HomeMy WebLinkAboutCity Council Minutes 10.05.1999MINUTI.:S OF THE CITY COUNCIL OF IAURF-L October 5, 1999 A regular meeting of the City Council of the City of Laurel, Montana, was held in the Council Chambers and called to order by Mayor Chuck Rodgers at 7:04 p.m. on October 5, 1999. COUNCIL MEMBERS PRESENT: Dirk Kroll Ken Olson Gay Easton Bill Staudinger Gary Temple Norman Orr Bud Johnson COUNCIL MEMBERS ABSENT: Miles Walton Mayor Rodgers asked the council to observe a moment of silence in behalf of the family of Miranda Fermer. MINUTES: Motion by Alderman Staudinger to approve the minutes of the regular meeting of September 21, 1999, as presented, seconded by Alderman Orr. Motion carried 7-0. CORRESPONDENCE: Montana Department of Commerce memo: Information. Budgets and the Certified Mill Levy PUBLIC HEARING ON THE 1999-2000 PRELIMINARY BUDGET AND TAX RESOLUTIONS: Mayor Rodgers opened the public heating. Mayor Rodgers asked if there were any proponents. Mary Embleton, City Clerk-Treasurer, stated that the council had already reviewed the Preliminary Budget that was distributed on September 21st. There were a few revisions because the initial taxable valuation for newly taxable properties was incorrect as issued by the Department of Revenue. The State had only looked at Class 4 properties, which are residential and commercial properties, and they did not take into account any other classes of property such as pipeline, personal, and centrally assessed property. After receiving the revised figure on Friday, October 1st, Mary revised the revenue figures for mill levy funds. Last year the value of the mill was at $6,873, but it dropped to $6,708 this year. The total mills will increase 1.38 mills this year. Mary distributed six charts which showed the City of Laurel Appropriations for the following funds: General Fund; PERS, Comprehensive Insurance, Police Insurance, Employee Health Insurance; Water, Wastewater and Solid Waste; State Gas Tax, Street Maintenance and Sweeping; and Light District #2 and Light District #3. Alderman Staudinger thanked Mary for her presentation. Mayor Rodgers thanked the council for hiring Mary for the Clerk-Treasurer position, and he thanked her for doing an outstanding job. Mayor Rodgers asked if there were any opponents. There were none. Motion by Alderman Temple to close the public hearing, seconded by Alderman Staudinger. Motion carried 7-0. CONSENT ITEMS: a. Claims for the month of September in the amount of $288,055.62. b. Committee Reports. --Laurel Airport Authority minutes of August 24, 1999 were presented. --Budget/Finance Committee minutes of September 20, 1999 were presented. Council Minutes of October 5, 1999 --City Council Committee of the Whole minutes of September 21, 1999 were presented. c. Resolutions. 1) Resolution No. R99-42: Being a resolution levying and assessing a special tax against certain property in the City of Laurel for any unpaid sewer charges. 2) Resolution No. R99-43: Being a resolution levying and assessing a special tax against certain property designated as garbage districts in the City of Laurel, Montana, for the removal of garbage and refuse. 3) Resolution No. R99-44: A resolution levying and assessing all of the property embraced within Special Improvement District No. 110 of the City of Laurel, Montm~a, with the cost of street paving, curb and gutter, and storm drain facilities in Murray Heights Subdivision. 4) Resolution No. R99-36: Being a resolution levying and assessing all of the property embraced within Special Improvement District Light No. 2 of the City of Laurel, Montana, with the entire cost of maintenance and electrical current for the fiscal year, 1999 - 2000. 5) Resolution No. R99-37: Being a resolution levying and assessing all of the property embraced within Special Improvement District Light No. 3 of the City of Laurel, Montana, with the entire cost of maintenance and electrical current for the fiscal year, 1999 - 2000. 6) Resolution No. R99-38: Being a resolution levying and assessing all of the property embraced within the City of Laurel, Montana, for street maintenance for the fiscal year, 1999 - 2000. 7) Resolution No. R99-39: Being a resolution levying and assessing all of the property embraced within Street Sweeping District No. 1, of the City of Laurel, Montana, for the purpose of the sweeping of streets in the downtown or business district for the fiscal year, 1999 - 2000. The mayor asked if there was any separation of consent items. There was none. Motion by Alderman Johnson to approve the consent items as presented, seconded by Alderman Orr. Motion carried 7-0. SCHEDULED MATTERS: a. Confirmation of Appointments. None. b. Joe Leckie: Ordinance to increase the Judge's salary. Does not require coar~cil action at this time. c. Approve 1999 - 2000 Preliminary Budget and Tax Resolutions. Motion by Alderman Johnson to adopt the 1999 - 2000 Preliminary Budget and Tax Resolutions, seconded by Alderman Olson. Motion carried 7-0. Resolution No. R99-41: Being a resolution levying taxes for general and specific purposes for the City of Laurel, Montana, for the fiscal year beginning July 1, 1999. RESOLUTION NO. R99-41 BEING A RESOLUTION LEVYING TAXES FOR GENERAL AND SPECIFIC PURPOSES FOR THE CITY OF LAUREL, MONTANA, FOR THE FISCAL YEAR BEGINNING JULY 1, 1999. Council Minutes of October 5, 1999 Motion by Alderman Olson that Resolution No. R99~41 be passed and adopted, seconded by Alderman Johnson. Motion carried 7-0. UNSCHEDULED MATTERS: a. Police Oversight Task Force. Mayor Rodgers appointed Aldermen Ken Olson, Norman Orr and Gay Easton to the Police Oversight Task Force. Alderman Olson will be the chairman of the Police Oversight Task Force. b. Resolution No. R99-45: A resolution declaring an emergency for the immediate construction of the cemetery maintenance building. RESOLUTION NO. R99-45 A RESOLUTION DECLARING AN EMERGENCY FOR THE IMMEDIATE CONSTRUCTION OF THE CEMETERY MAINTENANCE BUILDING. Motion by Alderman Orr that Resolution No. R99-45 be passed and adopted, seconded by Alderman Johnson. A roll call vote was taken on the motion to adopt Resolution No. R99-45. All aldermen present voted aye. Motion carried 7-0. c. Alderman Staudinger requested permission to be out of town for an extended period of time. Motion by Alderman Johnson to grant permission for Alderman Staudinger to be out of town for an extended period of time, seconded by Alderman Kroll. Motion carried 7-0.
