Proposed Ordinance Chancre: Motion from Joe Bradley to recommend the
change to Council, second by Grace Edwards. George Reiter is concerned
that we are prohibiting business in Laurel. Motion carried unanimously.

LIQUID AIR CORPORATION FORMERLY H_ & R OXYGEN:
Ra Zelka At the last meeting I requrested that we have one of
my people come in and answer some of the questions that I was
unable to answer at the last meeting. At this time I do have my
supervisor here, Mr. Steven Pebler from California. He'd like
to answer any questions you might have. I'd like to have him come
up at this time.
Cal Cumin The questions we had at our last meeting were: There
are people in the neighborhood who feel the plant has been expanded
over the years primarily focusing on the lagoons. There is some
opinion that the holding ponds, or lagoons, or whatever you call
them, are raising the water table around there and poisoning the
grass in adjacent yards. There is some concern with the fact that
your liquid air plant is an accident waiting for a place to happen--
very volatile fuels. These are the concerns we would like to be
addressed by your expert.
Steve Pebler I'm Air Production Manager for Liquid Air Corpora-
tion in charge of all the fill plants from Colorado west. As far
as the expanding of the operation, our business has increased
slightly in the high pressure acytelene areas. The ponds are
getting full. We eliminated some of.it in the last year. Right
now, there is currently two companies in this area that are pro-
ducing that lime or having that lime as an extracting operation.
The other one is in Billings. It's the Linde plant. I don't
know what you call the area, but maybe some of you are aware of
it, that plant is being shut down in July of this year. At that
point they currently have a person who is taking the lime off their
hands. There is a lot of good uses for it, and it doesn't kill
grass. To the contrary the biggest way we get rid of it is to
sell it to farmers to till into their fields to balance acid rain.
It promotes growth rapidly, so at that point we will be getting
rid of the ponds we've got and go to settling tanks -- whether
they are above ground or below ground is up to the City to tell
us. It'll take a period once he starts pulling lime out of our
operation to get rid of the standing ponds we've got. When we
do finally get rid of the ponds, then we'll go to tanks. The slurry
will be stored in tanks and we'll haul it out (undistinguishable)
so that it just won't be exposed.
You're referring to somebody else?
Steve Pebler Basically you have a subcontractor come in. He will
buy, or take, or whatever sort of a deal that we set up with him.
He is a go-between. He will find a place to sell it. That's his
business. It's a private business not affiliated with Liquid Air
but he pulls out of 8 of my operations.
When is he going to be coming up here?

Steve Pebler Well, July is when Linde will shut down. They will
produce no more lime at that point. He's already contacted us
to take (undistinguishable) which is fine. You know we would like
to get rid of the ponds just as much as you do just for the fact
that it is an eyesore and that's valuable land sitting there.
How long will it take to get rid of the lime you've got?

Steve Pebler That's a good question. At times he takes big loads
depending on the requirements around. Steadily, he'll take a little
more than we're producing. At the point when he catches up to us
he's probably going to have to go elsewhere to find extra ponds
to get rid of.
Ray had indicated last meeting that by the end of this year those
ponds would be gone.
Steve Pebler I can't say at the end of this year. I would say
that by the end of this year there will be a definite dent -- whether
they will be completely gone I can't say. You'd probably know the
uses in this area more than I would. I know they've got what is a
paper back or something that you get on a one shot deal that takes
a tremendous amount. Sugar refineries use it and . . .
Ray Zelka There's Exxon Refinery and Cenex over here. That's
where we give our supply of lime to out of Billings' operation.
Steve Pebler But they use it in glass factories, water purification,
like I say the farmlands till it into the ground. These are just
some of the uses. The guy that sells it knows all the uses. That's
not my business.
For the purpose of these minutes then so that we can report to the
City Council, would it be fair to say that you will be phasing these
out over the next 12 months?
Steve Pebler Yes, because we are just as interested in getting rid
of them. That is the way the operations all went. Those ponds are
the biggest headache I've got. There is no hazard involved as far
as the product, and I've brought the material they'd be handling
if you'd like to see (cough, cough, undistinguishable)
What about the neighbor's complaints that the ponds are leaking?
Are they self-sealing, Ray?
Ray Zelka Yeah, they are self-sealing. They will not leak down.
Are you talking about going over the dikes or something?
Over the dikes.
Ray Zelka I don't know. I was out there today. It's got a long
ways to go before they get over the dikes.
But they did prior to today?
Ray Zelka We've never run lime over.
Not the lime, but the liquid was running over?
Ray Zelka It would have to have been several years ago that it
happened. It hasn't happened since I have been manager. we've
had water come up pretty close but we've never had it overflow.
The top of the dike right now is bladed off where they were
getting in with the drag line to haul the lime out for the last
shipment to Great Western. That was done last fall and there's
no water mark across the top of that dike today, so nothing could
have got across it. It would surely have made a mark across it.
• Mr. Pebler, what is your position with the company?
Steve Pebler I am the Regional Production Manager.

So your primary focus is on production?
Steve Pebler The operation also. •
Grace Edwards I would like to address the complaints on the
regulations.
Steve Pebler Regulated by the Pressed Gas Association, but that's
more on a committee/suggestion type function. Other regulations,
we are regulated just like any other industry is.
I will tell you this. I've got a pond that is 20 times the size
of this one in Los Angeles. They haven't asked us to get rid of
it. We are working to get rid of it but they are not concerned.
It is an eyesore (undistinguishable)
The odor is the worst right after generation. OK. If you stood
in that first collecting tank where it dumps into and when it is
still hot, the odor is strong. The odor -- really, I don't think
you detect the odor on the pond itself. When it's being manufac-
tured you'll get some odor out of that.
Can you tell us when the ponds were first installed?
Steve Pebler In early 79, because that's when our plant was put
in.
What about the safety precautions? Some of the neighbors were
afraid the thing would blow up their house. What is the risk of
any explosion or is there any?
Steve Pebler Well, obviously, we are producing acytelene out
there which is flammable; but Liquid Air is owned by Air Lockheed(sp?
the largest industrial gas manufacturer in the world. They are
bigger than Union Carbide. Our safety department is huge. Our
safety precautions are unbelievable. Ray goes through safety
inspections (unintelligible) Whenever I come in, I do safety
inspections on my tours through; but we have a safety department
and safety officials that do yearly/bi-yearly inspections on
this location.
I think Grace is asking who regulates you. Maybe what she meant
is does any government agency do any safety inspections?
Steve Pebler Oh, we have government agencies. We produce medical
gas, so we have to have FDA do a lot, weights and measures, OSHA...
Has there ever been any kind of accident out there?
Steve Pebler No,sir.
If you had asked me 20 years ago if I thought there was a safety
hazard, I probably would have told you ",yes" because this country
is way behind on industrial gases in that they got into it
before they really knew what they were doing. The last 10
years -- just the improvement -- has been fantastic. I'd be
more than glad to walk anybody through the operation.
Steve, do you have a time frame on closing that plant totally?
Steve Pebler No. If business got to be such that we outgrew that
location, we probably would have a time frame but there is a
limited amount of business in this area. That plant has been there
for I don't know how long, and we haven't outgrown it. We have
increased some but very little. The lime is an accumulation through
the years.
Regarding the expansion of the plant facility itself, there
• hasn't been any construction except for the protective covering
over the dock?
Steve Pebler Yea, and moving of some partitions inside of the
building.
Have you actually added a room on?
Steve Pebler No.
We covered that to keep the snow off because it was a safety
hazard.
There is a lot of talk by the neighbors. There must be some water
that is seeping out of there ruining their grass and other green
property that they have around their homes.
Ra Zelka I haven't seen any evidence of that at all, sir. As
a matter of fact the fellow that has the property directly north
of us puts that in grass every year, just to feed his cattle. It
is by far the greenest of anything around there. If the other
people would fertilize a little bit too and work their ground,
they would have nice green grass too. The dike is about 12--14
feet at the bottom and that comes up to about 9 feet on top, and
there is no way it can get through there. I have walked around
there and checked it, even before the last meeting we had here,
and I couldn't find anything. There is some water in front but
that's well water. When we test cylinders the water has to go
somewhere when we dump it out. That's just plain well water.
• That's the only water I ever found.
Bob Rosselot The reason I brought up the question is there were
some of the people that talked about it. Now I farm out here and
I didn't get to that place to see, but I'd like to have somebody
that's here that knows to go over there to look to see if there
is validity to that.
Bus Roberts I never checked the houses, Bob. I was there this
afternoon but I couldn't see that there was any seepage around
there where anything looked dead around there at all.
Bob Rosselot You have a much bigger problem controlling the growth
in that area than you'll ever have in the County, I guarantee it.
I have to have our area sprayed regularly just to try to control
the (???) because it promotes the growth so rapidly. I use the
stuff in my garden and you guys are welcome to use it too. I
guaranty you will get the biggest vegetables you ever saw.
Bob, it's the alkali that is seeping up north of town and you can
see it laying around.
Steve Pebler No, it's not alkali -- it's a lime, a different
chemical. Alkali will of course . . . .
It's that basic whitish stuff.
(??) Real strong, yes.
• Steve Pebler This is different.
It has a basic property but it doesn't have that salty `- there's
no salt to it. As a matter of fact the water on top of that is
really soft, very soft. It is very similar to a gypsum material.
Is the person who said the grass was ruined here tonight?
That's my next door neighbor, Bob Smith, and they had a tragedy
in their family and isn't here tonight. They would like a copy
of the transcript ofthese minutes if they can.
Cal and I went out about two weeks ago. We walked around the
fence line and couldn't see where anything.was dying. It was in
the minutes, but I sure couldn't see anything.
I was out there last week and it was swamp to the west (unintelligible)

Ray Zelka It was melt off from that heavy snow we had, sir.
(undistinguishable) because I had it in the front yard also.
We walked around - the only place wet was by the dikes (undistinguishable]
swampy all around the north side of the fence - -- - -
Ray Z_elka The water all runs that way. That's the way the ground
runs (unintelligible) the ground is swampy back there, plus the
smell (undistinguishable)
Steve Pebler Oh, there is a sulphur-type smell to it.
Krug was there (unintelligible)
They have taken lots of pictures before and after that (unintelligible),
genuine concern. He felt that the property is losing value (undistinguish
Steve Pebler I can't speak for the water grades. That may be
something that can be remedied. I don't know anything about that,
but it's not coming from the ponds (unintelligible)
Those ponds, when you dig down you get down to a pile of crust.
It's about as hard as concrete. You literally have to chip it
out. It takes quite a dozer to get through (undistinguishable)
Well, I mean that stuff forms a crust. When it dries its (???)
Is there anything that might get over the top of the dike, could
it be just water?
Steve Pebler Yes (undistinguishable)
Bus Roberts It didn't show any--this afternoon it didn't show
anywhere that the water had run over (unintelligible) It was
probably, off hand, I'd say probably 4 or 5 feet below the top
of the dike.
At the time of the last meeting though I think their major concern
was the pit itself on the dike was higher than the spot where
the ground was seeping out. (unintelligible) That was their major
concern. When you get above the dike the ground level increases.
You mean the water was actually above that dike at one time?
No, the dike was there (unintelligible)
You say you are going to replace the pits with tanks. Are you
going to wait until the pits are empty before installing the tanks
or vice versa?
Steve Pebler Well, it

the application. If he needs it in a slurry
form like it comes out; or if he needs that
that first and get rid of that first, and
in right away. I don't know.
So the whole thing will hinge on when Linde closes down as to
what's (unintelligible)
Steve Pebler Well, Linde has already named the date for closing
down. Basically what it's going to hinge on is his business.
We know that he's got contracted business that will take more
than we are producing at this point. So we are going to gain on
it no matter what. And then everything he grabs in addition to
that will just take more pumping down. Ray, also, since the last
meeting, has installed . . . . We're re-circulating that water
not putting it out of that pit. That water is crystal blue before
it comes out. We're going to start re-using that water so that
will help keep that water level down. Summertime it's not a
problem.
(undistinguishable) But they also said you pull semi trucks in
there and you use that almost like a building . . barrells on
the trucks and they just sit there so that actually it's just
like a little building (undistinguishable) I'd like to hear a
response to that. Why are them semis and van type vehicles
sitting there?
Ray Zelka There's one van for carbide storage. Carbide you
can't store outside or anywhere it is going to contact moisture.
If it contacts moisture it gives off acytelene gas. Obviously
we can't have that. I don't know when it was put in -- a long
time before I came.
Steve Pebler It was about the time the acytelene was started up,
around 79 somewhere in there.
The only other trucks that are in there are trucks to take deliveries
(undistinguisable)
This has been going on since 79 you say?
Steve Pebler At least 79 as I recall.
Do you plan to reclaim your pits?
Steve Pebler To reclaim them? I don't understand what you . . . .
You know, it's a sort of filling it in, etc.
Steve Pebler Yeah, if we eliminate that lime we'd like to level
it off too, because that's good property. There's no reason to
leave those pits out there. They are just a hazard being a deep
hole laid out there, so we plan on backfilling them, sure. (not
understandable)
There's some other talk by the people that attended about barrells
and stuff laying around. Ray said something about that you crush
those?
Steve Pebler Umm Humm
Is it still safe?
Steve Pebler Oh, yes.
To use for storage of grain or something?
Ray Zelka You bet! They hold approx 35 gallons and weigh 11 lbs.
I wish somebody would come and steal them all.
Steve Pebler The thing is we let them build up and then bring in
a crusher and get rid of them. •
Didn't somebody complain about these barrells blowing around?
Ray Zelka Yes. They are so darn light that any of these winds
that we get scatters them around and the boys have to go back
and stack them. They are usually, normally, in a nice stack.
They can't get out of your property?
Ray Zelka No, sir, they are fenced in.
Well, you've got a break back behind your place on the north (???)
Steve Pebler We could remedy that problem. There are disposable
kind that you send back and get refilled made of a lot heavier
material. It's a little costly to have to pay to have them disposed
of because you have to send the others back and pay the freight
cost. We want to have as happy a neighborhood as possible. We
crush them and get rid of them.
Roger Bare I live right across the street from the plant and I
was here in protest to this plant when it first came into being. I was
assured when they put it in that all it was going to do was compress
air. It was just going to compress atmosphere air into tanks. That
was the assurance we had when this plant originally started. I was
here in protest of it then and still am today in protest of it. I
would be so thankful if they could move someplace else. For as once
you've got something it's a lot easier to get it than to get rid of
it. That's the same as measles, mumps, whatever. I don't know how 0
to get rid of it. If there was any way, I would like to get rid of
it; but I see it's here, and it looks like it's going to stay. I
wish that they could have confined themselves to just the compressed
air for oxygen. That was an oxygen plant originally -- not for any
other gases.
Steve Pebler Would you like a copy of the actual chemical content
of what's in it? We've got material handling sheets on it. That's
the law - it has to be public. So, any of the products that we do
over there, that anyone would like to know more about, we can
supply them with copies. Are you going to fix that fence back
there so that kids can't get through?
Ray Zelka As a matter of fact, I have a quote in now for a heavier
duty fence to go around the full field. We'll fill it with slats
across the north and west . . . .
Joe Bradley In regard to the complaints that we got, I don't see
where we can do much. I don't see any actual expansion that would
put them in violation of the non-conforming use. I don't think
that the covering of the loading dock is going to bother and it
certainly doesn't address their changing what they are doing inside
the building -- switching from compressed air to acytelene. That
is conceivable for them to do it, but I was hoping that maybe we
could get some benefit just by letting the plant officials know
that there are some complaints and hope to get rid of those pits
as soon as possible. That would probably solve 90% of the problems. 0
Cal Cumin Hopefully the service has been established with some
records and times for exactly what is there, so that the next
time we get a complaint (whether it is a valid complaint or not)
we should all know whether it is a valid complaint or not as far
as expansion is concerned. That is one of the reasons for getting
these gentlemen here again making this of record, a transcript,
saying they've got this as an industrial operation (??????).

CALVARY BAPTIST CHURCH ANNEXATION: Pastor Ray Willis explained the
annexation request, utilities, etc. Motion from Gerald Shay to
recommend approval of the annexation request, second by Bus Roberts.
Carried unanimously.
"ISLANDS" TO BE ANNEXED: C/S No. 68 and Lot 2A and 3A in Block 15,
Laurmac Subdivision Amended, and Lot 4A-1 and 4A-2 of Block 4,
Laurmac Subdivision Amended, are completely surrounded by City
limits. Motion from Joe Bradley to recommend annexation at City's
request, seconded by Grace Edwards. Carried.
JURISDICTIONAL AREA: Board recommends that a letter be sent to
County Commissioner's office requesting help in proving resident
freeholders.
Cal Cumin presented aerial photos of the City of Laurel which cost
$700.00. Motion from Joe Bradley to pay half the cost of the
photos or $350.00, second by Don Gudgell. Motion carried unanimously.
NOTE: Other half to be paid by Public Works Department.

PROPOSED ADDITION TO "HOME OCCUPATION SECTION" OF THE ZONING ORDINANCE (3/13/86) 1
B. Home occupation:
(1) Home occupation is permitted in a dwelling customarily
incidental to the principal use as a dwelling subject
to the following limitations:
a. No person other than .a member of the immediate family
occupying a dwelling- is.emp'loyed, except domestic
help.
b. No stock in trade is displayed or sold upon the
premises.
c. No alteration of the principal building changes the

character thereof as a dwelling.
d. No illuminated sign is used, and no sign other than
one giving the name and occupation, and not more
than one square foot in area, is displayed.
e. No more than 25 percent of the area of one story
of the building is devoted to the home occupation.
0 f. No equipment shall be used in such a home occupation
which creates noise, vibration, glare, fumes, odors,
or electrical interference, no equipment or process
shall be used which creates visual or audible inter-
ference in any radio or television receivers off
the premises.
g. The home occupation shall be deemed to be both site
specific and owner specific; thus, the use of a por-
tion of a structure as a home occupation will not
permit a subsequent owner an automatic home occupa—
( (2) The following activities are prohibited from home occupation
under this section:
a. Motor and motorized vehicle or boat repair of any kind
to include body and engine work, upholstery and glass
repair, and audio system work.

systems.
c. Furniture and appliance sales, repair, or renovation.
d. Manufacturing of any food products for barter or sale.

WHEREAS, certain property owners have requested that
certain lands known as Certificate of Survey No. 1894, Tract

PMM, Yellowstone County, Montana, be annexed and incorporated
into the City limits of Laurel, Montana; and,
WHEREAS, said property owners will waive in writing all
