CITY-COUNTY PLANNING BOARD LAUREL, MONTANA 68044 June 14, 1990 The Laurel City-County Planning Board meeting came to order at 7:00 p.m., June 14, 1990, with the following members present: John H. Smith, Chairman Donald Gudgell, County Rep. Clarence Foos, County Rep. Lonnie Kellogg, City Rep. Joe Bradley, City Rep. Linda Dennis-Williams, City Rep. Russ Bray, County Rep. Donna Kilpatrick, City Rep. Members absent: Grace Edwards, County Rep. Roy Johnson, County Rep. Gerald Shay, Member at Large Others present: Cal Cumin, Cumin Associates Jim Worthington, City Engineer Sheryl Cox, 1114 W. Maryland Lane William & Kathleen Staudinger, 804 Wyoming Ave. Patty Oblander, 620 2nd Avenue Vern Gebhardt, 1107 Montana Ave. Home Occupations r Sheryl Cox, 1114 W. Maryland, has applied for a Home Occupation for a balloon bouquet business to be run out of her home. Cal informs her that she cannot display or sell any of the bouquets at her home, or have customer traffic. Mrs. Cox makes a comment that this will create more running around for her and wonders why no one at City Hall told her of these stipulations. Joe questions Mrs. Cox on whether or not she could show her customers pictures of the bouquets and take orders over the phone. Mrs. Cox states that she had not planned on having people coming into her home, and that sounds like a good idea. Joe states that the Board has to be very strict on Home Occupations because residential areas need to stay residential. . Joe inquires cif Mrs. Cox whether or not she would be willing-to amend her application to state that she would not display any of the bouquets and not have customers come to her home. Mrs. Cox states she is willing to change the application to state that. a r. „ Cal recommends approval subject to no stock or trade to be sold at her home, no customer traffic and subject to an annual review of her business license to check that these stipulations are being met. Motion by Joe Bradley, seconded by that the application for Home Occupation be approved subject to no stock or trade to be sold at her home, no customer traffic and subject to an annual review of her business license to check that these stipulations are being met. Motion carried. William & Kathleen Staudinaer At this time Mr. & Mrs. Staudinaer withdrew their Home Occupation request due to a conflict it causes with his Railroad retirement. Allev Vacation - Block 4 of. Magnus Subdivision Patty Oblander spoke concerning the application. They are asking to vacate the alley because there is an irrigation ditch running through some of the lots and it is too expensive to culvert. The ditch is 15' deep and across in some spots. Jim Worthington, City Engineer, states that the City would more than likely not ever develop the alley. Patty states that Vern Gebhardt, property owner at 1107 Montana, has plans to put several rows of trees in his yard in hopes of improving the looks of his property. At this time there is quite a "junkyard" in the neighboring lots. He hopes that the trees will hide some of the "junkyard". Joe thinks the City needs to look closely at this, because basically with a request for vacating an alley the City is giving away its land to the surround property owners. So, before the City gives this land away they should consider it seriously. The City of Billings makes the property owners buy the alley, or street that they are vacating. Joe states that they never have charged to vacate an alley before, and there have been quite a few alley vacations on the South side. If the City does decide to put an alley through the property, say 20 years from now, it could be a problem with some of the property because of landscaping or even placement of the homes. Joe states that Patty needs to get signatures of all the property owners. Cal recommends that the Council make it a policy to start charging for abandonements in the future. Motion carried. r ANNEXING OF COUNTY PROPERTIES TOTALLY SURROUNDED BY CITY PROPERTY Jim Worthington, City Engineer, reported the following areas are surrounded by the City Boundary: 1. Cert. of Survey 41155 NW Corner 8th Ave. & West 7th St. 2. Tract 2, Cert. of Survey 411894 NW Corner 8th Ave. & 8th St. 3. Cert. of Survey 4168, NE Corner.8th Ave. & Maryland Lane. 4. Cert. of Survey 41168, NE Corner 1st Ave. & Maryland. 5. Unplatted commercial zone area adjacent to Village Sub. A motion was made by Lonnie Kellogg, seconded by , that the above tracks be annexed It was recommended that the City Council consider-a motion-to that effect. DISCUSSION ON CONSIDERING REQUIRING BUILDING PERMITS/INSPECTIONS ONE (1) MILE OUTSIDE OF CITY LIMITS. It was recommended that the permits and inspection area not be extended the one (1) mile at this time, however it is proposed that the area of the Laurel Airport be covered by the City Building and Inspection Codes. The Planning Board will make a recommendation to the City Council that the specific request for a home occupation designation be granted or denied. 4. The City Council will consider the Planning Board's re- commendation concerning the specific home occupation designation and approve or deny it at their next regularly scheduled meeting. Attendance by the applicant or his /her representative is required at this meeting.
