of the Laurel Municipal Code is hereby amended to read as follows:
"Accessory Uses" Change to read "Accessory buildings or uses incidental
and customary to a permitted residential use and located on the same parcel
as the permitted residential use."
"Clinic, Animal" Delete from RP District.
In the RP District, change the following "Allowed" uses to "Special
Review" uses:
Child Care Center
Churches and other places of worship including Parish Houses
and Sunday School Building.
Day Care Home
Parking, Public
Parks, Playgrounds Playfields, and Golf Courses, Community
Center Buildings--operated by Public Agency, Neighborhood, or.
Homeowner Associations.
Sign, On premise
Change "Eating and Drinking Establishments: Cocktail Lounge, Restaurants,
Bars, and Taverns" from an "Allowed" use in CBD, CC, HC, and LI Districts
to "Special Review" in , CBD, CC, HC, and LI Districts.
All other ordinances which may be in conflict with this ordinance are
hereby repealed.
This ordinance shall become effective thirty (30) days after final passage.

thus, the use of a portion of a structure as a home occupation will not
permit a subsequent owner an automatic home occupation designation.
Procedure
1. Complete home occupation request form and submit it to the
City seven (7) working days prior to a regularly scheduled
meeting of the Planning Board.
2. The Planning Board will consider the request at their regu-
larly scheduled meeting. Attendance at this meeting is
required by the applicant or his /her representative.
3. The Planning Board will make a recommendation to the City 1
Council that the specific request for a home occupation
designation be granted or denied.
4. The City Council will consider the Planning Board's recom-
mendation concerning the specific home occupation designation
and approve or deny it at their next regularly scheduled
meeting. Attendance by the applicant or his /her represent-
ative is required at this meeting.
