Bills approved: Director of Public Works Department in the amount of $200 for Adminis- trative Services in October; Postage $21.62 HOME OCCUPATIONS: Jack Broadhurst, 2303 Atchison, requests a home occupation as talent agency and tourism development. Motion from Joe Bradle , second by Russell Bray, to recommend granting this home occupation. Passed unanimously. INFORMAL PUBLIC HEARING - WYANT SUBDIVISION PB #86-04: An application has been submitted to subdivide the following property: Tract 8B of Amended Tract 8 of C/S #1878 situated in a portion of the SEQ, Sec. 34, T1S, R24E, PMM, Yellowstone County, Mt. located 1 mile west of the Laurel Airport. Number of acres: 17.33; number of lots: 5; proposed use: single family homes. Adjacent property owners were notified as a courtesy. Peter Knapp of Sanderson, Stewart & Gaston Engineering represents Arlet Wyant. Currently zoned under airport zoning but is agricultural use. Tract being developed for residential homes. Subdivider has not contacted • the High Ditch Company. Access onto Laurel Airport Road. Cal Cumin states under State subdivision law this tract size qualifies as a minor subdivision. Airport Road and Yard Office Road are arterial roads in the master road plan. Lot 3 must be re-designed. Wyant must provide air navigation easement. Area is within the airport zone and buildings placed upon these lots must go through special review before housing can be built. Park requirement must be met. b? ?P ? Adjacent property owners protesting: Don.and Donna Gudgell Harvey Fox George Reiter George Reiter recalls comprehensive plan was to remain green belt area around airport per public hearing. 1983 hang glider crashed, stunt flyer crashed, 1985 airplane crash north of this lot and killed pilot. Planning Board maps show prime agricultural land. Septic tank hazzard areas also shown. High Ditch Co. runs thru this Tract 8B and high water. Save agricultural land. Robert Kraft protesing as adjoining property owner. Protest letters received and read into minutes: Robert & Kayrene Kraft Don & Donna Gudgell Yellowstone County Surveyor's Office General discussion on agricultural. Harvey Fox concerned about wells and water as his wells just west have run dry in recent years. Cal Cumin says water rights will not affect any adjoining property and tests must be done by developer on each lot. Access onto Airport Road will not have an adverse effect on current use of that road. This zoning is provided for under State law. This area does restrict building. Drainage is a problem. Not zoned for agriculture. The area is largely unzoned. Planning Board tests for growth and need. Motion from Donna Kilpatrick, second by Roy Johnson, to recommend denial by the County Commissioners based on (1) not needed, (2) prime agricultural land, (3) road access. Motion passed with Don Gudgell abstaining. MACE REALTY - PB #86-03: This has been referred back to the Planning Board by the Council for reconsideration. Bob Hornin protests.. Continuing protest by Wilkerson, Dell and Gremmers. Summary by Cal Cumin: 1. single family neighborhood 2. quality of Mace housing 3. One street into property 4. original letter stating single family housing only 5. traffic 6. duplex sales to others 7. no need for condos as currently 11 homes for sale 8. parks 9. Bob Mace's reputation and sudden change for zoning plans Mace is applying for R6000 zone. Mike Mace comments: Submitted to Council by Mace - - 1. Place deed restrictions on each lot to follow Mace's plans for lots as given to the City and agreed to by City. 2. Exception would be to build a single-family dwelling upon that lot only. Mike stated specifically clear that Mace's deed restrictions be a single unit and not multiple units on each lot to blend into the • single family dwelling surroundings (neighborhood). Mike Mace says there are 13 lots, Cal says 12. Chuck Dickerson questioned sale of lots to individuals now as previously Mace was retaining title to property. i • Joe Bradley dicussed spreading duplexes out and they become more unnoticeable. R6000 allows single family and duplexes. Roy Johnson states Alkali Creek area of Billings is now a jungle with single family and multi family dwellings. Roy does not believe con- centrating duplexes is good planning. Creates messy appearance and unkept areas on a larger area. Disrupting of peace and tranquility of the neighborhood. Currently 12 different owners would create loss of control in sub- division. Madelon Davis states that retired people would not want to move into a subdivision concentrated with children. Bill Gremmer states that West Maryland is handling as much traffic as the road can handle. Roads up there are all torn up. He is totally against subdivision. A lot of traffic and a lot of kids up there. Mike Mace wants to accommodate the residents. 12.sites out there. First 5 lots allow for 2 family dwelling on each lot and remaining 7 lots to one single family dwelling through deed restrictions. Mike wants to compromise the issue. Joe Bradley suggested bring in deed restrictions that can legally be enforced. Submit this in writing: deed restrictions restrictive covenants number of lots and identify those lots Motion from Joe Bradle , second by Donna Kilpatrick, to bring the aforementioned before the Planning Board November 13th. Procedure • 1. Complete home occupation request form and submit it to the City seven (7) working days prior to a regularly scheduled meeting of the Planning Board. • 2. The Planning Board will consider the request at their regu- . larly scheduled meeting. Attendance at this meeting is required by the applicant or his /her representative. 3. The Planning Board will make a recommendation to the City Council that the specific request for a Home occupation designation be granted or denied. 4. The City Council will consider the Planning Board's recom- mendation concerning the specific home occupation designation and approve or deny it at their next regularly scheduled meeting.
