MONTANA 69040 July l0, 1586 Meeting of the Laurel-Yellowstone City-County Planning Board called to order with the following members present: Dr. John Hawley Smith, President (City Rep.) Gerald Shay, Member-at-Large, Exec. Secty Bob Rosselot (County Rep.) Donald Gudgell (County Rep.) Darrell Aaby (City Rep.) Joe Bradley (City Rep.) Donna Kilpatrick (City Rep.) Russell Bray (County Rep.) new member Members absent: Grace Edwards (County Rep.) Yzaguirre, 836 W. 4th St. Bob Mace, Box 20821, Billings • Joanne Garnett, Yellowstone County Planning Board John Darlington, Yellowstone County Planning Board Minutes of previous meeting approved as sent out. Bills approved for payment: Director of Public Works Department in the amount of $200 for Administrative Services in July; postage and advertising. Joanne Garnett of the Yellowstone County Planning Board presented a slide show on what their board is doing and are planning to do. John Darlington, planner for the County Board, requested input from this board and volunteered to speak to other groups if requested. Ms Garnett would also present the slides to groups. HOME OCCUPATIONS: Ess P. Yza uirre, 836 W. 4th Street, requests a home occupation as a mechanic. Will be pulling out engines and disposing of the auto bodies. The request seems to be in violation of the Laurel Municipal Code Zoning Ordinances. Cal Cumin recommends denial. Motion from Joe Bradley to recommend denial,.second from Don Gudgell. Passed unanimously. Board recommends to Mr. Yzaguirre to try and get a building in a commercial zone. PUBLIC HEARING - PB #86-03 MACE REALTY: A zone change has been requested on Lots 1--3, Block 14 and Lots 5--13, Block 13, Cherry Hill Subdivision, 2nd filing, from R-7500 zone to allow R-6000 zone. The owner proposes condominium units. The property is located on the south side of Maryland Lane and adjacent to 13th Avenue, Laurel, MT. Petitioner present. Any units built would be pre-sold. 12 lots involved. lkr Petitions and letter of protest accepted and entered into the record. Bob Horning opposes project. Reminds board this is the third time this same project has come up. Cal Cumin recommends approval.of project subject to having control on how many units are built before they are sold. 12 points of zone change criteria reitterated. Motion from Joe Bradley to recommend approval, subject to restrictions on number of units, etc., second by Donna Kilpatrick. Vote: 4 for, 4 against with Gerald Shay, Don Gudgell, Darrell Aaby and Russell Bray voting, no. Motion from Don Gudgell to recommend denial, second by Russell Bray. Vote: 4 for, 4 against with Bob Rosselot, Joe Bradley, Donna Kilpatrick and John Hawley Smith voting, no. PUBLIC HEARING - FENCE ORDINANCE: No protesters present. Cal Cumin read the proposed ordinance. Motion from.Joe Bradley to recommend approval, second from Don Gudgell. Russell Bray questioned 6 ft. limit. Motion carried unanimously. PARKING ORDINANCE PROPOSAL: Present ordinance requires off-street parking for new buildings or additions'to buildings. It is being suggested that $1000 cash be donated in lieu of this requirement for a 10x20 parking space. Motion from Don Gud ell to hold a public hearing on changing the parking ordinance, second by Joe Bradley. Carried unanimously. Hearing is scheduled for August 14th. Cal Cumin questions semis, junk cars, etc., on 926 West 8th - zoning violation. Jurisdictional area discussed. Discussion regarding street names. A letter to be written to the County Surveyor's office to attend our next meeting to talk about numbering system. Fences and walls. The building line and yard requirements of these regulations shall not apply to retaining walls or other walls or fences not over six feet in height; except that, on a corner lot in any residen- tial district there shall be no fence, wall, terrace, structure, shrubbery, planting, or other obstruction to vision having a height greater than three feet above the curb level for a distance of 25 feet from the intersection of the front and side street lines. On a corner lot in a commercial or industrial district, no portion of a building or r;thcr obstruction to vision between two and ten feet above the curb level, except a post or column, shall occupy the space formed within the triangular yard space formed by measuring five feet distance from the corner of the intersecting street lines and the hypotenuse of the triangle becomes the setback line. It shall be unlawful for any person to erect or maintain any barbed wire fence in or along a residential area in the City of Laurel. Further, any barbed wire fence erected in other areas of the city shall, along - any public street or sidewalk, maintain the lowest strand of barbed wire at least six (6) feet above sidewalk grade, over the top of a non - barbed fence over private property and at least six (6) inches inside the . property line. Replace with the following: D. Fences: (1) In R7,500, R6,000, RLMF, RMF, RMH, PUD, RP, NC, and P zones, fence heights in front yards shall not exceed three (3) feet; side and rear yard fence heights in these same zones shall not exceed six (6) feet; on corner lots adjacent to a street, houses with a front yard facing a side street (or at 90 degrees, approximately, from the adjacent front lots), and with a side yard or back yard adjacent to a front yard in the same block, shall not have a back yard fence higher than three (3) feet where adjacent to a front yard, or a side yard fence paralleling the street higher than three (3) feet. (se e (2) There are no fence height requirements in AG, RE20,000, CBD, CC, HC, LI, and HI zones. (3) Electric fences shall not be permitted in any commercial or residential zones except AG and RE20,000 zones. (4) No fence shall be located in a public right -of -way. () These providisions shall not apply to fences required to surround and enclose existing junkyards and public utility installations or to en- close school grounds and public playgrounds. Fences proposed to surround three (3) or more houses in existing subdivisions shall be reviewed through the Special Review process.
