A special meeting of the city council of the city of
Laurel, Yellowstone County, Montana, was held in the Council
Chambers (the usual meeting place), in said city, on Tuesday,
the 16th day of betober, A. D. 19239 at the hour of 8 olclock
P, M., at which there were present:

The clerk thereupon presented and read the notice of
the meeting, together with proof of service thereof, which said
notice and proof of service were and are in words and figures, as
follows

Laurel, Montana, GH 'ETRIG:
You and each of you are hereby notified that a meeting
of the city council of the city of Laurel has been and here is
called and ordered to be held in- the Council Chambers in the City
Hall, the usual meeting place, on Tuesday, the 16th day of October,'
1923, at the hour of 8 of clock P. M,, for the prupo se of con- .
sidering and adopting an ordinance providing the form and author-
izing and directing the issuance and delivery of?40,000 water-
works bonds for water mains, and $15,000 waterworks bonds for a
settling basin, in said city, and levying an annual ad valorem
tax sufficient to pay the principal and interest of said bonds
as same respectively mature.
Further at said meeting any other appropriate action
with reference to said matters will be taken.

moved the adoption of the following ordinances

"AN ORDINANCE PROVIDING FOR THE ISSUANCE, EXECUTION
AND DELIVERY TO THE LAWFUL PURCHASERS THEREOF OF THE
FOLLOWING 6%BO14DS OF. THE CITY OF LAUREL, YELLOWSTONE
COUNTY, MONTANA, TO-WIT: $40,000 WATF,FWORkS BONDS,
SERIES At FOR THE CONSTRUCTION OF MATER ItiAIN6 IN AND
FOR SAID CITY AND $15,000 WATERWORKS BONDS SERIES B,
FOR THE CONSTRUCTION 01' A SETTLING BASIN FOR THE

WHEREAS, in accordance with Ordinance No, 268 of said
City, notice of intention to issue and sell X40,000 Water Mains
6% bonds, $15,000 settling basin 6o bonds at public auction to
the bidder offering the highest price therefor, was duly pub-
lished once each week for a period of four consecutive calendar
weeks, in "The Laurel Outlook," a weekly newspaper printed,
published and of general circulation in said cit, commencing
August l5th, 1923, and in "The New York Herald,`" a daily news-
paper printed and published in New York city and having a general
circulation in financial circles throughout the United States, in
the issues thereof of August 16th to September 13th inclusive,
and evidence of such publishing has been furnished to the city
Council by the city clerk in form of publishers' affidavits; and,
WHEREAS, each issue of bonds aforesaid was on the 14th
day of September, pursuant to the advertised notice of sale afore-
said, by the city council, and at public auction, duly awarded,
bearing 6% interest, to Crosby, McConnell and Company of Denver,
Colorado and Stern Brothers and Company of Kansas City, Missouri,
who were the highest and best bidders therefor, at a price ex-
ceeding the par value of said bonds together with all accrued
interest thereon to date of deliver; and
WHEREAS, it is the duty of said council under the law, to
issue said bonds for the purposes aforesaid, and to cause them to
be delivered to said purchases; Now, Therefore, in consideration
of the premises,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
LAUREL, YELLOWSTONE COUNTY, MONTANA; AS FOT1017S:
Section 1. That it appears to the city council of said
city, that it would be and is hereby deemed necessary to extend
the 3% debt limit and to borrow the sum of Forty Thousand Dollars
040,900) and issue bonds of said city therefor, for the purpose
of replacing worn out wooden water mains and to extend the 3W/ del7t
limit of said city and borrow the sum of Fifteen Thousand Dollars
(015.,9000) and issue bonds of the city therefor, to construct a
settling basin, which water mains and settling basin shall be a
part of the water works plant of said city and shall be owned and
controlled by said city and the revenue derived therefrom shall

be devoted to the payment of said bonds.
Section 2. That in order to borrow money with which
to replace worn out wooden water mains in and for said city, as
mentioned in section': l hereof, there shall be and there are
hereby authorized, ordered and directed to be issued and deliver-
ed to the purchasers thereof aforesaid, the negotiable water main
bonds of said city, to an amount aggregating the principal sum of
x'40,0002 which shall be known as and designated "Waterworks
Bonds, Series A"- shall be forty in number, numbered consecutive-
ly from One to forty, of the denomination of $1,000 each; shall
bear date of July 1, A. D.1923 shall become absolutely due and

the rate of six (6) per centum per annum, payable semi-annually on
the first days of January and July, respectively, in each year,
which installments of interest to date of maturity of principal,
shall be evidenced by appropriate coupons to be attached to each
bond; and both the interest accruing on and the principal of said
bonds, shall be payable in lawful money of the United States of
America, at the Banking House of Yountze Brothers, in the city and

at the rate of six per centum per annum,-payable semi-annually on

purpose, prior to the issuance of this bond, at which election a
majority of all of the qualified tax paying electors present and
voting thereat voted in-favor of the issuance of this bond; and
under, by virtue of and in all respects in full and strict com-
pliance with the constitution, Chapter 57Part IV, Revised Codes
of Montana, 1921, all laws amendatory thereof and supplementary
thereto, and an ordinance-of the City Council of said City duly
adopted prior to the -issuance of this bond,
. And it is hereby certified, recited and warranted that
said city has been for some years past and is now a body politic
and corporate, with the general powers of a corporation, duly ,
organized, existing and operating as a city under and by virtue
of the constitution and the general laws of the state; and is now
and always has been under the control of a duly organized city
council as the duly constituted corporate authority thereof; that
all things, acts and conditions rec1uired by the constitution and
laws of the state of Montana to exist and to happen and be done
and performed precedent to and in the issuance of this bond, in
order to constitute the same the valid and binding obligation of
said City, do exist and have ha:=opened and been done and performed
in regular and due form and time; that the total indebtedness of
said city, including this bond, does not exceed any constitutional
or statutory limitation; and that due provision has been made for
the ley.y, assessment and collection of a direct annual ad valorem
tax on all of the taxable property of said city, in addition to
all other taxes, to create a fund sufficient to pay the interest
accruing upon this bond promptly when and as the same becomes due
and to establish a sinking fund with which to discharge the prin-
cipal hereof at maturity.
The faith, credit and all of the taxable property of said
city are hereby irrevocably pledged for the punctual payment of the
interest and redemption of the principal of this bond, respectively,
as the same become due and are payable as aforesaid.

construct a settling basin at a cost of approximately $15,000, in
and for said city, as mentioned in section 1 hereof, there shall be
and there are hereby authorized, ordered and directed to be issued

Section 4. That each of the bo-jds hereby authorized
shall be signed by the mayor and city clerk and sealed with the
corporate seal of said city, which seal shall be impressed thereon;
that each of the interest coupons to be attached to e.ach of said
bonds shall be executed by the engraved facsimile signatures of
said mayor and city clerk, and the officers in this paragraph
mentioned are hereby authorized, ordered and directed to cause
said bonds and coupons to be prepared substantially in the forms,
respectively, he-reinabove set forth and to execute the same for
end on behalf of said city, as and in the manner aforesaid; and
after their execution and before said bonds are delivered to the
purchasers thereof, they shall be registered by the city clerk in
a public record book kept for that purpose in his office, which
shall show that said bonds were issued by said city, the amount
of each bond, its number, date of issuance, time and place of
payment, rate of interest, number of interest coupons attached.,
name and postoff ice address of the purchaser and a proper de-
scription thereof for future identification.

Section 5. That for the purpose of providing the
necessary funds to pay the interest accruing on said waterworks,
Series A Bonds promptly when and as the same falls due and to
discharge the p rincipal thereof at the respec tive maturity dates,
there shall be and by this ordinanc e there is hereby levied
upon all the taxable property in---sa id city, 'in addition to all

and said tax when collected shall be the city treasurer be kept,
in a separate fund to be designated "Waterworks Bonds, Series A.
dated July 1st, 1923". which shall be irrevocably pledged to and
used solely for the payment of the interest accruing on and the
principal of the said waterworks bonds, Series A, hereby author-
ized when due, so long as any of said bonds, or the interest
couxrjons thereto appertaining remain outstanding and unpaid, and
for greater certainty the city council bhall in each of said
years 1923 to 1942, both inclusive, include the bond tax here-
inable levied for each such year in the annual estimate for city
purposes for said year; and annually and at the lawful time said
bond tax s hall. in each of said gears be certified to the county
treasurer of said county, extended upon the tax rolls and col-
lected by the same officers, in the same manner, and at the same
time as the taxes for general city, county and school district
purposes for said county for such year are certified* extended
and collected, and in case taxes sufficient to pay smi-annual
interest on said bonds, due January 1 and July 1, 19249 and the
principal due July 1, 1924, cannot be levied and collected in
time to pay said interest and principal when due, then same shall
be paid out of the general fund of said city of Laurel and said
interest and principal shall be levied and collected in the year
1924 and the said general fund shall be reimbursed therefrom.
Section 6. That for the purpose of providing the
necessary funds to pay the interest accruing on said waterworks

discharge the principal thereof at the respective maturity dates,
there shall be. and by this ordinance there is hereby levied upon
all the taxable property in said city, in addition to all other
taxes, the following direct annual ad valorem tax, in each of the
years and for the amounts of principal and interest respectively

and said tax when collected shall be the city treasurer be'--'kept, in
a separate fund to be designated "waterworks Bonds, Series B,
dated July lot, 1923", which shall be irrevocably pledged to and
used solely for the payment of the interest accruing on and the
principal of the said waterworks bonds, Series B. hereby author-
ized when due, so long as any of said bonds or the interest cou-
pons thereto appertaining remain outstanding and unpaid, and for
greater certainty the city council shall in each of said gears
1923 to 1942, both inclusive, include the bond tax.hereinabove
levied for each such year in the annual estimate for city pur-
poses for said year; and annually and at the lawful times said
bond tax shall in each of said years be certified to the county
treasurer of said county, extended upon the tax rolls and col-
lected by the same officers, in the same manner and at the same
time as the taxes for general city, county and school district
purposes for said county for such year are certified, extended
and collected, and in case taxes sufficient to pay semi-annual
interest on said bonds,, due January 1 and July 1, 1924 and the
principal due July 1,1924, cannot be levied and collected in time
to pay said interest and principal when due, then same shall be
paid out of the general fund of said city of Laurel, and said
interest and principal shall be levied and collected in the year
1924 and the said general fund shall be reimbursed therefrom.
Section 7. That on the 15th day of December, 1923 and
on the 15th days of June and December., respectively, in each year,
so long as any of the bonds hereby authorized to be issued remain
outstanding and unpaid, the city treasurer shall and he is hereby
ordered, authorized and directed to remit out of any moneys in his
hands belonging to said city, in the form of check or draft pay-
able in New York City, U. S. A., to the Banking.3ouse of Kountze
Brothers, in the city and state of New York, U. S. A., a sum
sufficient to pay the semi-annual interest accruing on said bonds
on the first days of January and July respectively thereafter and
on the 15th day of June in each year he shall so remit a sum suf-
ficient to pay the principal maturing on said bonds on the first
day of July, in each of the years 1924 to 19431 inclusive, to-
gether with any-.:.:and all handling or exchange charges made by said
bank for handling said coupons and bonds.
Section 8. That the mayor, treasurer and clerk, re-
spectively, of said city, the treasurer and auditor, respectively,
of said county, are hereby authorize d, ordered and directed to
furnish the purchasers of said bonds with such certificiates
transcripts or other documents as will fully evidence the pro-
ceedings had preliminary to the issuance of said bonds, the
j regularity and sufficiency thereof, and the acts of said officers
in the premises are hereby declared authorized, ratified, approved

Section 9. That the provisions of this ordinance and
each of the bonds and interest cou_gons issued :pursuant hereto,
shall constitute and the same are hereby declared to be a binging
and irrevocable contract between said city and the pruchasers of
said bonds and the holder from time to time of each of said bonds
and the interest cou-Pons thereto appertaining.
Section 10. That any and all ordinances, or parts
thereof, heretofore adopted in conflict with the provisions hereof,
or which would in any way prevent the passage and adoption of this
ordinance at this meeting, be and the same are hereby repealed.
Section 11. That inasmuch as it is necessary for the
iranediate preservation of the -public peace, health and safety,
that the city have an adequate water works system installed
immediately, an emergency is hereby declared to exist and this
ordinance, therefore, shall take effect immediately after its
passage and approval and shall be thereafter irrep.ealable until
the indebtedness hereby created, both as to principal and in-
terest, shall have been fully paid, satisfied and discharged."

Thereupon Cjuncilman Hageman moved that any and all
rules of the council requiring ordinances to be referred to a
committee and taken under advisement until the next regular
meeting of the council, and any and all rules which would., unless
suspended -prevent the final -passage of said ordinance at this
meeting be suspended, and that said -proposed ordinance so intro-
duced and read, be further read a second and a third time fully
and distincly at length at this meeting and placed upon its
final passage.
Said motion was seconded by Councilman Coy.
The mayor stated the motion and put the question, upon
the suspension of the rules as aforesaid, and the vote upon said

The Mayor then declared that said motion had duly
carried by the unanimous assent of all members of the city
council present, and under the motion, directed the clerk to
read the Ordinance the second time.

The Mayor stated, under the motion, that the Ordinance
stood for third reading, and directed the clerk to read the

city council, duly signed and approved said Ordinance, No. 272.
Ordinance No. 272 was thereupon ordered to be recorded
in Ordinance Book No. 1 of said city, and was thereafter duly
recorded there at pages -- to -- inclusive.

Minutes of the City Council of Laurel
Laurel, Montana,
October 16, 1923.
The City Council of the City of Lauxel met in regular
session in the Council Chamber in the City Hall and was called
to order by Mayor H. A. Carlisle at 8;00 o'clock P. M. October
16, 1923.
Upon roll call, the following Aldermen answered present;
Price
Hageman
Nicola
Perry
Coy
The City Engineer, who had been instructed at the
meeting of October 2nd to make a survey of the alley in Block
1, Laurel Realty Subdivision, filed a written report recom-
mending pavement of the alley if the property owners desire.
It was moved and seconded that the report of the engineer be
adopted. The motion carried.
after some discussion of the bill filed by the New
York Herald for the printing of notice of bond sale, it was
moved and seconded that the Oity Clerk be instructed to notify
Crosby-McConnell and Company that the bill filed was unreasonable
and that the City was not disposed to pay for any part of the
bill occasioned by their mistake in writing notice. The motion
carried.
It was moved and seconded that we do now adjourn. The
motion carried.
