J, Parker, at 7:30 o'clock P.M. Upon tall call' the following aldsrrnen arsswered present, Tra D. Rodgers A, E. Leuthold J. E. Freebtary E. H. Eberavill~r Roy Horning bdalter Menell.o Jake Ruff John Besl~nw3.tch The minute o~ the previous meeting were read. It was rnov~d by Ruff and seconded by L~uthold that these minutes be approved as read. Motion harried. Mr. OTConn~11 and Mr. ~J'ood appeared before the council regarding some vacant lots owned by the Lutheran Church. .The City would like to place a skat- in~ rink on these lots. This was agreeable with the Church provided ghat thc~ Church would be absolved of arty and all liability in case of accident. It was moved by Freeburg and seconded bar Ebersviller that a contract be drawn up with the Church for a consideration of $1.~0~ claiming all responsibility for accidents on these lots. Motion Carried. Mr. Robinson representative for Black and Veatch appeared `before tY~ Council and explained in detaa.l the arbitration set up of the question of liquida- ted damages due the city from Cop Construction Company. He stated that the arbitrater had recommended damages in the amount of eighty (80~ days to b~ paid to the Gity~ si~tty-five (65) days to be paid by Cop Cons~ruction~ and fifteen (].5? days to be paid to the City by Bacharaeh, Incorporated. Mr. Robinson stated that Bacharach was not included. in the arbitration, and would decline to pay the fifteen days. Mr. Robinson suggested that Mr. Morrison, the arbiarator~ be contacted and a~k~d to submit a supplemental reports deleting Bacharaeh~ Incorporated. ~Ir. Robinson also delivered a message to the Mayor and Council from Mr. Banker. Mr. Engebregson ~ppear~d before the ~ouneil to state that Pfir. Greening would accept the statements and recommendations as sit forth in Resolution No. 102lt. Mr. Engebregson also asked for a legal description of this property. It was moved by BesZanwitch and seconded by Ebersviller that the City ~gineer dr~.w up a 1ega1 description of this propertg~ the procedure is then to be as follows Petition to be prepared and brought before the Councils regarding the vacation of this property, Notice to be prepared by the ~l.erk, and published for two con- se~cutiv@ weeks in the Laurel. Outlook. Clydinance to vacate the property and close the street. City to thin issue a Quit ~7.aim Deeds and Bill of Sale to this property. Motion Carried. Mr. Greening then agx~eed to pay this year's taxes on the propert~r. RESOLUTION N0. 1025 Resolution ~To. 1Q25,~ being a resolution transferring certain Bands of the City o~ Laurels namely One Hundred forty-four (],l~.~..00} Dollars from the •General Fund to the Police Fundy for fines collected in Qetober~ and X498.95 frc~an the General F~.u~d to the Sidewalk Funds was presented. Tt Baas mowed by Horning and seconded by Eb~rsviller that this resolution be approved. upon taking roll ca11 vote, all aldermen present voted ~~Ay~?~~ and resolution No. 1025 was declared passed and approv~;d. St was moved by Leuthold and sesconded by B~,slanwitch that this resolution be ~.pproved. Upon taking roll. c~.l.l votes all aldermen present voted ~~.Aye", and resolution No. 1025 was declared passed and approved, Clerk's report for the month of petober was presented. It w~,s z+ioved by Beslanwitch and seconded by Horning that this report be approved. Motion Carri~d~ Water report for the month of October was presented. It was moved by Lauthold and seconded by Horning that this report be approved. Motion ~Gmrried. Water Registrars report for the month of Qctober was presented. It was moved by Horning and seconded by Beslanwitch that this report be approved. Nation Carried, I~ I _ Minutes of the City Council of Laurel City Tre~surer~s report for the month of October was pre~~nted. It was moved by Horning and seconded by B~slanwitch that this report b~ approved whin corrected. Motion carried. I~~tter was read from the County Treasurer of Yellowstone County regard- ing the pereents~ge of liquor tax that would be forthcoming to the City of Laur~l~ in thy: amount of X567.90 for this quarter. Mr. F'reebury reported on the taxes for the City of laurel. Hs recom- mended that this year the taxes be paid from the department i.nvolv~d, rather than paying all out of General and Park as was done previously. S.T.D. taxes to be borne by the General Fund. It was moved by Ebersviller and seconded by Rodgers that the matter of taxes be referred to the Finance committee with authority to act. Motion carried. Mr. Rathbun requested that the men who wished to have Fridays Nov~nber 29th! 1957 as a day offs be allowed to have this tame,. provi.d~d that there were enough men to carry on the City work, and this tim~~ if taken to come off their vacation time. It was moved by Beslanwitch and seconded by Ebersviller that the men b~ allowed to have this day offs provided the tame was taken off the vacation time. Motion carried. Mr. Bradley reported that a Mrs. Morrison would like to deed c~rtai property to the City and asked whether or not the City would accept it. I~ way moved by Beslanwitch and seconded by L~uthold to accept this property. Motaton Carried. Mr. Leuthold stated that h~ felt that we should keep stressing the passage of the proposed storm sewer. AZr. Rodgers requested a meting of the followa.ng rriemhers of the Council to decide on the purphase of anew sewer machine. Mr. Horning, Rodgers Mr. Ruffs Mr. Freebury~ Mr. Leuthold and Mr. Rathbun. Meeting to be set for a later date. There being no further business to conduct at this times Motion was made and seconded that the meting be adjourned. Motion Garried. orothy P.
