Meeting of the Laurel-Yellowstone City-County Planning Board
called to order at 7:02 p.m., with the following members present.

Larry Herman representing the Winkel°s states this is a
request for Special Review and the ultimate determination is
going to be made by the State.
What this is, is a variance to allow a Personal Care Facility.
A Personal Care Facility is for people who are ambulatory as
such to take care of themselves in a controlled environment
or communal type home which has to be licensed by the state
before it goes into effect. The state has inspected the
facility and issued the certificate of need and so it would
take series from this board to issue a special review.
Joe Bradle states he called the State and spoke with a Charles
Aagenes, head of Health Planning and Resources Development Bureau
in regards to the certificate of need being issued. The application
for certificate of need is not complete until they get the
Citys approval as to the site, then the state will hold their
hearing. So the certificate of need has not been issued yet.

Gerald Shay inquires as to how many occupants will be living
in the two houses.
Ellis Winkel figures six and that probably doesn't cover the
staff.
Betty Winkel states you really don't know until the state tells
you how many staff employees are required, but she figures three
employees on the payroll plus them.
Cal Cumin asks if the facility the Winkel's have now is classified
a personal care facility.
Betty Winkel replies that it is classified a Foster Home.
Joe Bradley states there shouldn't be any off-street parking
problem.
Donna Kilpatrick asks if there has been a fire inspection performed.
Betty Winkel states that has been done by the State Fire Marshall
already. --
Larry Herman refiects the state would not allow the application
without first having a fire inspection and there should be a
copy in our files. Larry also asks if there were any protests
filed. 0
Cal Cumin states this is an application for one personal care
facility and yet there are two buildings involved. Isn't this
a bit unusual?
Betty Winkel replies no, because it is one legal description.
Joe Bradley states Mr. Aagenes, of the state has concerns about
the two houses and might request the two buildings be joined due
to employing staff in each building.
Cal Cumin would like entered into the minutes a letter from
Thomas Selleck, Deputy State Fire Marshall, regarding a personal
scare home for people at 717 W. 1st Street. It is addressed to the
Department of Health & Environmental Sciences whereas, an in-
spection was conducted on the above said property August 27th, 1987,
to determine the condition of the home for life safety. The
following is the violtion and correction necessary to provide a
reasonable degree of fire safety to this facility. Uniform Fire
Code, Section 10.301 - No fire extinguisher - correction - install
an A.B.C. fire extinguisher in the kitchen area, a 1--A minimum size.
Fire extinguisher shall be installed so that the top of the
extinguisher is not more than five feet above the floor.
Cal further states there is no problem with the use of the land •
and he recommends that the two buildings be connected some how
subject to state approval.

Joe Bradley recommended approval subject to State approval,
that the facility complies with said requirements, consistent
• with the zoning code, compatible with the land use, acquiring
a City License and that there would be no adverse impact.
Joe Bradley motioned seconded by Donna Kilpatrick to close the
public hearing and no second hearing be held. Motion carried
6--0.

Joe Bradley states he never thought the City of Laurel had
a parking problem, but apparently some of the chamber people do.
Joe wants to know what side is the Chamber siting on. Do they
feel we need more off- street parking or not? What happened
to Firemans Park and Blackburn's property.
Donna_Kilpat_rick said they could not generate enough support
so the idea was dropped.
. Darrell McGillen explains where Donna is coming from. Darrell
would like to see the ordinance changed to prevent what happened
to him happen to someone else. He remodeled the a Palace for the
second time, there was 2400 square feet involved. He was aware
of the ordinance saying any new or additions would have to supply
additional off-street parking. He was told by the Building
Department at the time of his building permit application that
one or two additional parking spaces would accomodate your
addition. He added that in his budget for the constructiorhe
knew he could handle that additional cost. While in construction,
Jim Flisrand of the Building Department came back to Darrell and
stated after reviewing the ordinance he would need 16 additional
parking spaces. With the other business people within the block
alleviated 50% of his problem leaving additional eight spaces
needed. Mr. Blackburn across the street assure Darrell he will
make up an agreement with him for the additional parking he needs.
This is unacceptable due to the fact the ordinance states you may
not cross a major collector to obtain additional parking. Right
now Darrell is waiting for formal legal papers to sign agreeing
to pay the City $6,000. for six parking spaces. He would. like
to see this ordinance changed to alleviate hardship to already
established businesses trying to upgrade by remodeling their
business. This puts extreme hardship to any business.

Joe Bradley asks if Darrell feels off-street parking should
be required at all.

a heavy burden on the businesses already established.
Joe Bradley motions to recommend to the council to allow the
us to draw up some revised requirements for location of off-
street parking seconded by Velda Thomas. Motion carried 6--0.
Temporary Signs
Cal Cumin the City Council had the issue of Temporary Signs
come up. The council referred the issue to the Planning Board
for a recommendation back to them. It does not have to be at
the next meeting.. Cal has drafted up some ideas and provisions
and would like all committee members to study it and report back
with any ideas they may have at our next Planning Board Meeting.
HOME OCCUPATION.
Bob Strand of Sue's Video explains the details of the business.
It is simply creating home videos. There will be no impact of
traffic in his neighborhood, there should be no problem with
noise. There might be an occasional customer, one at a time.
Cal Cumin inquires as to exactly what the business is.
Bob Strand explains that he will be taking pictures of weddings,
parties, etc. He would be making video tapes, film editing and
filming. His equipment does not interfere with television etc.
Gerald Shay motions to approve subject to no traffic coming to

Gerald Shay recommends approval subject to a limitation of 50
gallons of all paint products and subject to no fire code
violation, seconded by Donna Kilpatrick. Motion carried 6--0.
Clarence Sonste aard came to the Laurel City-County Planning
Board about a piece of property he owns located in the county.
He was wondering about re-zoning it. The Planning Board gave
several suggestions and recommended if he wishes to pursue the
issue he would have to file and application for re-zoning.
Russell_Bray discusses sign ordinances. He would like sign
painting and sign lettering shops put in separately from sign
manufacturing.

Joe Bradley states there were no minutes due to no quorum.
John Smith then asks about the meeting before that.
Joe Bradley states the Planning Board will have to approve them.
Joe makes motion to approve the meeting of September, 1987,
seconded by Donna Kilpatrick. Motion carried. 6--0.
Three bills submitted for approval were submitted for Director
of Public Works Department for three months, for September,
October and November in the amount of $200.00 each.
Joe Bradle motioned to approve seconded by Gerald Shay.
Motion carried. 6--0.
