Meeting of the Laurel-Yellowstone City-County Planning Board called

Minutes of previous meeting amended to show Little Scottie Mobile
Home Park approved subject to review of final landscape plan by
Cal. Minutes of previous meeting approved as corrected. Bills
approved: Public Works Department in the amount of $400.00 for
administrative services---February and March, 1986; Cumin Associates
for Planning Advisory services for January, February, and March,
1986, as per agreement in the amount of $3,375.00.
HOME OCCUPATIONS:

present for the second time. If he wants to pursue a home occupa-
tion, he must re-apply.

OXYGEN PLANT:
Barbara Smith, 928 W. 4th Street, ... and we object to this. They
started to make acytelene back in 1980. They built these large
pits and approximately 6 mos ago they built another one. It's close
to our fence line. It is coming across under the ground like and
killing off the grass over there. It's always wet when you walk
there, and it is a bad smell in the neighborhood. We object to this,
and we would like to find out what can be done about it.
Robert Smith, 928 W. 4th Street, I would like to speak in terms of
credibility. This plant originally, when they were first under the
grandfather clause, said the cylinders contain oxygen and nitrogen
and that was about it. There are green barrells scattered all over
the place. At the time they spoke to the County Commissioners they
mentioned the fact that it would be a beautiful industrial site and
that there would be pine trees all around'it. All there is around
it is a mess. The issue, I understand, is the fact that they are
talking about fire protection when in fact there is no more room for
them to put off displaced water. There are 2 pits. There is one
down there on Schwab's place. I don't think that's used any more.
That one pit was dug deep enough you could have buried my house.
That is now full of water. It is my guess that in these green
barrells there is calcium carbide, a high desiccant to make acytelene
with the addition of water. The by--product is calcium hydroxide
which is in fact a very caustic substance. In fact if this plant
were to go into the City, I am sure the next step would be sewerage.
That is a very caustic substance. Right now this is becoming ground
water that has a greenish scum on the top and has an odor, as Mrs.
Smith mentioned. No one in the neighborhood wanted that plant since
it has been there. It is expanding bit by bit.
What are your credentials? About this caustic material, etc.?
You're a chemist, is that correct?

Roger Bare No. No. They are just holes in the ground. I can see
that much. There is no lining in them, no cement, no plastic. They
are just holes in the ground with dikes around them. That's all I
can tell you.

Robert Smith The acytelene was not part of the original squeezing
} air out of the atmosphere.
• Clyde Bray, 1201 W. 4th Street, I don't know whether you fellas know
it or not, but that whole area out there is full of underground
springs. Every time you permit buildings (school house or anything
else) it pushes that water further west. The developers have got
the whole thing out there completely soaked. There's no way to get
it out. I'm asking you fellas to stop everything until the govern-
ment, County, City or State, gets that water out of there before you
build any more. If you don't think so, I would like to have each
and every one of you at my.place at any given time -- bring your
boots, not your car -- I'd like to take you over there and show you
just exactly what's going on.

Barbara Smith I might mention that there were other people planning
to attend. One of them is sick. There was an original petition in
protest written and given to the City in 1973. Then when they requested
the zone change in 1977, twice we handed in petitions. I believe one
had 67 signatures and the other had approximately the same amount of
signatures.
Is there anyone here to speak for the.plant?
Ra Zelka 4432 Vaughn Lane, Billings, I'll say what I can. I didn't
have enough time to get a man flown in to answer these questions for
these people. We have our own people out of Phoenix. I could get a
meeting together at their convenience.wherever they want to meet.
• These people will fly in to visit them about the problems that are
here. First off the pits are unlined. Every acytelene plant that
they have uses unlined pits due to the fact that a lime sediment
seals off the pit. That's why the water won't go away. We rely.on
evaporation to get rid of it. What has happened is we have had a
lot of snow and everything filled our pit. Two months ago we found
out that the water was well below grade and you could see the lime
coating underneath the socalled water. We call it decanted water.
Our intent is to use it back into the acytelene system, which we
haven't been able to do. Not for this time. But that's still not
going to drain the pits as they say. It would be impossible to drain
them. Our intention, as I expressed before, would be with Gilmore
Lime Co. out of Salt Lake City. They are planning on putting in
underground storage tanks and pump the slurry out. By-products of
this lime has to be in slurry form before they can pump it. So if
they drain it they are going to have to fill it again to slurry it
anyway to take it out. It's done in Billings the same way. Now
then, as far as the addition to the building, we got approval to
put the dock in. The only reason we covered it is because of the
last snow storm. It put us behind on delivering gasses to refineries.
People who need it couldn't even get the cylinders off the dock.
It's only a cover. There is no reason we would ever cover the sides
of it at all. The square footage of that plant is the same as when
we built it. It has not been changed. Internally what we have been
doing is taking out partitions to make more floor space available to
put in more animated equipment so that we won't have to have these
• men doing this back breaking work. We used to do the palleting by
hand. We now have machines to do that. We don't have to tip cylinders
by hand. We have a machine to do this. We had to make room inside.
With the limitation of the building we had to use the space we had
by moving the walls back and whatever we had between the two plants
to make enough floor space. There is an odor from it -- no use in
denying that. There have never been objections though. It's not
nearly as bad as other odors we have in the area. I'm around it so
much I don't even notice it. So what can I say? What bothers him
might not bother others. I can't tell -- I've been around it too
many years, I guess. Are there any more questions?
You're the manager?
Ray Zelka Yes.
Are those pits fenced?
Ray Zelka They were until we had - we took out 140 yds of by-product
last year and sold it to the sugar refinery down in Lovell. So at
that time one side of my fence was torn down and then dumped the lime
in the pit. Now I have a bid in with Valley Builders to go clear over
to the property line down clear around. We have had a couple of
breakins and this might stop some of our breakins. And also, if the
looks didn't bother people, we could put slats in this fence which
will be a chain link fence. The barrells that blow around I can't
help. They have already been damaged. My boys stack those once a
week. The wind blows them around. They are very light -- 11 lbs.
and holds 45 gals. I tried to give them away to the sanitation
departments for putting garbage in. Nobody wants to take them for
free so when we get a bunch built up I get a man to come over. He
crushes them at night, hauls them away and sells them for scrap in
order to make up for the labor it takes to crush them. That's the
way we have been getting rid of them. Our intentions of expanding
the building "no"; expanding the business "yes." We can not exist
without business. The building will not be expanded. I mentioned
that to the couple who came over at the time I was building the roof.
All that roof is for is for rain and snow protection and in the
summertime to keep the hot sun off the cylinders. The gas does
expand and wherever we lose safety we lose the product. So that's
the process from the outside. That pad was there originally and we
got permission from the Council to raise that pad 4 ft. That was
done at the time we first started out when all our trucks were
pickups and 1 Tons. Now we've got people coming in with semis and
they use all kinds of heists to load and unload.
Ray, how long have you been the manager?
RayZelka 5 yrs.
Is that when the plant opened?
Ray Zelka No, that's when Liquid Air purchased the property.
How long ago was it that you came to the Council for approval?
Ra Zelka That would have been approximately 3 yrs ago.
You're talking about the loading dock?
_RayZelka Yes, the pad was there before and we got permission to
bring that up.
Did you come before this board?
Ray_Zelka No, I think it was a different basis then. It was in
this room anyway, but different people.
When were the pits first dug?
Ray Zelka The time they were put in was around 69, 70 somewhere in
there.
Barbara Smith The plant was there in 1980. I took pictures of it.
No, I didn't bring them with me, but I took pictures.
Ray Zelka We'll have to find out because it was before I came.
What about the pits that are a block away?
Ray Zelka They were dug when this was an acytelene plant and it
was done shortly after that. The oxygen stand tank was put in.
We never did compress any air. We just brought it in in cylinders.
Can you give me a year? When was the acytelene plant started?
Ray Zelka I'd have to ask somebody.
Was that before your time?
Ray Zelka I was in the office at H & R Oxygen at the time. I
don't remember what they were doing here.

Ray Zelka That was all theirs. We dug one pit after that about
2 yrs ago.
What is this? Is it a by-product?
Ray Zelka Calcium carbide, water and acytelene gas.
Acytelene gas is manufactured, added after the original oxygen
plant? How much property is the plant sitting on?
Ray Zelka The acreage amount to C/S 1330 and C/S 477. This
• section here goes all the way from W. 4th Street to Old Highway
#10. It narrows after it gets down here about 3blocks.

Does that include yourself?
Ray Zelka Yes.
Barbara Smith May I ask if there's anyone there at night, because
I hear all this hissing and stuff like it's going to blow up. I
was concerned if there was anyone there that could adjust whatever
needs adjusting.
Ray Zelka This liquid is a criogenic that actually boils to keep
itself cool. As it boils it builds up pressure and these release
valves maintain it at a certain temperature. The bulkheads some-
times get a little loud. The safety valve - - - -
Barbara Smith The people in the neighborhood feel like they are
sitting on a keg of dynamite that's ready to explode.
Ray Zelka Not unless you can mix hytrogen, oxygen and CO2 together.
Barbara Smith All I know is that acytelene is very explosive.
Ray Zelka That's in a cabinet cylinder.
Ray, what are your long-range plans out there?
Ray_Zelka_ Well, what we're hoping for is to have the lime company
come in, take care of the pits, level those, and haul that out. It
looks like starting about duly. A company over in Billings is
shutting down and moving out and has the lime company available to
us. We should be able to supply 5000 gals of that a day to them and
of far as in the plant - - -
These pits will be taken care of by a lime company out of Billings?
Ray Zelka No, no. They come out of Salt Lake City -- Gilmore Lime.
But you're saying that the pits will be removed possibly in the
spring?
Ray Zelka No. It will probably be the end of the year. There's
a lot of pumping to do. One pit there, the one we're talking about
today, is about 12 ft deep on the north end and 8 ft deep on the
south end.
But your long-range plan is to remove these pits?
Ray Zelka Yes. We'll be.doing that in all our plants.
So they will be gone by the end of 1986?
Ray Zelka We're striving towards that. It all depends on how much
Gilmore can do.for us and how much he can sell to the people in the
popular areas so he doesn't have to travel so far. We have to take
that out of the pit, pile it outside, then he hauls it -- they don't
want to take it to the slurry like Exxon does. It may have to dry a
little bit so we can haul it down the highway. The highway is the
slurry, so it-has to dry a little bit. That's what that pile is
south of the one site east right now. That's to be removed by
Gilmore's next trip. Then, of course, we'll have to take some more
out of the pit and put it there.
Is that where the odor comes from, Ray?
Ray Zelka Yes, .it's the water. It's kind of a stagnant water and
a smell to it. I don't find it objectionable but there is an odor
there.
Weren't you in to talk about annexation a while back?
Ray Zelka Yes. That is pending right at the moment. It is currently
with the department in San Francisco. I called the girl last Monday
and the paper work is supposed to be completed. What we want to do
is try to get City water down there. I don'.t care whether there
will be sewer or not.
Would you continue to expand on your long-range plans. What other
plans do you have out there, Ray?
Ray Zelka Well, completely closing in the area with non flammable
fence of some nature. The one end exit/entrance will be towards
the south.
How does water work on a chemical fire like that?
Ray Zelka It would work in there due to the fact that all there
would be in there would be machinery and cylinders. There is no
exposed calcium carbide in that room.
But, if one of those cylinders exploded, water is not going to do 0
anything to it, is it?
Ray Zelka No, it would be like a propane tank or anything else.
It would have to burn its way out. But the cylinder, even though
there is no gas in it, it is full of a porous filler. Gas can
a
only be released out of that cylinder at very small flowings at
a time. It's like a sponge -- it absorbs. You can't keep acytelene
over 15 lbs per sq. in. in the vessel. If you buy a cylinder that
says 250 lbs at the valve you know there has got to be some way to
get that, and they do that by adding more cells and that's done
through accumulation of cells. You can actually throw an acytelene
cylinder in a fire, which has been done on several fires they've
had in Billings, and all it does is torch a fire. We have never
had one explode yet. I've got them over there burnt to a crisp.
We take them all to the insurance companies. They are really safe.
The industry is shipping these cylinders every place. They are
putting them in private homes, in hospitals, industrial sites,
ships, airplanes, everything. They've got to be safe. That's
what this equipment we are putting in is for. We check it every
5 yrs. High pressure is to be checked, low pressure every????
What about the hydrogen? Is it the same kind of cylinder setup?
Ray Zelka Yes. That's a high pressure cylinder. We tell our
filler to take special precautions filling them. As a matter of
fact, when they have that in liquid form they usually fill with a
towel all around it until the cylinder is full. It blankets the
gas.
Is the hydrogen cylinder made the same way as the acytelene is?
Ray Zelka No. It's a hollow vessel cylinder. It has a safety
release on it. A filling to approximately 200 lbs will release
at 3360 psi. They have a safety release on the cylinders. We
have yet to have a safety release on high on these cylinders.
What would happen if they were in a fire?
Ray Zelka The cylinder would not explode. Pure gas will not
explode. Compare it to a propane tank. Poke a hole in it, light
it. It will not explode until it is out of gas.
If those hydrogen cylinders were sitting in a very hot fierce fire
would they explode?
Ray Zelka No. Safety release and the gas would burn off. The
safety added is a multiple cord around which expells the gas in all
directions to keep the cylinder from travelling, and it is just like
a torch. What usually happens it just burns off the safety.
Do you feel that you can keep your plant profitable without
expanding the plant itself over the years to come?
Ray Zelka No. There will be a day when we're going to get out of
there. At the moment it is unprofitable for us to move. We were
going to move this last year. We talked to the Planning Board last
year on some property over here in the industrial site. My people
took it back to the home office, analyzed everything and they feel
right at the moment that they could just not coordinate the move.
As business picks up and we get a little competition in the area,
we could end up being sold. It's a survivor the way it looks.
Before too long we hope to build a fast-fill plant which would
take up twice the room we've got over there and would need an
easier locale to get to anyway. They have discussed that.
What is the name of your plant?

That's headquartered where in this country?
Ray Zelka We have our headquarters in California.
How many of these plants do you have operating here in the U.S.?
Ray Zelka About 800 plants. We're one of the smallest.
Have you ever undergone fire inspection out there?
Ray Zelka We get them by our insurance company, our safety engineers
every 3 mos.
The City of Laurel at all?
Ray Zelka I've asked them to come over, but they haven't come over yet.
So there are in-house inspections by your company.every 3 mos plus the
insurance company periodically?
Ray Zelka Once a year.
So you have in-house inspections every 3 mos; and insurance company
inspections once.a year.
Do you know what your policy limits are?
Ray Zelka Self insured $50,000,000.00

Cal Cumin would like aerial photos of Laurel area cost estimate at
next meeting.
1986--87 BUDGET:
Motion from Bus Roberts, second by Joe Bradley, to submit proposed
budget as is. Carried.
Bus Roberts asked about a sign ordinance.
Cal Cumin distributed letters regarding jurisdictional area. Also
presented a proposal to change the Home Occupation ordinance. This
will be discussed at the next Planning Board meeting also.

Dear Mr. Brown:
In reference to our telephone conversation Wednesday,
March 5, 1986, the City of Laurel has issued a building permit,
following a request from the Airport Authority, for the con-
struction of a hangar at the Laurel Airport. This permit
relates to your project number of C-86-13.
The Airport Authority made a formal request to the City
Council to enforce the building codes on the airport property
and, appropriately or not, the request was granted.
The City of Laurel will be requesting State approval
to enlarge the jurisdictional area for enforcement of the
building codes, which will encompass the airport area.
At your convenience, please send me a copy of the neces-
sary requirements and stipulations for the purpose of enlarging
our jurisdictional area.

Commissioners.
The notice of intent prepared by attorney Joe Bradley is
acceptable as to form.
If it has not already been done, there will need to be a
certification that the signatures on the petition constitute 5%
or more of the resident freeholders in the area proposed for
inclusion in the jurisdictional area of the planning board.

Dear Mr. Hanser:
In April 1985, the Laurel - Yellowstone City- County Planning Board submitted
a petition to the County Commissioners to change the jurisdictional bound-
aries of the Laurel Board; this new boundary was determined after much
discussion with the Billings - Yellowstone City - County Planning Board and
was the boundary mutually agreed upon (see attached letters from the County
Planning Director).
I believe the Commissioners then turned the petition over to the County
Clerk and Recorder who in turn submitted it to your office for evaluation.
After that, nothing has been heard.
The Laurel City Attorney has prepared the documentation for the desired
hearing on the boundary change, including the detailed geographic descrip-
tion of the area involved. Accordingly, I do not believe there is any new
work that has to be done other than for your office to just review the
existing documents.
I would like to point out that the petition submitted constituted at least
fifty percent of the resident freeholders of the area in question and not
just the five percent as required by 76-1-505, RCM. Laurel at least deserves
the courtesy of some sort of reply from the County.
If you would shed some light on why the initial petition' is being held up,
it would be greatly appreciated.

PROPOSED ADDITION TO "HOME OCCUPATION SECTION" OF THE ZONING ORDINANCE (3/13/86)
B. Home occupation:
(1) Home occupation is permitted in a dwelling customarily
incidental to the principal use as a dwelling subject
to the following limitations:
a. No person other than .a member of the immediate family
occupying a dwelling -is.emp'oyed, except domestic
help.
b. No stock in trade is displayed or sold upon the
premises.
c. No alteration of the principal building changes the
character thereof as a dwelling.
d. No illuminated sign is used, and no sign other than
one giving the name and occupation, and not more
than one square foot in area, is displayed.
e. No more than 25 percent of the area of one story
7 of the building is devoted to the home occupation.
f. No equipment shall be used in such a home occupation
which creates noise, vibration, glare, fumes, odors,

or electrical interference, no equipment or process
shall be used which creates visual or audible inter-
ference in any radio or television receivers off
the premises.
g. The home occupation shall be deemed to be both site
specific and owner specific; thus, the use of a por-
tion of a structure as a home occupation will not
permit a subsequent owner an automatic home occupa-
(2) The following activities are prohibited from home occupation
under this section:
a. Motor and motorized vehicle or boat repair of any kind
to include body and engine work, upholstery and glass
repair, and audio system work.

b. Prefabrication of building construction components such
p as, but not limited to, cabinets and heating and cooling
systems.
c. Furniture and appliance sales, repair, or renovation.
d. Manufacturing of any food products for barter or sale.
e. Generally all those uses specifically and already allowed
and provided for in Laurel's CoMmercial and Industrial
Zoning Districts as delineated in Section 17.32 of this
Ordinance.

Procedure
1. Complete home occupation request form and submit it to the
City seven (7) working days prior to a regularly scheduled
meeting of the Planning Board.

• 2. The Planning Board will consider the request at their regu-
larly scheduled meeting. Attendance at this meeting is
required by the applicant or his /her representative.
3. The Planning Board will make a recommendation to the City
Council that the specific request for a home occupation
designation be granted or denied.
4. The City Council will consider the Planning Board's recom-
mendation concerning the specific home occupation designation
and approve or deny it at their next regularly scheduled
meeting. Attendance by the applicant or his /her represent-
ative is required at this meeting.
