HomeMy WebLinkAboutBoard of Adjustment Minutes 04.12.1983BOARD OF AD.IUSTM NT LAUREL, MONTANA 69044 April 12, 1983 Meeting called to order at 7:31 p~m., with the following members present: Bonnie Preikszas, James Smit~, Andy Muri, Dick Michel and Don Cahill Others present: Dale T. Blom, 1812 E. 8th Street, Laurel George A. Strand, 408 W. 2nd Street, Laurel Margie Gough, Cumin Associates, Billings Clark Johnson, Laurel Bill to Laurel Outlook in the amount of $24.00 for advertising for public hearings approved for payment. PETITION #83-1 STRAND: A variance has been requested on the W40' of Lots 9 and 10, and:on the N15' and W40' of Lot 8, Block 5, East Laurel Subdivision, R6000 zone, to allow a variance in the lot line setbac~ and lot size restrictions for the purpose of adding an attached garage. The property is located at 408 West 2nd Street, Laurel. Fee has been paid. Notice publi, shed in the Outlook on March 23 and 30th, 1983. Notices sent to adjacent property owners. No protests. Cumin Associates says this is'an appropriate request. Petitioner present. He wants to build an attached garage near to the lot line. Transfer of land has been done (the 15x40' piece) and the Certificate of Survey is in the process. Discussion. Motion from Bonnie Preikszas to grant the variance depending on the Certificate of Survey being recorded, seconded by Andy Muri. Motion carried with the vote being 5 for, 0 against. Petitioner will be notified by mail of the Board's decision. PETITION #83-2 BLOM: A variance has been requested on C/S 474 in Lot 27, Nutting Bros. Subdivision, Yellowstone County, Montana, Community Commercial Zone, to allow one mobile home to be placed thereon. The property is not large enough for a zone change. The property is located at 1812 E. 8th Street, Laurel. Fee has been paid. Notice published in the Outlook on March 23 and 30th, 1983. Notices sent to adjacent property owners. No protests. Petitioner present. Mr. Blom's mother wants to retire this spring, and the only way she can retire is to move off the Casa Village lot in Billings and move her mobile home somewhere where there is no lot rent. Discussion of Community Commercial zone. This is an unusual situation involving land use. Present home was already there when petitioner purchased land about three years ago. Cumin Associates recommends denial~ Mobile home would be on a septic tank and well. Motion from Andy Muri to grant the variance but restrict the variance to a life estate or as long as Mr. Blom's mother is to occupy the mobile home~ with the ~ariance reversing in case of sale of the property, seconded by Dick Michel. Motion carried with the vote being 5 for, 0 against. Petitioner will be notified by mail of the Board's decision. Meeting adjourned 8:09 p.m.
