The City Cour~ci]. of the City of Laurel met in special session in the C our~c it Chamber and' was called to order by- pda~or Conrad at
5:00 otclock P. P~. Apri1 15, 1942, to cor~~ider the contract with
the Northern Pacific Railway Company re~ardir~ the Sewage Disposal

Resolution Into. 592, being a resol~tio~ approving the contract ar~d
authc~ri~3.r~g the ~a~or to execute the same on behalf of the Gity
and ordering a copy of sa3.d contract spread upon the mir~ute~ of
this meeti~ag ~t~a~ introduced arld read. Th~reupor~, It was moved b~
- Vordahl and seconded by Thomson that Resolut3.on No. 592 b~ passed and adopted. Upon roll. call all aldermen presen'~ voted aye aYad
paid motion was declared passed.
The contract is as follow:
~'AGREEIvIENT made this 20th day of ,~priZ, 1942, between NORTHERN
PACIFIC RAILWAY COMPANY, hsreir~after called Railway Company, and CITY OF LAUREL, State of l~on'~a~a, hereinafter called City, ~VITATESSETH:
Fora nwnber of years the Git~ and Northwestern Improve~er~t
Company, a corporation, a ~ub~idiary of thg RaiZwa~r Company, have
~o3.ntl.y owned and r,~intaine~l certain lines of eighteen (18) finch
sewer, the outlet of which has been aad now is into and through a twenty (20) inch sewer owned by the Railvua~ Company, said twer~~~
(20) ir~eh sever carrying the sewage to Yellowstone Rive. ,~baut
November 25, 194 , the ~ontarxa State Board of Hea1~h issued an order
requiring t~.e City to arrange for ~rea~me~t of sanitary sewage before
it is emptied into said ri~rer. Plans and arrangements havir~~ beers
made, the City is about to construct a ~anitarg sewage treating p].a to be situated near slid r3.ver, and has s~sured an eas~me~t for the
purpose of laying a ner~ ei~hte~~ (l8} inch 1i~ae cif ~e~rer through
which the sewage aceu~nulated in the City will be b.rough~ to the
proposed se~rag~ treating plant. the rowndhouse, car shop, poa~~r
plank a~ad inc ider~tal railroad fac3.13tie~ of the Railway Compar~~r,

Railway Cornpa.ny~ therefore desires an arrangeu~er~t ~v3.~h the Ci~~ so that
the sewage ori~3.~aati.ng at the Ra3.lv~ay Compaiay~ s exiting facil3.ties
ar~d facilities wh3.eh may be constructed i~t the future may be treated
at aiad through the treating plant about to be erected by the Git~.

NOS THEREFORE the parties agree as fo3.:Lo~vs:
I.
The pa.r~ies hereto ~vi11 cor~tirau~ to maintain anal to u~~ as
heretofore the line of sewer 3o~.~t1y owned as above stated, shown ire

and future additional connections, and also have the right to
discharge sanitary sewage through connections a~ suitable locations
on the r~e~r sewer 13.~e between points ~'An, ~'B", ar~d 'rCr'. It is u~- derstood that after completion of the treat3.ng plant tl~.e Railwa~r
Companp will eor~tir~ue to discharge industrial ~as~~ water info ar~d
through the privately owned twenty (20) inch sewer exter~d3ng from
point ~'C~' to the river.
II.
The City agrees to erect a pls~r~t of suff3.c3ez~~ eapae3.ty and
proportions ar~d to receive i~a 3.ts lir~e~ of sewer the 9anit~~y sewage
that map originate in the present a~ad future struc~ure~ of the
Rail~ray Comp~.ny, and to treat said sewage ire the t,r~ating plant 3.n
all 9~espects as sewage origir~atir~g in the City 3.s treaded and
t~~.BjJOSet~ Qf.
III .
The Railv~ay Company ,agrees to cont.~3.bu~e to apply on the
original. cost of the City's treating plant tM.~ sum of Eleven Thousand
Dollars {~11,000.0~), It is agreed that no demand i~ the future will. be made ors the Railwa~r Company to eant~ribute to the cost of any
additio~~, reconstructio~a or changes ire said treatir~~ plant.
IV .
The Railway Campar~y will be charged for the services of the
City and agrees to pay a fair service charge, pa;~men'~s to b~ made ar~aually, quarterly yr at such other ir~terga~.s as may b~ ~~r~ed upon.
Said service cha.r~e will be computed as follows:

Compar~y~s structures arad the er~t~.re quantity treated in the test
period ~t the treati~ag plant. Thy service charge so ascertained
shall continue to be the basis for the rate assessed upoza 'the
