The City Council of the City of Laurel met in regular session in the Council Chamber in the City Hall and was called to order by Mayor Frank `-right at 8:00 P. Y., February 6, 1923. Upon roll call, the following Aldermen answered present: Uor dahl Clark Hageman .Knudsen Price- Richardson The minutes of the adjourned regular session of January 23rd and Special session of January 29th were read ?.,..._ and approved. j The reportz of the Chief of Police and Police Judge for the month of January and City Treasurer's report for the month of December 'were read and appio ved. The bills for the month of January were referred to the Committee on Finance and aster due deliberation, the Com- mittee reported back recommending the payment of the following bills: Fat. It was moved and seconded that the re-Oart of the Committee be adopted and that the Clerk be instructed to draw warrants upon he proper funds in pa7ment o o the bills allowed. The motion carried. The corrorittee appointed at the adjourned regular meeting of January 23rd, consisting of Vordahl, 717-nudsen and Price, to make reconznendation in regard to the consolidation of the Ilorthern rac ific and City purx9ing plants reported outlining three propositions to be r cllae to the Northern Pacific Rail,day Company, conditioned on the legal phases of the pro- - positions submitted; First. That the City allow the Northern Pacific to join on to our pump house facilities and pay X4000.00 tzthich represents one-half of the cost of the intake and to share the pump and intake labor in proportion to the amount of =mater used. Second. That the Borth e_r? Pacific construct all necessary buildings and appurtenances and the City to purchase them at cost -arid furnish the 1Ra' ilway Company with eater at 4 2/3 V per 1000 gallons for the first 500,000 gallons per day with that as a minimum charge, for all 'iu_ excess of 500,000 gallons 3 ? per 1000 gallons. It was roved by Hageman and seconded by Clark that the report of the committee be adopted and the Clerk be instructed to submit these `propositions to the Railway Company for their consideration', The motion carried. After some discussion on the question of H. D. Kenyon., Alderman from the Second Ward, having moved out of the City, it was moved and seconded that the office be declared vacant and that the Council proceed to elect an Alderman to fill the vacancy, The motion carried. Upon roll call, all Aldermen present voted aye and H, A, Carlisle was declared to be the duly elected Alderman to fill the vacancy of H. D Kenyon. petition by the Northern Pacific Railway Company A . addressed to the City Council and requesting the vacation of that certain tract of land lying interjacent Main Street and Northern' Pacific Right ?=of-way in the City of Laurel and extending from First avenue upon the west to Alder Avenue upon the east was presented and read. It was moved by Price and seconded by Hageman that the Petition be granted and that the Clerk be in- strueted to 'give notice of the intention of the Council to take fA Barrie d. The Clerk read a communication from the Northern Pacific Railway relative to the City" s lease on. railroad pro- perty for park purposes, after a brief discussion as to the advisability of accepting the 'additional ground: proposed by the tom an it u?as moved b 7-mudsen and seconded bar Richardson Ordinance No, 258, being an ordinance providing that the cost and expense of making improvements in Special Improve- ment District No, 52 shall be paid, by the property within such district, providing for the levying of a special assessment upon and against the property situated therein to defray the cost and expense of making such improvements and providing that such special assessment may be paid in ten annual equal installments extending over a period of ten years, was presented and read. After some discussion the ordinance was referred to a committee consisting of Clark, Knudsen and Vordahl. After due delibaration, the committee reported back recommending its immediate passage. It was moved and seconded that the report of the Committee be adopted and that the unanimous 'eonsent and vote of the Council be had to place Ordinance No, 9,58 on its immediate passage. Upon roll call, all Aldermen present voted aye, It was moved and seconded that Ordinance No. 258 be passed and adopted, Upon roll call, all Aldermen present voted afire and the said j' ordinance was declared passed and adopted, RESOLUTION NO. 284, Resolution No. 2841 being a resol-ation levying and assessing a tax upon all property in Special Improvement District No. 52 of the City of Laurel,- Montana, to defray the cost of making improvements in said Special Improvement District, was presented and read, It was moved by Alderman Knudsen and seconded by Alderman Price that said Resolution be provisionally passed, . Upon roll call, all Aldermen present:;v.oted aye and said. Resolution No; 284 was declared provisionally passed. ORDINANCE NO. 259. Special Improvement District No, 58 of then City of Laurel, Montana, to defray the cost of 1 making improvements in said Special Improvement District, was ; presented and read. It was moved by Aldermen Richardson and seconded by Alderman. Vordahl that said Resolution be provisionally passed. Upon roll call, all aldermen present voted aye and said Resolution No, a&5 was declared provisionally passed. ORDINANCE NO, 260. Ordinance No. 260, being an ordinance providing that ; the cost and expense of making improvements in Special Improve- ? went District. Ho. 60 shall be paid: by the property within such district, providing for the levying of a special assessment upon and agin.st the property situated therein to defray the cost and expense of making such improvements and providing that such { special assessment may be paid in ten annual equal installments { extending over a"period of ten years, was presented and read. Upon roll call, all `Aldermen present voted aye. It was moved and seconded that Ordinance No 260 be passed and adopted. Upon roll call, all Aldermen present voted aye and the said ordinance was declared passed and adopted. j RESOLUTION NO. 286, Resolution No. 286:- being a. resolution levying and assessing a tax upon all property in Special Improvement District No. 60 of the City of Laurel, Montana., to defray the cost of making improvements in said Special Improvement District, was presented and read. It was moved by Alderman Knudsen and seconded by Alderman Priee that said Resolutio.n be provisionally passed. Upon roll call, all Aldermen present voted aye and said Resolution. 286 was declared provisionally passed. After considerable discussion relative to the condition of the City Water System,_ it was moved by Price and seconded by Hageman that the Clerk and City Attorney prepare the necessary J' resolutions for the creation of a Special Improvement District for the replacement of the transmission main and 'including a settling basin providing that no leggy obstacles be encountered.
