R21-96 A RESOLUTION CANCELLING THE NOVEMBER 2, 2021, GENERAL ELECTION OF CERTAIN MUNICIPAL OFFICERS WHEREAS, MCA Section 13-1-403(4) and (5) authorizes a municipality to cancel a general election for the election of a municipal officer by resolution, after notification by the election administrator if the number of candidates filing for election is equal or less than the number of positions to be filled; and WHEREAS, by letter dated August 30, 2021, the City of Laurel received noticed by the Yellowstone County Election Administrator that the following elected municipal officer positions are eligible for cancellation: City Council Ward 1, City Council Ward 2, City Council Ward 3, and City Council Ward 4. WHEREAS, pursuant to Section 13-1-403 provides that a declaration of intent to be a write-in candidate must be filed with the election administrator by 5 p.m. on the 65`x' day before the date of the election, or August 30, 2021. WHEREAS, as of September 7, 2021, the following municipal officer positions remain eligible for cancellation: City Council Ward 1, City Council Ward 2, City Council Ward 3, and City Council Ward 4. NOW, THEREFORE, BE IT RESOLVED THAT: 1. The City of Laurel, by and through the City Council hereby cancels the November 2, 2021, general election for the following municipal officer positions: City Council Ward 1, City Council Ward 2, City Council Ward 3, and City Council Ward 4. 2. The following persons are hereby elected to the following municipal officer positions by acclamation: City Council Ward I Heidi Sparks (4 year term) City Council Ward 2 Michelle Mize (4 year term) City Council Ward 3 Iry Wilke (4 year term) City Council Ward 4 Richard A. Klose (4 year term) Introduced at a regular meeting of the City Council on September 7, 2021, by Council Member Sparks. The following candidates have filed for a nonpartisan municipal office in Yellowstone County and are running uncontested. In accordance with 13-1-403(4) MCA, the governing body may by resolution cancel the election for those races. If your governing body wishes to cancel, please forward a copy of the executed resolution to the Yellowstone County Election Office.
