July 232 Pursuant to the laws of Montana-.and also upon the special call of the Mayor, a special meeting of the City Council of the City of Laurel, Yellowstone County, Montana, was held, in the Council Chambers in the City Hall, the usual meeting place on Monday, to-wit: the 23rd day of .July; A. D., 1923, at the hour of 8 oT clock, P. ICI., at which there were present on roll call, the following Mayor H. A. Carlisle City Clerk T, A. Rigney Councilmen B. L. Price B. B. Hageman 0. M. Wold H. C. Knudsen Ed Gum Charles E. Perry J. F. Nicola Absent: R. E. Coy The following proceedings, among others, were had and taken, to-wit: The Clerk thereupon presented and read the notice of the meeting, together with proof of service thereo, which said notice and proof of service were and are in words and figures as follows: Laurel, Montana, July 21, 1923. To the members of the City Council of the City of. Laurel, Montana, GREETING: You and each of you are hereby notified that a special meeting of the City Council of the City of Laurel has been and hereby is called and ordered to be held in the Council Chambers in the City Hall, the usual meeting place, on Monday, the 23rd day of July, 1923, at the hour of 8 oI clock P. M., for the puxpose of canvassing the returns from the special water works bond election, held in said city July 21, 1923, and if it be ascertained that said election has carried by the requisite majority, at said meeting there will also be presented for consideration and final passage an ordinance declaring the result and validity of said election and providing for the advertisement and sale of $40,000.00 of bonds to replace worn out water mains and $15,000.00 of bonds to construct a settling basin for the municipal waterworks system. Further at said meeting any other appropriate action with reference to said matters will be taken. Done at Laurel, Montana, this 21st day of July, 1923. H. A. Carlisle Mayor. • B. B. STATE OF MONTANA } COUNTY OF YELLOWSTONE) 33. CITY OF LAUREL ) . it the undersigned Chief of Police of the City of Laurel, Montana, do hereby certify that I duly served the above and foregoing notice on the 21st day of duly, 1923, by delivering in said city a true copy of said notice to each and every of the eight councilmen of the said city. WITNESS my official signature affixed this 21st day of duly, 1923.. 0. C. Bundy Chief of Police. Upon motion duly made, seconded and carried, the Clerk was instructed to insert said notice, with proof of said service, as a part of the minutes of said meeting. The Clerk thereupon presented the returns from the special waterworks bond election held in said city on the 21st day of duly, 1923, and council proceeded thereon to canvass said returns, from which it appeared that the ballots cast upon the questions submitted at said election were as follows: First question submitted, relating to the issuance of 440,000.00 bonds: Ballots cast "BONDS - - - YES" 44 Ballots cast "BONDS - - - NOTT 8 Total ballots cast - - - - - - 52 Second question submitted, relating to the issuance of $15,000.00 bonds: Ballots cast "BONDS - - - YES" 28 Ballots cast "BONDS - - - NO'T 22 Total ballots cast - - - - - 50 Thereupon Councilman 0. Ivi. Viold introduced a pro- posed ordinance entitled: "An ordinance declaring the result and validity of the special water works bond election held in the city of Laurel, IvIontana, Saturday, duly 21, 1923; providing for the advertisement and sale of the negotiable coupon bonds of said city to the amount of $40,000 for the purpose of providing funds with which to replace worn out watermains of the municipal water works system, and the negotiable coupon bonds of said city to the amount of 415,000 for the purpose of providing funds with which to construct a settling basin for the municipal water works system.; and declaring an emergency." Under the direction of. the Mayor said ordinance was read in full by the City Clerk and considered by said council. Thereupon Councilman U. C. Knudsen moved that any and all rules of the council requiring ordinances to be referred to a committee and taken under advisement until the next regular meeting of the council, and any and all rules which would, unless suspended, prevent the final passage of said ordinance at this meeting be suspended, and that said proposed ordinance so introduced and read, be further read a second and a third time fully and dis- tincly at length at this meeting and placed upon its final passage. The Mayor stated the motion and put the question,. upon the suspension of the rules as aforesaid, and the vote upon said question was as follows: Those voting "AYE"s Councilmen, B. L. Price B. B. Hageman 0. TAI. Wo ld H. 0. Knudsen Ed Gum Charles E. Perry J. F. Nicola Those voteing "NO": None Absent and not voting Councilmen; - R. E. Coy The Mayor then declared that said motion had duly carried by the unanimous assent of all members of the City Council present, and under the motion, directed the clerk to read the-Ordinance the second time. The Clerk read the Ordinance the second time, fully and distinctly at length. The Mayor stated, under the motion, that the Ordinance stood for third reading, and directed the Clerk to read the Ordinance the 'third time, and the Clerk so read the Ordinance. The Mayor stated, under the motion, that said pro- posed Ordinance had been read the third time fully and dis- tinctly at length, and might now be placed upon its final passage. Thereupon Councilman B. B. Hageman moved that said proposed ordinance do finally now pass as read. Said motion was duly seconded by said Councilman H. C. Knudsen and the question being on the final passage of said ordinance under the direction of the Mayor the Clerk called the roll, the vote up.Qn the final passage of said ordinance resulted as follows, to-wit: _W Those voting.t'AYE": Councilmen, B. Coy The Mayor declared said Ordinance had finally passed, the same was numbered 268 and the Clerk was directed to make proper record thereof, Ordinance No. 268 having finally passed, the same was presented to the Mayor for his approval, and the Mayor, having fully considered the same, thereupon, in open session of the city council, duly signed and approved said Ordinance No. 268.. Ordinance No. 268 was thereupon ordered to be redorded in Ordinance Book No. _,.of said city, and was thereafter duly Minutes of the City Council of Laurel Laurel, Montana, Wuly 23, 19230 recorded therein at pages to inclusive. Thereupon the Councilman H. C. Knudsen introduced, read and moved the adoption of the followingresolution, to-wit: RESOLUTION NO. 280. "Be it resolved by the City Council of the, City of Laurel, Montana, that a true copy of Ordinance No. 268 of the City of Laurel, passed and approved this 23rd day of June, 1923, and this resolution each be posted on the 24th day of June, 19231 by the City Clerk in the following public and conspicuous places, to-wit: One copy at the entrance to Tourist Park, in first ward. One copy at the City Hall, in second ward. One copy on the Hall Lumber Co. Fence, in third ward. One copy on N. P. Hotel fence, in fourth ward.. APPROVED: July 23, 1923. H. A. Carlisle Mayor. Rigney, City Clerk of the City of Laurel, Montana, do hereby certify that on the 24th day of July, 1923, I posted a true copy of the above and foregoing in each of the following public and conspicuous places in said city, to-wit; One copy at entrance to Tourist Park, in first ward. One copy at City Hall, in second ward.. One copy on Hall Lumber Co. fence, in third ward. One copy on N. P. Hotel fence, in fourth ward. In witness whereof I have hereunto set my hand and affixed the corporate seal of said city this 24th day of July, A. D., 1923. T.. A. Rigney City Clerk. II The motion for the adoption of the foregoing was duly seconded by Councilman Ed Gum and' the question being upon the adoption of said resolution, under the direction of the Mayor the Clerk called the roll with the following result: Those voting "AYE" Councilmen, B. Coy The Mayor declared said resolution duly adopted, and the same was in open session of the Council, si.gn.ed and approved by the Mayor, and sealed and attested by the City Clerk.
