The Laurel-Yellowstone City-County Planning Board meeting of
April 12, 1990 was brought to order at 7:00 p.m. with the
following members present:
John Smith, Chairman
Roy Johnson, County Rep.

A question is raised by Roy Johnson concerning the motion by
Grace Edwards on the Special Review application on Town Pump.
He states he has had several phone calls questioning as to
why the Planning Board recommended approval. Roy doesn't remember
voting for approval, he remembers a different motion stating
that we didn't approve or disapprove, but are giving it to the
Council to decide.
Joe states that the motion should of approved or disapproved,
based on the zoning issues only. If no motion was made one way
or another than the Planning Board didn't do their job. The
application was sent to the Planning Board for that purpose.
Joe states that the legal add was correct in stating that the
application was approved, with the stipulation that the Council
hold a second public hearing, because that is what the Board
did. The Zoning was proper and the Board recognized that.
He feels that the legal ad should stand as was published.

Motion by Roy Johnson, seconded by Clarence Foos, that the •
motion by Grace Edwards be amended to read "That this Board
send a message to the City Council that the Special Review
does not conflict as far as we are able to determine with our
present Zoning Ordinance and further recommend that they hold
a public hearing." Motion carried, minutes are amended.
Sister Cities International
We received correspondence from Sister Cities International concerning
applying to their organization.
Cal feels that it would be an expensive venture. He recommends
that we table this issue.
Motion by Joe Bradley,, seconded by Lonnie Kellogg to table
the Sister Cities International issue. Motion carried.
Home Occupations
Mary Massey, 419 Birch Ave., Laurel, has applied for a Home
Occupation to allow her to do bookkeeping for truck drivers at
her home. She would keep track of their monthly bills while they
are out on the road. This would enable them to have their
tax receipts on hand and organized for tax returns at the end
of the year.
She would either have the truckers drop the information off at

her home, or she would get a seperate post office box that they
would send information to.
She feels that no one would come to her home, unless there is
some kind of a problem or question that needs to be addressed.
She is located in a residential zone. She does not own the
house it is owned by Ed Martin. She has gotten his approval
on this.
Cal states that the owner of the house probably should have
made the application. He feels that we could run into problems
if people apply for home occupations that rent these homes without
the owner's consent. The owner needs to at least sign the
application to show approval.
Motion by Joe Bradley, seconded by Russ Bray that the
Planning Board recommend approval to the City Council under
the conditions set forth in the application, and that she
obtain a city license, and that Ed Martin send a letter stating
that this meets with his approval. Also, that clients would
not come to her residence. Motion carried.8--0.
Ron Boucher, 508 4th St. W., Laurel, has applied for a Home •
Occupation to repair and sell appliances in his garage. He would
do this on his days off and week-ends.
Ron gets the appliances through placing ads in the paper. He
then takes them apart and repairs them, and then sells them.

• Cal states that repairing appliances is strictly prohibited in
residential areas, and this is stipulated in the Home Occupation
Ordinance.
Cal states that this Ordinance was drawn up because of people
that do this at their homes and create a mess that extends beyond
these peoples garages and into front yards, alleys, etc.
Unfortunately these few people made it tough on those people
who do this without the mess.
Question on Fred's Appliances being able to do this at his
shop. Joe has received a complaint on Fred and is going to
pursue it.
Cal recommends denial of Ron Boucher's Home Occupation based
on the Ordinance against it.
Motion by Donna Kilpatrick, seconded by Don Gudgell to
recommend denial of the Home Occupation to the City Council.
Motion carried 8-0.
Rebecca Penne, 3142 67th St. S.W., Billings, has applied for
a Home Occupation to detail cars at 202 Durland, in the garage.
• Detailing cars is basically cleaning the inside and outside of
cars for car dealerships and also individuals. She does it
one car at a time and averages 2 cars per day. She does Laurel
Ford's cars, and various other individuals.
She would never have more than 1 car at a time parked at 202
Durland. Individuals that would be having this done would make
an appointment time and bring their vehicles to 202 Durland.
Cal recommends approval subject to the limitation of one car
at a time and that she pick up the cars and deliver them to her
customers.
Motion by Don Gudgell, seconded by Clarence Foos that the
Planning Board recommend approval to the City Council subject
to the limitation of 1 car at a time and that she picks up and
does her own delivery. Motion carried 7-1.
Ellen O'Connell, 921 E. 4th St., Laurel, has applied for a
Home Occupation to sell and display Indian beadwork at one of
the apartments at the above address.
Mrs. O'Connell does not own the apartments, but manages them.
She would display the jewelry in the front apartment and live in
another apartment. There are 12 apartments in the building.
• The apartment is zoned Commercial. She would have to go through
a fire inspection before doing anything.
Cal feels that the owner should of applied for this, not the
renter. He will suggest that the application for license and
home occupation be changed to specify whether the applicant is
the owner or a renter.
Cal recommends that this be sent back to the Licensing Committee
to be considered a Commercial application, not a Home Occupation. •
Motion by Joe Bradley, seconded by Lonnie Kellogg, that the
Planning Board refer this back to the City License Committee and
the City Council because it does not come under a Home Occupation.
Motion carried 8-0.
Motion by Don Gudgell, seconded by Clarence Foos, to approve
the Administrative Services bill for $200 for April, 1990. Motion
carried 8-0.
Motion by Lonnie Kellogg, seconded by Russell Bray to
adjourn the meeting. Motion carried 8-0.
The meeting was adjourned at 7:55 p.m.

Dear Mr. Cumin,
Has Laurel selected a Sister City yet? I would like to
learn of any developments which have occurred, and if you
have formally established a relationship, please forward copies
of the official signed documents to Ethel Norris at Sister
Cities International.
As you may know, I am the State Coordinator for Montana,
and I am establishing a State Management Team. The goal of
the State Coordinator and State Management Team System is to
establish in each state a broad -based communication outreach
and support network that will enhance and strengthen the
quality of Sister Cities Programs in the state. If Laurel has
established a Sister City, I would like to have one or two
persons from city appointed to serve on that Team with me.
I hope that you and /or other representative(s) of Laurel
will be able to attend the 1990 Annual SCI Conference, to be
held July 25 -28 at Albuquerque, New Mexico. I expect to be
there, and hope to see you at that time.

Dear Chuck:
Regarding your proposal to build a north - facing house on Lot 4, Block 13,
Murray Heights Subdivision: This is a corner lot bordered on the north,
east, and south by platted, existing, Laurel streets and street rights -
of -way; there is a one -foot, non - access, strip along the entire south
lot line designed to prevent access to and egress from Twelfth Street.
You asked about backyard fence heights. You can construct a fence up to
six -feet high along your back property line (along Twelfth Street); how -
,.., ever, because you are located on a corner,.the fence height cannot exceed
three feet for a distance of twenty feet back (extending west) from the
southeast property corner. Accordingly, your six -foot fence must taper
to three feet to meet this requirement. The same applies for the east
side of the lot: a fence cannot exceed three feet in height for a dis-
tance of twenty feet north from the southeast lot corner. On both the
south and east three -foot height limitations, if a chain -link or similar
fence material is used which creates no more than a ten percent obstruc-
tion to visability, a four -foot height is allowed. In addition, as you
inquired, you could also angle a six -foot fence across your southeast
lot corner so that the twenty -foot distances back from the corner are
maintained. This latter would create a vacant, triangular area which 1
you could landscape with non - vision - obstructing materials.
As I discussed with you, you can appeal this criteria to the Board of
Adjustment if you like, and you can also ask for approval of an amended
plat vacating the one -foot non - access strip. Both processes have appli-
cation fees and a formal hearing (for the Board of Adjustment) attached,
and the amended plat would have to be prepared at your expense prior to
approval or submittal.
