HOME OCCUPATION SECTION 17.44.010(B) PUBLIC HEARING: This being the time.and place advertised, a public hearing was held on the question of a proposed change in the Home Occupation Section of the Zoning Ordinance, known as Section 17.44.010(B). L. D. Collins wants to put more teeth in the ordinance. Cal Cumin states it is a problem of enforcement. Should be referred to the License Committee.. Bryan Conner asks about doing work for ones.. own self. Cal Cumin went over the proposed amendment. Hearing closed. Motion.f rom'Grace Edwards,:second by Darrell Aaby, to recommend that .the Council adopt the proposed addition to the section. Carried unani- mously. HOME OCCUPATIONS: Richard A:MeA er, 3.15 West Avenue dba Grandpa's Toy Shop, not present. Andrew Glenn Porter, 1118 6th Avenue dba A.G.Porter Fly Co., doesn't actually use his home for manufacturing. Needs to have license to buy wholesale. Motion from Bob Rosselot, second by Marvin Carter, to recommend that the Council grant a City license for this home occupation. Carried unanimously. NURSING HOME ANNEXATION Joe Rude, President of. the Laurel Nursing Home, presented their case. Will replace present nursing home plus addition.. It will be.residential in appearance with off-street parking and service area attached to the present park areas. • Jerry Shutz presents engineer's view. Talked about streets, curb/ gutter, sidewalks, lightin „ retain drainage on site, sewer and water, garbage cans and site for collection; street signs, SIDs, maintaining park areas, access for emergency vehicles off of Maryland. City park needs to be annexed also. Cal Cumin asked for a description of the property, which has not yet been platted. Dr. Smith abstains from discussion because he is on the staff of the home. How wide is street on Maryland? Will pave 22 ft. wide. Home has filed "waivers" with City Clerk. Would like to start construction in the fall of 86. Daryl Shay asks about possible conflict with.softball complex. Engineer sees it as an asset.; L. D. Collins, alderman, asks about taxes, traffic and parking. Cal Cumin asks for several items to be addressed: must be.platted, annex the park and sign waivers.. Hearing closed. Motion from R. M. Williams, second by Don G'udgell, to.recommend approval subject to stipulations. Carried with Joe Bradley abstaining* SOFTBALL ASSOCIATION: Daryl Shay represents'Girls' Softball Association.. Cashell Engineers not in attendance. They want to build a complex on 9th Street/10th Avenue which is a public park just outside the City limits. Would like the present plan changed to 3 fields, basketball court, parking lot. A concession stand is planned in the future with lighted fields and no.streets. Association will pay for development of the park. Will take to Council for annexation -- will probably then be referred back to the Planning Board for a recommendation. The Park Committee should become involved. ORDINANCE REGARDING FENCE REGULATIONS: Discussion regarding old ordinance and new proposal. Discussion of.chain link or see-through fences. Discussion of yards. Discussion of right-of-way. Discussion of setbacks. Motion from Marvin Carter, second by Grace Edwards, to recommend passage of new Section 17.40.010D as proposed subject to slight language change. Passed unanimously. Street grading, paving or improvements We propose to provide for the dedication of 1/2 of Maryland Lane and 8th Street. Maryland Lane will be paved from Washington Avenue to the service drive of the nursing home. Pavement of 8th Street will occur at a later time. 2. Curb and gutter Curb and gutter will be provided along Maryland Lane from the exsiting curb and gutter at Washington Avenue east to the new service drive of the nursing home. 3. Sidewalks Sidewalks will be provided for along Washington Avenue and to service drive on Maryland Lane. 4. Lighting Street lighting, if additional is required, will be provided by the developer. 5. Surface drainage and storm sewer Since there is no storm sewer in close proximity to the proposed site, the developer will provide surface drainage and pondage to receive such drainage within boundaries of site. 6. Sanitary sewer and water lines Both sanitary sewer and water lines will be connected at Washington Avenue and run east along Maryland Lane approximately 250' and then directly into the proposed new building. We will provide fire hydrants as per city code. 7. Sprinkling districts N/A 8. Garbage sites and containers Garbage pickup and storage of containers will be provided on site within a screened in area by the developer. 9. Street signs Street signs, if required, will be provided by the Owner. 10. Any and all other improvements for which a special improvement district could be created. We know of no other special improvements or considerations. PROPOSED CHANGES IN LAUREL ZONING REGULATIONS REGARDING FENCES May 8, 1986 Delete existing section on fences and walls (Section 17.40.O10D): 1L. Fences and walls. The building line and yard requirements of these regulations shall not apply to retaining walls or other walls or fences nc:t over six feet in height; except that, on a corner lot in any residen- t'al district there shall be no fence, wall, terrace, structure, .,hrubherv, planting, or other obstruction to vision having a height treater than three feet above the curb level for a distance of 25 feet fr the intersection of the front and side street lines. On a corner lot in a corm rc al or industrial district, no portion of a building or -tier obstruction to vision between two and ten feet above the curb iovel, except I post or column, shall occupy the space formed within the triangular yard ;pace formed by measuring; five feet distance from the corner o* the intersecting street lines and the hypotenuse of the triangle becomes the setback line. It ;.hall be unlawful for any person to erect or maintain any barbed wire fence in or along a residential area in the City of Laurel. Further, any barbed wire fence erected in other areas of the city shall, along anv public street or sidewalk, maintain the lowest strand of barbed wire at least six (6) feet above sidewalk grade, over the top of a non - barbed fence over private property and at least ;ix (6) inches inside the _ property line. • Replace with the following: D. (2) There are no fence height requirements in AG, RE20,000, CBD, CC, HC, LI, and HI zones. (3) Electric fences shall not be permitted in any commercial or residential zones except AG and RE20,000 zones. (4) No fence shall be located in a public right -of -way. (5) The height of a fence shall be the vertical distance from the highest top board, rail, or wire to the ground directly below. (6) On corner lots, a fence shall not exceed a height of three (3) feet for the part of the fence which lies immediately adjacent to the front yard of an interior lot. (7) These providisions shall not - apply to fences required to surround and enclose existing junkyards and public utility installations or to en- close school grounds and public playgrounds. (8) It shall be unlawful any person to erect or maintain any barbed wire fence in or along a residental area in the City of Laurel. Further, any barbed wire fence erected in other areas of the City shall, along any public street or sidewalk, maintain the lowest strand of barbed wire at least six (6) feet above sidewalk grade, over the top of a non - barbed fence over private property and at least six (6) inches inside the property line. Also, change the definition of fence (Section 17.20.225) to read as follows: 17.20.225 Fence A barrier of posts connected by boards, rails, panels, or wire constructed fro purposes of enclosing space for separating parcels of land or for landscaping and including masonry walls, ornamental structures, privacy screens, and shrubs.
