CITY-COUNTY PLANNING BOARD LAUREL, MONTANA 59044 The meeting of the City County Planning Board was called to order at 7:00 p.m., October 8, 1988 with the following members present: John Smith, Chairman Roy Johnson,.County Rep. Grace Edwards, County Commissioner Darrell Aaby, City Rep. Chuck Dickerson, City Rep. Russell Bray, Co. Rep. Don Gudgell, Co. Rep. Clarence Foos, Co. Rep. Joe Bradley, City Attorney Members Absent: Velda Thomas, City Rep. Gerald Shay, Co. Rep. Others present: Cal Cumins, Cumins Associates, Billings 0 Don & Mary Anne Johnson, 523 Elm Ave. Curtis Doherty, 512 Pennsylvania Ave. Lynn Nordahl, 1110 6th Ave. Cheryll Lund, Planning Board.Secretary Home Occupations LLynn_Nordahl, of 1110 6th Ave. has applied for a Home Occupation. He wants to start up a home delivery service of "Pride of the Valley" products that he purchases from Lucky Seibert. He has written permission from Lucky to do this, and he has also obtained the necessary health permits. There will be no traffic coming to his home, and no extra garbage. All undelivered meat will be stored in a deep freeze. Motion by Grace Edwards to recommend approval subject to no extra traffic and garbage, seconded by Don Gudgell. Motion carried. Curtis Doherty, of 512 Pennsylvania Ave., has applied for a Home Occupation to start up a Family Computer Center. All sales will be done outside of his home, with no storage of inventory, or showroom. Motion by Don Gudgell to recommend approval subject to no traffic in the home, seconded by Grace Edwards. Motion carried. Don &.Mar Ann Johnson 523 Elm, have applied to a limited kennel license to allow them to bred and sell Chinese Sharpai dogs. The dogs reach a maximum height of 18-21 inches. They ,C r ? are the "wrinkled" type of dog that is popular. Mrs. Johnson states that they are a quiet dog with a nice personality. They plan to confine the females while they are in heat, and they do have a double fenced yard. The dogs will never be "kenneled" as this type of dog does best in a family environment. The Johnson's are doing this as a money making venture. They hope to have a full scale kennel within 2 years, with one litter of pups on the ground per year. The dog's sell anywhere from $ 800- $1500. Cal states that the Johnson's are in a residential area, and in order to go into a commercial kennel they need to be in a commercial zone. He reccommends that they apply for a zone change that would change the zone to Highway Commercial. This process is somewhat lengthy but it gives the neighbors a chance to air their concern's during a public hearing. Motion b Joe Bradle to deny the Home Occupation request, seconded by Don Gudgell. Motion carried. Minor Plat There is no action to take on this minor plat, but Cal would like the Planning Board to be aware of this. The location is just South of the Conoco C Store on South 1st Avenue right next to the highway off ramp. The site is being considered for a Burger King. Motion by Chuck Dickerson to recommend approval with the stipulation that a sidewalk be installed by S. 1st Ave., seconded by Joe Bradley. Motion carried. Move on Houses Joe Bradley has been unable to find a model Ordinance to address this issue so the subject will be tabled until he can find one. Houses in Transit Cal and Joe have drawn up a tentative Ordinance regarding Houses in Transit. This Ordinance will not apply to new modular homes. Motion b Chuck Dickerson to have a Public Hearing on this issue, seconded by Roy Johnson. Motion carried. Discussion on a gentleman who is selling bicycles without a license. He is less than 1 mile out of the City limits, and we have received a complaint from a local bicycle dealer. Cal will write a letter to him. Motion by Don Gudgell to approve the minutes of the September • 8th meeting, seconded by Joe Bradley. Motion carried. City County Planning Board meeting of October 13, 1988 Motion by Grace Edwards to approve the Administrative Services bill for August for $ 200 and October for $ 200, seconded by Joe Bradley. Motion carried. Motion by Joe Bradley to adjourn the meeting, seconded by Don Gudgell. Motion carried. Procedure 1. Complete home occupation request form and submit it to the City seven (7) working days prior to a regularly scheduled meeting of the Planning Board. 2. The Planning Board will consider the request at their regu- larly scheduled meeting. Attendance at this meeting is required by the applicant or his/her representative. 3. The Planning Board will make a recommendation to the City Council that the specific request for a home occupation designation be granted or denied. 4. The City Council will consider the Planning Board's recom- mendation concerning the specific home occupation designation and approve or deny it at their next regularly scheduled meeting. Attendance by the applicant or his/her represent- ative is required at this meeting.
