Susan has a complaint against the city regarding the burial of her baby. (See attached incident report). Motion by Bruce Teeters that the incident report be sent to the city's insurance company. Seconded by Frank Smith. Motion carried. It was the hoards recommendation that in the future if someone wants a grave moved they should be informed that the city's policy is that family members should not be present and they will be informed when the job is complete. There was discussion regarding a headstone being put up in the veterans section for Orville Spoon. Mr. Spoon has been cremated and there will be no burial but they would like a lot with a headstone in bis memory. Lloyd Shay stated that the Legion has discussed this and see no problems since Orville lived in Laurel for many years. The committee suggested that since there was not ~oing to be any burial that one of the corner lots be used. MONTANA 59044 December 14, 1990 PUBLIC WORKS DEPARTMENT The incident report filed by Susan M. Stabelfeldt and dated December 6, 1990, pertains to the grave of her child. The grave site is defined as being located in SeCtion G, Block 41, Lot 3 and the burial occured on September 20, 1986. On October 2, 1990 there was a burial in the adjacent grave to the south of the Stabelfeldt grave. On November 13, 1990, Susan Stabelfeldt came to the Laurel City Ball and reported to the Assistant City Clerk that she felt the burial of October 2, 1990, was to close to her baby's grave and in the wrong location. The City of Laurel staff went to the cemetery and upon checking measurements determined that the burial of October 2, 1990, was correct and that the location of casket and fiberglass vault for the Stabelfeldt baby was not in the center of the grave lot. Susan Stabelfeldt was informed of the investigation. She then reguested that the casket and vault be repositioned, so that she could have the headstone placed in the center of the grave lot. The grave lots are 4 feet wide and 10 feet long. On November 16, 1990, the city crew excavated the site, in the presence of Susan Stabelfeldt and found that the fiberglass vault was located 6 inches from the south lot line and 12 inches from the west and front of the lot. The soil was removed from around the vault and the adjacent ground leveled. The vault was then slid north 12 inches and east 24 inches. Susan agreed that the position was acceptable and the dirt was then placed back in the site. · The entire action was witnessed by Susan Stab~lfeldt and two friends, Assistant Poblic Works Director~ and myself the Public Works Director. The City of Laurel moved and casket and vault to satisfy the request and concern of Susan Stabelfeldt. However, I would like to point out that the casket and vault were originally positioned within the grave plot. There is no ordinance or regulation that requires the vault and casket to be placed by centering such in the plot.
