Minutes of previous meeting approved as sent out. Billsfor Public
Works Department in.-the amount of $200 for Administrative Services in
March; Cumin Associates in the amount of $3,375 for Planning Advisory
services for January, February and March, 1985, as per agreement.
PUBLIC HEARING - PB#85-01 BERNHARDT: A zone change has been requested
on the N NE Section 15, M, R2 E, PMM, Yellowstone County, from
Agricultural zone to allow Residential Mobile Home (RMH) zone. The
owner proposes a residential manufactured housing subdivision. The
property is-located SW of intersection of Stra__uch Road and Roundhouse
- ? - - ? ver present.

Bob Miller presented the plan for zone change designed by Christian,
Spring & Sie]bach Associates. Larry Lockrem and Bernhardts wish to
trade land and Lockrem can then develop property. Homes will be on
standard foundations and won't look like mobile homes. Mr. McGee
presents soils, et,c. Current land use is farming. School children
would be in precinct-growth by approximately 250 students. Taxes are
now $300 - would be approximately $240,000 in taxes. Park would be
5--6 acres in NW corner. Developer doesn't want annexation at this

time. Will sign waiver of annexation. Water and sewer are nearby.
Proposes that water line will be replaced by developer in part through
negotiation with City. Roads will be paid for by developer. Develop-
ment would create 1;00 vehicle trips per day. There are plenty of gas
lines, electricity, etc. to serve the subdivision. Developer proposes
that the 18" BN line could be used for the benefit of City and the sub-
division. Developer says the land is not prime aiz,,-icultural land.
Phase I would be 175 lots - 25% are spoken for now (44 spots approx.).
All work would be done to City specifications. Would be overseen by
Department of Housing & Urban Development. 50% would be retired persons.
Garbage would be done by City or could be private hauler. Owner of
Yellowstone Sanitation .says City can't pick up for 5 years. Ditch would
probably be piped. Negotiations would take place between ditch company
and developer. Ernie Davis questioned the water line and sewer line.
They are in bad shape. Property is in Laurel fire district.
Cal Cumn went through the 12 points of zone change criteria. Developer
answered
Lots will not be rentals.
Donellaa Braswell questioned prime agricultural zone. Taxes on 14x80 home
erry Krum asked about traffic. Mrs. Krum asked about traffic and
sewer.
Lydia Sekora had land classed as Al farm land.
Letter from Jim Flisrand, Director of Public Works, read into record:
1. The present zoning is Agricultural with a portion of each
quarter of that section being zoned Industrial. All cities should
promote and encourage industrial growth. The property in question,
with the existing utility easement and close proximity to the inter-
state and railroad, is a prime industrial area.
2. Access to the property is a major concern with both the
police and fire departments. The two "plus" miles from the downtown
core area would be a burden for all departments within the City. The
nearest point from said property to the outer City limits is one--half
of a mile. During the winter months the county roads used for access
to this property are, at times, snowbound.
3. The 10--inch water line referred to as existing is 8-inch in
areas and is not capable of more than 30 PSI without leakingtionhe line
has been disconnected at the south end due to its poor

Motion from Joe Bradley to recommend denial, seconded by Grace Edwards.
Bus Roberts left before vote. Motion carried with 6 for, and Marvin
Carter voting against. This now goes to Council for final recommendation.
DENNIS JOHNSTON BIG SKY HAUL-AWAY: Needed signatures of the planning
board to enable him to fulfill the requirements set by the State of
Montana regarding a proposed landfill site approximately 60 acres in
size approximately 112 mile from the existing Laurel landfill.
Motion by Joe Bradley, second from Merritt Williams, to approve the
application. Passed. Hearings will be required.
There will be a hearing on the Laurel Planning District soon.
Ken Tolliver, BNRR and the City should get together and settle the
Nutting Drain issue.
Ed LaPrath talked about his Mathis subdivision on 14th.

on the NINE4 Section 15,

Gentlemen:
A pre-application conference was held January 7, 1985, at the
City Hall in Laurel concerning a residential manufactured housing
subdivision. The property concerned is the NJNE'4' of Section 15,
with the owners being William and Gladys Bernhardt. The developer,
Larry Lockrem from Christian, Spring, Sielbach & Associates, indi-
cated they would prefer to annex the property to the City of Laurel
and use the existing 18-inch sewer and 10-inch water lines running
adjacent to the west edge of said property.
Realizing the existing problems we are having, my concerns on
this subdivision are as follows:
1. The present zoning is Agricultural with a portion of each quarter
of that section being zoned Industrial. All cities should promote
and encourage industrial growth. The property in question, with
the existing utility easement and close proximity to the inter-
state and railroad, is a prime industrial area.
2. Access to the property is a major concern with both the police

The line has been disconnected at the south end due to its poor
condition.
To recap, the property in question would make a suitable
industrial site for industries capable of incorporating their own
fire prevention system. Access to the property in an emergency or
non-emergency situation is a major concern. Prior to any improvement
of that property requiring city water, a new water line would be
required from Shannon Road to the water treatment plant.

WILLIAM J. BERNHARDT having petitioned for a zone designation of
RMH on the following described premises: NNE Section 15, T2S,
R24E, PMM, Yellowstone County.
At a meeting of the Laurel - Yellowstone City- County Planning Board
held on March 14, 1985, after public notice and a public hearing
having been held, the Board recommends to the Laurel City Council
that the petition for a zone designation of RMH in the above matter
be denied.
