Minutes of the City Council of Laurel
May 19, 1936

The City Council of the City of laurel met in regular session in
the Council Chambers in the City Hall and was called to order by mayor
R. Broughton at 7:30 0' cloak P. M., May 19, 1936.
j Upon Roll Call the following Aldermen answered present:

The minutes of may 5th and may 14th were read and approved.
The Street and Alley committee reported regarding the application
of Mr. Joe Gehrett to plant a hedge three feet high can the north side of
his property where the curbing should go. After some discussion; it was
moved by I. N. Smith and seconded by Law that lar. Gehrett be allowed to
plant a hedge and keep it trimmed so as not to obstruct the vision., and- nat
to be over three feet high at any time, and to be ten feet from the sidewalk
running north and south. Upon Roll Call all aldermen present voted aye and
the motion carried.
The committee appointed to investigate the qualifications of
I. N. Smith, alderman from the bird Ward reported as follows:
"We, the undersigned committee, appointed by the Mayor t0
investigate the qualifications and eligibility of I. N. Smith as an alderman
from the Third Ward of the City of Laurel, Montana, and also to ascertain
what powers, if any, the Council has to remove him, report as follows:
That since he was issued a certificate of erection, has sub-
scribed to the oath of office, and become seated as an alderman.' the City
Council does not have the power to remove him from office.
That the City Council does not have the legal right to decide
the controversy raised by the written protest filed in this matter.
That he will be recognized as a member of the City Couneil until
such time as a court of competent jurisdiction shall or may `decide otherwise.

Mr. Reese Price appeared before the Council as a xep.resentat-ive of
Eire Department in regard to receiving two estimates on the; painting of the

aHbs7it a3 _f.o one years license. to, operate their establishmen.l. Mr ; Price
also ask the Council to make allowance in the budget for the expense of
sending two representatives to the State convention of the Firemen.
The Mayor .°declared a ten minute recess and ask the .sire and Police
Committee to meet with Mr. -Price and Mr. Herbert in regard to the matters and-,
they reported back that due "to the fact that the Chairman of the Committee was
absent, they would wait` until his return, have a meeting and report at the
next meeting.

A claim to the Yellowstone Bank for interest from TTov;fl;
Jan. 1, 1936 at 6% on $11,000 1916 Funding bonds in the amount 110.00
was presented and read. The claim was approved by the Finance Committee,
and it was moved by Conrad and seconded by Thomson that a warrant be issued
for same. The motion carried.
It was moved by L. L. Smith and seconded by hooters that the city
Treasurer be authorized to deliver the X11,000 of 1936 Refunding Serial
Bonds to the Yellowstone Bank and to pay and cancel the 1916 Funding Bonds
in like amount. The motion carried.
The Treasurer's delinquent license report was presented and read.
After some discussion, it was moved by Conrad and seconded by Law that the
Council authorize the City Attorney to take action to collect delinquent
licenses from L. G. Braswell, J. L. Hodges and E. L. Long, who have dis-
continued business. The motion carried.
It was moved by Conrad and seconded by L. L. Smith that the City
Attorney be authorized to take action to collect or cancel the license of
W. 'W. Teeters Dairy. The motion carried.
&%r. Conrad asked the Council to give the park Committee permission
to spend approximately .225.00 on the permanent improvement of two tennis
-' courts in the City Park, After discussion, it was moved by Bray and
seconded by Law the Park Committee be allowed to spend 0225.00 on the
improvement of the tennis courts. Upon roll call all aldermen present voted
aye and the motion carried.
It was moved by Conrad and seconded by L. L. Smith that the park
Committee be authorized to replace dead trees in the City,Park with ash trees,
or/willow trees if ash were not available. The motion carried.

Mayor Broughton had to leave and s.=r. Conrad, President' of the
Council presided during the remainder of the meeting.
It was moved by I. I. Smith and seconded by Thomson that we do
now adjourn. The motion carried.
