Bills approved for payment: Engineering Department in the amount of $400 for administrative services in August and September; Cumin Associates in the amount of $3,375 for planning advisory services for July, August and September as per agreement. HOME OCCUPATIONS: Ken Szillat, 1173 Ridge Drive, Laurel, wants to build a garage fbr his heating business. Area is zoned residential. Other homes have garages other than house. 90% of his business is in Billings. He wants to build duct work in his garage. Will use a sheet metal block and cutter for sheet metal. No supplies stored in structure. Area is Re-20,000 outside of City limits but within the 1-mile zoning jurisdiction. He will file proper form and come back to October meeting. Jean M. Shay, 605 7th Avenue, Laurel, has put up a garage and wants to donate part of building to a doll museum. No charge for admittance. Wants to know if she can sell dolls. Cumin asked if there are any covenants against business in her subdi- vision. No. Dolls are of museum quality. She must meet all regulations as far as signs, etc. Cumin has no objections. Motion from Marvin Carter to recommend approval, seconded by Hal Dantic, carried with Gerald Shay abstaining. FILE #PB84-15: Application for annexation, zone change to RMH and preliminary plat approval of Village Subdivision, 3rd Filing, An addition to the City of Laurel, located in the N2, Sec. 11, T23, R24E, MPM, to be known as Lots 1--10, Block 1. The proposed sub- division is located east of Village Subdivision, Phase II. Ken Tolliver explained this request is so that utilities can all be put in at the same time as Phase II. 0 iI I%11 .. tl C1.. ! c Comments from Larry Peterson, Director of Public Works, as follows: 1) Only 3 garbage containers will be required - not 7; 2) The plat shows a drainage easement across Lot 6. The City needs this easement to extend a logical distance beyond the flood control dike and we need to have a written description of the permanent easement being given; 3) The ditch should be culverted and not left open. Mr. Tolliver.does not anticipate a future development until culvert under railroad is made larger. Some type of commercial development may take place in the SW/corner at some point in the future. There are now 30 trailer homes on Phase II. Jim Kraft, Floodplain Administrator, states t major flooding has been addressed and, in all from the entire subdivision." Cumin recommends approval. Motion from Bus Roberts..to recommend approval change, seconded by Marvin Carter. Council FILE #PB84-16 GEISEN: A zone change has been requested on Tr. 1, /S 42207, Yellowstone County, MT, from RE-20,000 residential zone to allow RMH Residential Mobile Home zone. The owner proposes one or two mobile homes for residential use only. The property is located one mile from Laurel City limits on Valley Drive. Perc tests have been done. Protest from Sam Cain that trailers devalue on-site homes in the area. There are 4 trailers on Valley Drive, 1 is in.the immediate vicinity of t-he proposal. 3 other protests received. None of the protests are within the 150' protest • area. Cumin recommends approval. Site is big enough, no conflicting use. Motion from Marvin Carter to recommend approval, seconded by Ed LaPrath.. Carried with Joe Bradley abstaining. Council will act, after publication, on October 16th. ROGER ANDERSON has said he is going to make his subdivision legal so the County Attorney has dropped the suit against Mr. Anderson. To this point he has not proceeded. TOM DAUGHERTY was in last month to request condos. If the land is already subdivided, the board will not take action. DEBBIE LINGER's cake decorating business has received a letter from the Health Department which says she must have separate entrance and facilities. She has dropped her request. COUNTY--WIDE PLANNING BOARD reported on. The County adopted county-wide planning. There will be 7 areas. Discussion on when to cut off protests so it may be determined if protests are legal. Procedure 1. Complete home occupation request form and submit it to the City seven (7) working days prior to a regularly scheduled meeting of the Planning Board. 2. The Planning Board will consider the request at their regu- larly scheduled meeting. Attendance at this meeting is required by the applicant or his /her representative. 3. The Planning Board will make a recommendation to the City Council that the specific request for a home occupation designation be granted or denied. 4. The City Council will consider the Planning Board's recom- mendation concerning the specific home occupation designation and approve or deny it at their next regularly scheduled meeting. Attendance by the applicant or his /her represent- ative is required at this meeting. Nti4 ,,:.,-52e,,,,..)-",--1 j Fa » , y :.r.:; Aug. l7th,1984 Laurel City Planning Board: It is my hope to open a Doll Museum here at our residence at 605 7th Ave. We built our new garage with this in mind, and it is designed so that my collection can be displayed and enjoyed by anyone who carets to see the dolls. Having collected and studied dolls most of my life I have quite an extensive collection ranging from antique to modern and I have some 'one of a kind' dolls that are very interesting. I will be happy to show the collection to clubs, classes and other doll collectors. There will be no charge to visit the museum, but I will have a jar for donations if anyone cares to help with the cost of the lights, heat, etc. Because some of my dolls are made of wax I do have to have heat control in the building. I will have the museum open by appointment. There are two very talented doll artists in Billings who have agreed to come out and have workshops on doll making and dressing if there is enought interest shown. I really do feel that there is a lot of interest in this area concerning dolls and collecting them for a hobby. There is a,.,Do11 Museum located 18 miles out of Great Falls and the owner, Mrs. Geneva Collins has been a dear friend and has been very helpful in telling me how to arrange the dolls and display them to make them more interesting. Question #2 on the request form asks if any stock in trade will be sold. Actually, I won't be a dealer but I would like to be able to sell some of the dolls that I have duplicates of or that I no longer want and would sell to get new ones. A lot of my dolls are collectors dolls that are made in limited numbers. In order to get these dolls you must -get your name on a dealers list. Sometimes I have to wait as long as two years to get a certain doll. If I don't update my list with all the dealers then once in a while I will get the same doll from two differnt dealers. Since I don't need two dolls just alike I sell the duplicate doll. If you return a doll you lose your deposit so its easier to sell to another collector through a doll club or publication or to trade the duplicate doll for one I don't have. So these would be the dolls that I would be selling. I wouldn't actually have any stock or as I mentioned before I wouldn't be a dealer, however I could tell people where the dolls they like can be purchased. There shouldn't be any complaints about noise or traffic, and I don't think the neighbors would have any complaints. there is plenty of parking in our driveway and along the street from the alley to the corner so it would not inconvenience anyone. Thank you, Mrs.Jean Shay 605 7th Avenue Laurel, Mt.59044 RESOLUTION CREATING COUNTY PLANNING BOARD WHEREAS Section 76 -1 -104, Montana Code Annotated allows for the establishment of a county planning board for the area outside of the incorporated limits of cities, towns and jurisdictional planning areas, and WHEREAS the City- County Task Force on Planning did, on May 1, 1984, pass a motion requesting the Board of County Commissioners to pass a resolution of intention to form such County Planning Board and to provide the affected electors with notice thereof as required by statute, and WHEREAS the Board of County Commissioners by resolution gave public notice of their intent to create such planning board and of a public hearing thereon by publication of notice of the time and place of hearing on such resolution in each newspaper published in the county not less than 15 or more than 30 days prior to the date of hearing, and WHEREAS a public hearing on the Commissioners' intent to establish a County Planning Board was held on the 19th day of June, 1984, at 7:00 o'clock p.m. in the County Commissioners' Board Room, room 403, Yellowstone County Courthouse, Billings, Montana, and WHEREAS within sixty (60) days of the public hearing only nine letters protesting creation of county -wide planning were received, and WHEREAS the nine protests do not constitute a majority of the qualified electors of the county residing outside the limits of the jurisdictional area of an existing city- county planning board established pursuant to 76 -1 -504 through 76 -1 -507 and outside the incorporated limits of each city and town in the county; — NOW, THEREFORE, IT IS HEREBY RESOLVED that: 1. The Board of County Commissioners hereby establish a County Planning Board for the area in Yellowstone County outside the incorporated limits of Billings, Broadview and Laurel and outside the 41 mile jurisdictional area surrounding Laurel. 2. The County Planning Board is created in accordance with and has the applicable powers set forth in Title 76, Chapters 1 and 2 of the Montana Code Annotated. DONE this 2A day of August, 1984.
