LAUREL-YELLOWSTONE CITY-COUNTY PLANNING BOARD LAUREL. MONTANA 69014 November 14, 1985 Meeting of the Laurel-Yellowstone City-County Planning Board called to order with the following members present: Dr. John Hawley Smith, President, City Rep. R. M. Williams, Vice President, County Rep. Gerald.Shay, Member-at-large, Executive Secretary Marvin Carter, City Rep. Grace Edwards, County Rep. Joe Bradley, City Rep. Bus Roberts, City Rep. Bills approved: Public Works Department in the amount of $400 for administrative services--October, November, 1985; postage and advertising for Pizza Hut and Figgins plat. HOME OCCUPATIONS: Ted J. Mason, 2618 Topeka, requests a home occupation of office for wholesale imports. Mr. Mason was not present so Board could not make a recommendation. Kim A. Kautzman, 814 5th Avenue, requests a home occupation of prefabricating closet inserts using garage space for cutting and storage of supplies. Operates by phone calls. Would have saws, etc., running during the day. Will use most of the garage. Motion from Joe Bradley to recommend denial, seconded by Bus Roberts. Motion carried 6 for, 2 against, 1 abstention. PUBLIC HEARING PB#85-08 LAKEVIEW SUBDIVISION TO BE KNOWN AS SETTING SUN SUBDIVISION (GEORGE FIGGINS): Application for preliminary approval of Lakeview Subdivision to be known as Setting Sun Subdivision located in Tract 3A(1) of Amended Westbrook's Subdivision located in the NEk, Section 17, T1S, R24E, PMM, Yellowstone County, at the SW quadrant of U.S. No. 10 and West Interchange Access Road to I-90 Intersection. LeRoy Zuck presented the concept of this subdivision. Lots will be for sale; 3 commercial lots. Traffic study indicates this subdivision will not create a traffic problem. Mr. Figgins says he will finance by private funds if the package is approved; will post bond to insure. Mrs. Hutsell speaks for the subdivision and expresses the need for mobile home parks. Mary Thompson lives west of Figgins and is against the subdivision; wonders about water line and irrigation ditch placement. Tom Thompson questions irrigation ditch. Mrs. Schwab speaks against because of traffic. Mrs. Van Buren wants to keep neighborhood quiet; questions property values; worries about traffic. Cumin Associates recommends approval subject to conditions: • 1) that, as per the utility companies' request, 8 ft. easements be provided around Lot 1, Block 1; the east side of Lot 2, Block 1; around the entire perimeter of the project; and that a 16 ft. easement be provided north and wouth through the center of Block 2 and extending west from the north side of Block 2 to the property boundary (as per the map provided the City Engineer.) 2) That in the Declaration of Covenants the following changes be made: a) pg 2: the references to Carbon County be corrected. b) pg 2, item 4: the City of Laurel be included as a party to the agreement to the extent of requiring the City's approval before changes can be made in the approved covenants. c) pg3, item 7: correct the spelling of the word "tree" and specify that such landscaping must be done within nine months of the owner moving onto the lot. d) pg 4, item 21: correct the word "address." e) pg 5: provide for approval by the City of Laurel. 3) That in the Subdivision Improvements Agreement the following changes be made: . a) pg 1: in addition to approving the annexation, the agreement should also reflect the approving of the plat. b) pg 2, item 3: sewer line needs to be 10 inch. • c) pg 3, item 5: as with all improvements, the design of the disposal pit will have to meet the standards of the City Engineer. d) pg 3, item 6: the streets must also be sealed one year after construction (paving). -2- e) pg 3: paragraph 8 should be a complete description of the cost of improvements and how the developer is going to guarantee such improvements at no cost to the City. Mr. Figgins indicated that a performance bond was going to be used; as per the City's Subdivision Regulations, such bond must be in the amount of 125% of the cost of the improvements. This bond must be in effect prior to the approval of the final plat by the City. 4) That the proposed park area be reduced by 12,000 sq. ft. (two additional lots for Mr. Figgins) but that water and sewer be stubbed into the park, a paved parking area for 25 parking spaces for automobiles be provided, grass seeding and underground sprinkling be provided, and the. access requested by the State Fish & Game Department; these improvements also need to be included in the.Subdivision Improvements Agreement. 5) That the final. plat not be approved until the State Highway Department has approved the accesses as proposed in writing. 6) That the 10 inch water main to the site be located on the.. north side of Highway No. 10 and that the 10 inch sewer main be located on the south side of Highway No. 10. 7) That Waivers of Protest to Annexation be received from .all adjacent residents and property owners to the water and sewer main to be located in Highway No. 10 right-of-way prior to approval of the final plat or the extension of the water and and sewer mains. 8) That the water main be looped from the proposed development back into the City system. 9) That the location of any water main on John Johnson's property will be in future public right-of-way which aligns with existing or proposed City streets and alleys. Any public main must be in public right-of-way. 10) That the irrigation ditch located along the north property line be placed in a culvert and that this also be part of the Subdivision Improvements Agreement. 11) That as part of the Subdivision Improvements Agreement, a landscape buffer be placed along the west side of the subdivision. 12) That the large tract of land between Lot 1, Block 1 and Lot 1, Block 3 be included in the subdivision area. 13) That street names be provided all east/west streets. 14) That, except for the east access street, a 1 ft. non-access strip be platted along the entire east side of the subdivi- sion from Highway No. 10 south to the southeast corner of Lot 8, Block 3. 15) That all planned and needed improvements such as water, sewer, paving, curb and gutter, traffic signs, culverts, off-street parking, street lights, fire hydrants be included in the Subdivision Improvements Agreement as well as the cost of engineering and construction of same and the timetable of construction. 16) EIS waived for this subdivision. Motion b Grace Edwards to recommend approval subject to conditions, seconded by Marvin Carter. Motion carried unanimously. -3- PUBLIC HEARING PB#85-07 PIZZA HUT RESTAURANT SPECIAL REVIEW: A special review has been requested on Lots 6, 7, 8 and 9, Block 4, of Hageman Subdivision, and Lot 19, Block 4, of Hageman Subdivision, 3rd Filing, Highway Commercial Zone, to allow beer and wind sales at the Pizza Hut Restaurant. The property is located at 119 4th Street SE, Laurel, MT. P. Bruce Harper represents. Discussion. Motion b Gerald Shay to recommend approval, seconded by Don Gudgell. Motion carried unanimously. APPLICATION TO VACATE STREET AND BOTH ALLEYS ST. ANTHONY'S CATHOLIC CHURCH: Joe Bradley removed himself from Board in order to present this application to vacate the unimproved portion of West 8th Street extending from 3rd Avenue to 4th Avenue and lying between Blocks 1 and 2 of Fourth Avenue Sub- division. The street has never been opened. Vacating is requested for the street and both alleys. Motion b Marvin Carter to recommend approval, seconded by Grace Edwards. Motion carried 8 for, 1 against.
