August 17, 1937
The City Council of the City of Laurel met in regular session in
the Council Chamber and was called to order by mayor Broughton at 7:30
o'clock P. M. August 17, 1937.
Upon roll call the following aldermen answered present:
Conrad
Geo. Smith
Scoarse
Thomson
Wooters
Dr. Smith
Gomer
Law
The minutes of August 3rd and August 11th were read and approved.
Mr. Conrad, Chairman of the Park Committee, reported that in regards
to moving the Continental Filling Station Building an estimated cost of
$600.00 for moving the building and $75.00 for a concrete foundation
was received from J. R. Goehringer, Billings, Montana. After discussion
it was moved by Conrad and seconded by Geo. Smith that' aft:e.einvesti-
gation ' the City could not accept the building. Upon roll call Conrad,
Geo. Smith, Thomson and Gomer voted yes and Scoarse, Wooters, Dr. Smith
and Law voted no, and the vote -being a tie the Mayor voted yes and the
motion was declared passed.
Mr. Geo. Shearer appeared before the Council to ascertain if the
Library would be able to operate full time during the coming year on the
budget allowed. It was explained that if it was impossible to operate,
the City Council:-mould be able to pass an emergency budget.
After discussion it was moved by Dr. Smith and seconded by Wooters
the Riverside Park be turned back to the donnors. Upon roll call all
aldermen present voted no except Wooters and Dr. Smith who voted yes
and the motion was declared lost.
The mayor left and Mr. Conrad, president of the Council presided
during his absence.
After discussion it was moved by Law and seconded by Thomson Geo.
Spomer living in the tourist cabin at Riverside Park be allowed three
days in which to vacate. The motion carried.
An application for a permit by B. L. Price to construct a modern
frame and stucco dwelling and garage on Lots 1 and 2, Block 2, Laurel
Realty Subdivision, size 26x36 and to cost approximately $2750.00, was
presented and read. It was moved by Law and seconded by Gomer the
permit be granted. The motion carried.
An application for a permit by Mrs. Mary Ann Drury to erect a sign
size 5+xlt over the sidewalk at the Gardner Drug to hang 102 ft. high,
was presented and read. It was moved by Dr. Smith and seconded by Gomer
the permit be granted and the sign hung according to City specifications.
The motion carried.
An application for a permit by Yale Oil Corp. to erect a sign to
extend five feet over the street and to be 11 to 14 feet high at 201 W.
Main St. was presented and read. It was moved by Dr. Smith and seconded
by Scoarse the permit be granted and the sign hung according to City
specifications. The motion carried.
An application for a permit by John Fox to construct a frame and
stucco dwelling to be modern, size 24x30, on Lots 9 and 10, Block 9,
Laurel Realty Subdivision, to cost approximately X4,000.00 was presented
and read. It was moved by Law and seconded by Gomer the permit be
granted. The motion carried.
An application by E. N. Philpott to tap water main on Yellowstone
Avenue for Lot 10, the Pete Nielson five acre tract, was presented and
read. After discussion it was moved by Law and seconded by Dr. Smith
the matter be referred to the Water Committee. The motion carried.
The report of the City Clerk for the month of July was presented
and read. It was moved by Dr. Smith and seconded by Thomson the report
be approved. The motion carried.

An application by Carl Barthuly for the position of janitor for the
City Hall and Library was presented and read. It was moved by Dr. Smith
and seconded by Scoarse the application be placed on file for future
reference. The motion carried.
ORDINANCE NO. 347
Ordinance No. 347, being an ordinance revising and amending Section
18, of Ordinance No. 345, relating to license fees and fines collected
from retail liquor, was presented and read for final approval and
adoption. It was moved by Thomson and seconded by Dr. Smith Ordinance
No. 345 be finally passed and adopted. Upon roll call all aldermen
present voted aye and the Ordinance was declared finally passed and
adopted.
RESOLUTION NO, 475
Resolution No. 475, being a resolution levying and assessing a
special tax against certain property, designated as Garbage District
No. 1, for the removal of Garbage, Snow, 'deeds and Refuse, was presented
and read for final passage and approval. The City Clerk produced proof
of publication in the Laurel Outlook and stated that no protests had
been received. It was moved by Thomson and seconded by Dr. Smith
Resolution No. 475 be finally passed and approved. Upon roll call all
aldermen present voted aye and the resolution was declared finally passed
and approved.
RESOLUTION NO. 476
Resolution No. 476, being a resolution levying and assessing a
special tax against certain property designated as Garbage District No. 2,
for the removal of Garbage, Snow, Weeds and Refuse, was presented and
read for final passage and approval. The City Clerk produced proof of
publication in the Laurel Outlook and stated that no protests had been
received. It was moved by Law and seconded by Thomson Resolution No. 476
be finally passed and approved. Upon roll call all aldermen present
voted aye and the resolution was declared finally passed and approved.
RESOLUTION NO. 477
Resolution No. 477, being a resolution levying and assessing all 'of
the property embraced within Special Improvement Lighting District No. 1,
of the City of Laurel, Montana, with three-fourths of the entire cost
of Maintenance and electrict current for the year 1937, was presented
and read for final passage and approval. The City Clerk produced proof
of publication in the Laurel Outlook and stated that no protests had been
received. It was moved by Law and seconded by Wooters Resolution No. 477
be finally passed and adopted. Upon roll call all aldermen present voted
aye and the resolution was declared finally passed and approved.
RESOLUTION NO. 478
Resolution No. 478, being a resolution levying and assessing a
I_.._ special tax against property herein described for tapping into trunk
line sewer created by Special Improvement District No. 3 of the City
of Laurel, was presented and read for final passage and approval. The
City Clerk produced proof of publication in the Laurel Outlook and
stated no protests had been received. It was moved by Thomson and
seconded by Scoarse Resolution No. 478 be finally passed and approved.
Upon roll call all aldermen present voted aye and the resolution was
declared finally passed and approved.
RESOLUTION NO, 479
Resolution No. 479, being a resolution levying taxes for general
and spee-ific purposes for the City of Laurel, Montana, for the fiscal
year beginning July 1, 1937, was presented and read. It was moved by
Thomson and seconded by Scoarse Resolution No. 479 be passed and approved.
Upon roll call all aldermen present voted aye and the resolution was
declared passed and approved.
RESOLUTION NO, 480
Resolution No. 480, being a resolution transferring the sum of
Four Hundred Fifty-Three Dollars and No/100 from the General Fund to
the Park Fund was presented and read. It was moved by Dr. Smith and
seconded by Geo. Smith Resolution No. 480 be passed and approved. Upon
roll call all aldermen present voted aye and the resolution was declared
passed and approved.
A report and recommendations from the Finance Committee was presented
and read, relative to changes in the office to conform with the State
Examiner's report of June 26, 1937. It was moved by Thomson and
seconded by Gomer the report be accepted and the recommendations put into

operation. Upon roll call all aldermen present voted aye and the
motion was declared passed.
12he Mayor returned and presided.
Mr. Law presented the matter of raising the salary of the Leading
Nan, Henry Kaiser. After discussion it was moved by Law and seconded
by Conrad, Henry Kaiserts salary be increased to 6212,? per hour. Upon
roll call all aldermen present voted aye and the motion was declared
passed.
Mr. Thomson presented the matter of raising the salaries of the
Pump House employees and Mr. Brohaugh appeared before the Council in
regards to the matter. After discussion it was moved by Law and
seconded by Scbarse that Mr. J. S. Brohaugh be given the contract for
pumping at the rate of $200.00 per month and the City to furnish a
night helper for an eight hour shift who is to be paid X100.00 per
month by the City. Upon roll call all aldermen present voted aye
and the motion was declared passed.
Mr. Price presented the matter of obtaining an estimate on the
cost of oiling a 24 ft. strip the length of Fifth Street with the
same specifications as used by the State Highway. It was moved by
Thomson and seconded by Dr. Smith the City Engineer prepare the
estimate. The motion carried.
It was moved and seconded we do now adjourn. The motion carried.
