Minutes of previous meeting approved.
HOME OCCUPATIONS:
Steve S. Jamison, 101 So. 4th Street, Laurel, requests a home occupa-
tion for concession trailer sales. This is a 9x121, baked enamel
trailer, parked at home in back yard. Trailer will be moved to
c various places such as baseball games, parks or wherever we are
allowed to sell.. We will be selling pop, candy, snacks, etc., maybe
beer in some places. Motion from Ken Christian to recommend approval
for a City license, seconded by Jim Straw. Passed.
Debbie R. Linger, 103 Mountain View Lane, Laurel, requests a home
occupation for cake decorating and custom designing of silk flowers.
County of Yellowstone, Environmental Health-Division, will not allow.
Motion from Bus Roberts to recommend approval subject to County Health
approval, seconded by Ed LaPrath. Passed.
Cynthia L. Peterson, 1030 7th.Avenue, Laurel, requests a home occupation
of a daycare center. Read State regulations regarding registration of
such. Debate.and discussion about Planning Board's obligation to allow
or not allow violations of certain subdivision covenants - consider as
a topic of needed regulation. Complaints about other day care centers
arose. .Mrs. Peterson was asked to apply through "special review" process.
There was strong position by landowner, Duane Steiner, for our support
of the subdivision covenants.

FILE #PB 84-13A RIDER: Hearing carried over from July 12th. A
variance has been requested on Lots 1, 2, 3, and 4, Block 28, East
Yellowstone Subdivision, RLMF zone, to allow a mobile home to be
placed on these lots. The property is located at 101 So. 4th Street
next to the railroad tracks, Laurel, MT. Bob Rider present represent-
ing Lorraine Rider, his mother.. Wants one mobile home placed on
these lots for himself. There are 6 trailers already in that area.
No objection from Cal Cumin.. Motion from Marvin Carter to recommend
approval, seconded by Bus Roberts. Passed.
FILE #PB 84-14 PELICAN: A special review has been requested on Lot
36, Block-30, ast e lowstone Subdivision, Amended, HC zone. Frank
Pelican has applied-with-the Department of Revenue, Liquor Division,
for a floating all-beverage liquor license. The property is located
at 216 So. 1st Avenue, Laurel, MT. (old Suds Hut) Joyce Bratton
represented Pelican. They are appealing the decision for liquor
license to Happy Gardens. -Motion from Joe Bradley to recommend
approval of the special review, seconded by Ken Christian. Passed.
TOM DAUGHERTY appeared asking about-building a 26-unit townhouse.
Wants to build 16 at first. -Joe Bradley indicated that the Attorney
General has deemed it necessary to have Planning Board make recom-
mendation by a plan review.. Cal Cumin will check on this and report
back to Mr. Daugherty.
ROGER ANDERSON UPDATE: Cal Cumin reported the hearing was postponed.
LARRY MYERS UPDATE: Litigation going on.
ELECTIONS: Motion from Joe Bradley,-second by Marvin Carter, to
reappoint Gerald Shay as our Member-at-Large. Passed.
Motion from-Joe Bradley to retain John Hawley Smith as President and
R.-M. Williams, as Vice President, and to elect Gerald Shay as Execu-
tive Secretary, seconded by Ken Christian. Passed.

Dear Pat:
I have enclosed a copy of a letter sent to Debbie Linger
in regards to operating a food service business in her home.
This office receives numerous requests of this nature,
one as recently as August 6, 1984. It would not be possible
to inspect a private home on a routine basis and insure the
sanitary conditions of food preparation. It is difficult
enough to accomplish this with the licensed businesses in
commercial buildings.
We do not concern ourselves with temporary activities
such as school bake sales, church bazaars, Fourth of July
food sales, etc., since they are temporary and not a continuous
business activity.
I hope this will assist you in understanding our position.
When I have the opportunity, I will visit your office. Thanks.
