MONTANA 99010 June 12, 1986 Meeting of the Laurel-Yellowstone City-County Planning Board called to order with the following members present: Dr. John Hawley Smith, President (City Rep.) R. M. Williams, Vice President (County Rep.) Grace Edwards (County Rep.) Bob Rosselot (County Rep.) Donald Gudgell (County Rep.) Darrell Aaby (City Rep.) Joe Bradley (City Rep.) Bills approved for payment: Director of Public Works Department in the amount of $400 for Administrative Services in May and June, 1986; Cumin Associates in the amount of $3,375 for Planning Advisory Services for April, May and June, 1986, as per agreement. HOME OCCUPATIONS: Richard A. Metzger, 315 West Avenue dba Grandpa's Toy Shop. Cal Cumin recommends denial. Motion from Bob Rosselot to recommend approval, second from Donna Kilpatrick. Carried unanimously. PUBLIC HEARING - ELLIS & BETTY WINKEL FILE #PB86-01: A special review has been requested on the South 80 ft. of Lots 1, 2 and 3, in Block 4, East Laurel Subdivision, CBD Zone, to allow on premises beer and wine license. The property is located at 401 West Main, Laurel, MT. Petitioner present. Tom Kilpatrick, spokesman for the protestors. Petition against signed by 24 petitioners. Complained that another bar is 1/2 block away and is trashy. There are older citizens involved and that the major use of the area is residential. ?' .. ;. Betty-Winkel asked if these same people protested when Happy Gardens , was allowed their full liquor license review? Cal Cumin makes no recommendation except to say that this review does conform to the standards for a special review. Motion from Grace Edwards, second by Bus Roberts, to recommend denial. Vote: 4 for, 3 against, 2 abstained (Smith & Bradley). PUBLIC HEARING - LAUREL NURSING HOME FILE #PB86-02: A special review has been requested on the North 670 feet of West 325 feet of the E? SEk NEk, Section 9, Twp 2S, R24E, PMM, Yellowstone County, RE20,000 zone, to allow construction of a nursing home. The property is located on 5 acres between 8th Street and Maryland Lane between Washington Avenue and Idaho Avenue close to Washington Avenue Park, Laurel, MT. Petitioner's representatives present: Phil Gorby, R. Joseph Rude, Allen Rapacz, Jerry Schutz, Mark Kelley. This will be a 55-bed facility including personal care. Entry will be directly across from 9th Street and with a service entry on Maryland. Phil. Gorby and Joe Rude visited neighbors within the 300 ft. radius and found few concerns and no protests. Allen Rapacz presented plan for extension of sanitary sewer. Off- street parking exceeds minimum needs. Drainage will be a.recessed holding pit. Landscaping will be done. Boring tests have been done. A petition against and in protest of this application as being against the division of the park and the park being included in the landscaping of the nursing home. They feel the park should be a separate unit. The petition was signed by 24 signatures. Shirley Budge stated she was not notified (note: receipt for certifie• mail #P 188 414 095 dated May 20, 1986, is on file) and expressed her concern about traffic and water. High traffic already. Requests main entrance off Maryland. Chet Herbert asked about waiver of protest. Louis Gauthier questioned when Maryland Lane would be pushed clear through. Concern about too much traffic on Washington and Maryland. Zoning will remain single family. Julia Herbert states they have already given right of way. John Hawley Smith abstains due to being on the Laurel Nursing Home Board. Letter dated June 12, 1986, from the office of the City Engineer read and entered into discussion. Cal Cumin states that special review recommendations are limited. Maryland Lane is a future collector street. Recommends approval of on-site storm sewer as previously discussed. Recommends approval if landscaping and promises are finalized before final approval by Council. City can require an Improvements Agreement and needs to be spelled out on final approval. Motion from Joe Bradley, second by Donna Kilpatrick, to recommend conditional approval subject to written improvements agreement and subject to the engineer's approval as per his letter. Passed unani- mously with John Smith abstaining as stated before. OFF-STREET PARKING: Discussion led by Cal Cumin. Present ordinance requires off-street parking for new buildings or additions to build- ings. It is being suggested that $1000 cash be donated in lieu of • this requirement for a 10x20 parking space. Motion from Joe Bradley, second by Bus Roberts, to recommend that the ordinance be changed accordingly. Passed unanimously. Next month the Yellowstone County Planning Board will present pictures and presentation of their plans. FENCES: Motion from Grace Edwards, second by Joe Bradley to hold a public hearing on the proposed fencing ordinance update. Carried 7--2 with Smith and Gudgell voting, no. CUMIN ASSOCIATES' CONTRACT RENEWAL: Motion by John Hawley Smith, second by Joe Bradley, to extend the existing contract between Cumin Associates and the Laurel-Yellowstone City-County Planning Board for the period of July 1, 1986, through June 30, 1987, in the amount of $13,500. The Planning Board will consider the request at their regu- larly scheduled meeting. Attendance at this meeting is required by the applicant or his /her representative. 3. The Planning Board will make a recommendation to the City Council that the specific request for a home occupation - designation be granted or denied. 4. The City Council will consider the Planning Board's recom- mendation concerning the specific home occupation designation and approve or deny it at their next regularly scheduled meeting.
