Its On or about this 10th day of Ju1~r, 1970, Bob Mace, on behalf off' the McDonald Realty Company, filed a request with the Zoning Board of A.d~ustment to ~~rant a variance to move a house on to the following real property: ~ The North Half (N~) of Lot Eight (8) Lots Nice (9) and Ten (10), in Block Tin (lU) of the Fourth Avenue Subdivision. I 'i This aria is a R-1 zoned area, and the Zoning restriction~ prohibit any move- j ons in this area. Request for the variance was made on the basis that a build- ing permit hay been issued in error for the pro~ect~ and that the house was already moved. on, a.nd therefore, a hardship w~u1d exist if the variance were denied. ~ ~ The ?oning ~3oa~d. o~ Adjustment heard the request for the variance on the lath d.ay of July, 1970, and denied the same. For the City Council's information, w~ would like to state the reasons for our denial of this varia.nee. 1 1. It is the responsibility of a. builder to know and .follow Zoning ~ I requirements. Mx. Mae~* and the McDonald & Company are experienced realtors j and have built and sold many properties in this R-l zone. It i~ extremely diffi- cult for the Bated to believe: that they were ignorant of the zoning requir~ment~ in this area. Particula.rl~r, in view of the fact that the zoning requirements in an i'' R-1 area are simple and:f~w in number. 2. Tt is the policy of. the Zoning Board. to consider the feelings of the imm~d.iate neighborhood in regard to a proposed variance. Customarily, an applicant ~ will brim in a signed waiver or a,~r~ement in regard to the variance by the immediate ne3~hborhood in support o~ the application. In this instancse, we requested i;kie'<- ~~~l c~.t~t to contact the neighborhood. and to ascertain its feelings, However, the applicant declined to do so. W~ did not feel jus~ifi~d in ~rantin~ a variance where the people -~hemselve~ ~ have r~striet~d this type of building. 3. In regard to the issuance of the building ~~rmit in error, we have discussed this type of situation and cited the controlling provision of the Zoning Ordinance in a companion opinion regarding Air. Murray, ther~fore~ there is nv need to re~tat~ the sn~ here. 4. Insofar as elaimin~ the situation results in a hards~iip, we felt " that inasmuch as the house was built to be moved and. was in fact moved on, that it could in fact be moved off with very little expense and placed on a lot in an aria that did not have this restric-~ion. The basement could be salvaged by building thereani so that w~ felt the monetary loss to brim this situation into conformit with the Ordinance would be ver little. W~ would further Y ~ point out that only one-half of the house had been moved on the lot and the other half was still off when this violation of the Ordinance was discovered. Therefore, the applicant is responsible for incr~;asin~ his damages, 3.f any there are, by ~oin~ ahead and completing the move-an after the error way discovered. In summary, therefore, we feel that the ~.pplicant did not carry the burden of proof and show sufficient need or suf'.ficient hardship to sit aside the pro- visions of the Ordinance and especiall~r sines the applicant did not bring any evidence to over come thQ indication that the neighborhood was against this type of variance through their adoption of building restrictions prohibiting a 'I' move-nn. A Mr. Colbert, attorney, talked at length on this sub3ect. A Mr. Metzler spoke against phis building. Don Burka spoke and said he was next door and had no ob~ec~ions. Yovetich ~y asked whither or not construction has halted when the builders had been informed of their `ri.olation. Both Mace and McDonald said "No" they had. not. T3radl~~ asked if this building conforms to the standards- of the R-1 areas and Mated that the Council could over-ride the d.eci~ion of the Zoning Board, or could uphold the hoard's decision. Beslanwiteh made the motion that the Council over-rive the board and grant the vara.ance. A~t~rney Cfllbert stated ~ tha.t they wanted a variarac~ for the other four p~+opo~ed roll-ons as well. ` Yovetich stated that the Council should meet with thy; coning board first before a decision i~ made. Since there was a motion on the floor, the Mayor asked for a second, and there was none. Therefore, the motion died for lack of a second t~ the motion. T-~ornin~ then made the motion that the council uphold the Zoning Board's decision. Seconded by Jackson ~'arker. Parker stated that he thinks the ordinance needy re-vamping, but he did not wish to usurp the authority of the Zon.in~ Board. Upon taking a vote, motion carried, with B~slan~aitch voting ~'no'~. Letter was then read from Dave Murray, as kl.ng the council too over- ride the decision of the zoning Board, as follows: Honorable MaT,~or of Laurel Laurel City Council 117 West First Laurel, Montana Dear Sirs, On July 10, 1970 I received a letter from Johm Daley, ~h~ City Engineer of Laurel, Mating that we were in violation of the building ordina.nee in ptzttin~ four homes on seven lots which did not dive us the ~1~00 sq. minimum feet per site. H~ su~~;ested that I apply nor a variance ' from the Zoning Board of A~~ustments and correct any further violations of this nature. I met with the Zoning Board. ~f Adjustments on July 15~ 1970 and on July 16, 197fl I ~`ec~zved the following lettEr; j "Your request for a variance to build four homey on Zots 1~ thru lfl in Block Mt. The 1e~a1 description of the property Y~ involved is as follows i Lots Four through Ten (10) in Block Four G. of the Mountain Vista Subdivision to the City o~ Laurel. Request for the variance was made on the bads that a building permit ha.d been issued in error for the project and that the houses were already con~tructed~ and that therefore, a hardship would. exist if the variance were denied. The Zoning Board of Adjustments heard the request for the vas anae on the 15th r day o£ July, 197fl, and denied the same. ~d ~r For the City Council's information, we would like to st~.te the reasons for our denial of this variance: r I 1. The preamble of thy; Zoning Ordinance stated that it has been set ~s up .for the well-being and health of the inhabitants of the City, and that in the ~ interpretation anc~ application of the provisions of the ordinance that ~he~:~samQ are minimum requirements, and the purpose of the Ordinance i~ to create minimwn '1 standards in provi.c~ing adequate light, pure air, and safe from fire or other hazards and limiting the c~ncentra~ion of population. f" 2. It is thy: policy o£ our Board, and this is true of all Zoning Board, { that the applicant has the burden of proving thc; necessity and the desirability of the variance. 1 3. In re~axd to the issuing of the building permit in error, the ~onin~ drd~nance provide in Article IIT, Section 1.2~ ~.s follow : r'iVo permit will be valid unless the proposed construction is in Complete c:~mpliance with all provisions of this ordinance unless special exceptions are granted by proper ae~ion o~ the Hoard of Ad~ustmen~. The F3uilding Inspector is not impowered to made excerptions to the Zoning; Ordinance, and a permit erroneously issued in violation of any terms o~ the said Ordinance sha11 not be construed to supers~d~ the intend of the ordinance and shall be considered void and invalid.' It is the policy of our Board, and a~ far as we understand, of all Zoning Boards, to take into consideration the feelings of the people in the immediate neighborhood p~ the proposed variance. i is In regard to Mr. Murray~'s application, we feel that it was common knowled that two lots for building site way required in '~R.-1 Zone, ar~d that it is ex- tremely difficult to plead ignorance of this requirement when Mr. Murr~.y and the Real E~tat~ Mart have built many houses in that area based on this require- ' ment. In addition, them was no at~~mp~ by Mr. Murray to get the approval ~ off' the immediate neighborhood to the granting of this var3.ance. From what I t informatican we had, the neighborhood was opposed to the granting o~ the vari- 'I f~; anee. If the variance wire granted, it wo~.ld violate one of the basic purposes t`' o~ the Zoning ordinance as cited abon~~ that 3.s "to control the density of the population" in that these houses were very close together and certainly in- creasad the density of the people in that area. Insofar as the question of r, hardship upon the build.er~, it app~axed to tha Zoning Bard that in all probability, 8 feet or more adjoining Lot Lt could probabl~r be purchased from Mrs. Stc~1t~, whose properly adjoins this site on the youth. W~ feel, under the circumstances, the actual expedditu~e o~ money to bring this situation into corLformity would be very little:. We I further noted that given after the parties found that they were in violation o~ the Ordinance, their continued eon~truction on the site, and it could well be said that they increased their awn dam~,~es, if any there are. 'i In summary, th~r~fore, we feel that thy: applicant did not carry the burden of proof and show sufficient need or su.~'~'icient hardship to have u~ ~~t aside the strict provisions of the Ordinance or the desires of the neighborhood. I We would further point out that it appears to u~ that these houses are po~sibl~r ~ in violation of tie square footage requ3.r~ment of the Zoning Qrdinance in that the~~ houses are attempting to eslaim unfinished basement area ~,s part of the I total square Footage. The Orci.inanee itself is not clear on this pointy and therefor, we ~ug~e~tt to the City Cauncil that consideration be given to amend i the Zoning Ordinance so that this point may b~ clarified. We further request that if property other than singly-fam3.ly unit are construe~ed on land pr€~sently outside the Gity Limits, but-included in these subdivision, that, the Laurel City Council deny any requests for enty into the City or any requests for ~.ecess to city water and pity sewer. (signed by thirty-one per~on~) After diseussion~ motion was made by Yovet3ch and seconded by Jones that the Council uphold the decision of the Zoning Board. Motion carried. Motion was made bar Ebersvill~r and seconded by Beslanwitch that phis petition b~ accepted, end the City Engineer given authority to remove said hump. Motion carriRd. Jude Walter A. Motion carried. The Mayor thin turned this matter over to the remaining fourth ward alderman, Roy Horning, who was asked to come back to the council with a recommendation sug~~sting a replacement for Mr. Parker.
