Motion by Bud Johnson, second by Laurel Haggart, to approve the minutes of the
April 6, 2000 meeting. Motion carried 7-0.
Preliminary Plat- Salo Subdivision
This is a simple preliminary plat consisting of two ten-acre lots that front off of Boggio
Lane. This is the property that was previously being used as a halfway house by another
owner. A halfway house was not allowed to be in the residential zone.
The water system will bc domestic well and sewer will be septic system. Fire protection
will be through Laurel and law enforcement will be tiTrough Yellowstone County
Sheriffs department.
Mr. Salo plans to remove more of the nuisance items and rebuild the old corrals and put
in new corrals and a steel building for horses.
Cat recommends approval.
Motion by Kurt Baltrusch, second by Bud Johnson to recommend approval of the
Salo Subdivision Preliminary plat. Motion carried 7-0.
Reviewing a Draft Resolution Creating a Method of Determining a Fair Market
Value for Land Being Subdivided When Cash is to be donated in Lieu of Park Land
Dedication.
This resolution has been used in the City of Billings for many years, and in Yellowstone
County for a few months. It has been successful for the City of Billings and seems to be
the fairest way of determining a fair market value for land.
Motion by Kurt Baltrusch, second by Bud Johnson to recommend the resolution
be approved. Motion carried %0.
At this time Ed Thumer arrived at the meeting. (7:09 pm)
Review process for Home Daycare
Cal checked with the State of Montana regarding this issue and was told that the City
should not get anymore involved than we already arc.
Our Ordinances allow us to review Home Daycare's only when there are over 12 children
through the home occupation process.
Cai said we should continue to require all home daycare centers go through the home
occupation process so that both the City and neighbors arc notified of the proposed
center.
Miscellaneous Other
Cat updated the board on the situation with the River' s Edge (old Palm Beach Supper
Club). They are planning to apply for a zone change request to allow the mobile home
that she placed on the property illegally to remain on the property. The neighbor next
door also has placed a mobile home on his property illegally and was sent a letter to
remove it.
The gentleman provided money for Bill Fiegel's Clark' s Camp is trying to get the city to
help him get back some of the money he lost. Cal told him that fie City of Laurel and
Yellowstone County are NOT in a position to do that.
Cal was questioned on Little Tykes Academy out on Seitz Ronan. The board granted
them a special review to allow a business at that address with the stipulation that the road
into the Academy be on Ramshorn and not Seitz Ronan. The access was built off of Seitz
Ronan. Cat will consult with the City Attomey regarding this matter.
Cat passed out the preliminary budget figures that he put together for the budget/finance
committee.

City Council agenda items:
The Planning Board recommends that the Laurel City Council adopt the resolution
"Creating a method of determining fair market value for land being subdivided when
cash is to be donated in lieu of park land dedication", with no public hearing being held
unless the City Attorney recommends one.
Motion by Tom Roberms, second by Clarence Foos, to adjoun~ the meeting. The
meeting was adjourned at 7:45 pm.

RESOLUTION NO.
A RESOLUTION OF THE CITY OF LAUREL, MONTANA CREATING A METHOD
OF DETERMINING FAIR MARKET VALUE FOR LAND BEING SUBDIVIDED
WHEN CASH IS TO BE DONATED IN LIEU OF PARK LAND DEDICATION.
WHEREAS, State law provides that when a cash donation is to be accepted in lieu of the
dedication of land for parks or playgrounds when property is being subdivided, the mount
of that cash donation shall be the fair market value of the unsubdivided and unimproved
land which would have otherwise been dedicated; and
WHEREAS, the previous policy of determining the fair market value by using the
appraised value data recorded in the County Assessor's Office has not resulted in
determination of actual fair market value in all cases;
WHEREFORE, be it hereby resolved by the City Council of the City of Laurel, Montana:
1. At the time the preliminary plat is submitted to the City-County Planning
Department, the subdivider shall submit evidence to be used in determining the fair market
value of the unsubdivided and unimproved land being subdivided.
2. The evidence to be submitted by the subdivider shall meet the following
criteria:
A. It shall show the actual per acre sale price of at least three (3)
comparable parcels offand.
B. The comparable sales must have occurred within three (3) years of
the date of the subdivision submittal.
C, Information on sales of parcels located more than two (2) miles
From the subject property will not be acceptable except in those cases where no
information is available on sales within two (2) miles within the past three (3) years.
3. The City COUncil Of the City of Laurel'based on the information submitted
by the subdivider and the City-County Planning Board--shall determine the amount of the
cash donation which will be accepted in lieu of park land dedication. Such decision will be
made by the City Council at the time the Council acts on the preliminary plat.
