Parker ~t 1:30 p.m., May 9, 1957. ~ther$ present included Alde~~n J. E. Freeburg, A. E. Leuthald, E. H. Ebersviller, &oy Horning, daeob.~iiFf, Jahn Bes- lanwitch, Cit~* Attortaey Tom Bradley, City Engineer Lowell Rathbun, and Ja.~es ygons, representing Cop Cmns~ruction eampany and J. L. Flynn Company. The p~r- pose oP the meeting, a~ stated by the m~ymr, was to decide on a mutually aeeep~- able arbitrator to settle the controversy of the amount of liquidated damages d~.e tie City of Laurel by the Cop Construction C«mmpan~r and J. L. Flynn company because of their failure to complete constrractio~ of the water plant by tMe date specified. It was agreed by those present that an engineer familiar with this type of work be called as the arbitrator. Mr. Lyons suggested the Pollowir~g: JaY~ Morrison or Joe Maierle of the Mvrrison~Iaierle engineering f~.~m of H~ler~a, Montana, and William 'G~fenzel, cong~lti.rig engineer, Great Falls, as a gird possibility. Mr. Et>ersviller moved that John Morrison or Joe Maierle be eontact~d by the city engin- eer to act as arbitrator, or William Wenzel if the first tiro were ~a~.lable. Motion was seconded by Mr. Freebtzry, arsi was passed by the members of the council present. Mr. Lyons suggested that iY possible, approximate arbitration fees be determin~cl before arbitration, and if they seemed too gnat, that another meeting be called before proceeding any farther, and this was generally concurred with by those present. Mr. Lyons requested that if at all possible that a conference be called during arbitration to ir~elude the arbitrator, Toms Robinson of Black ~ Veatah, L~,r~ll ~iathbun and hi~s~lf.
